Merrill Watkins, County Rep. Don Gudgell, County Rep. Cia.fence Foos, County Rep. Larry Thomas, City Rep. Billielou Lance, County Rep. Jim Ziegler, County Rep. Donna Kilpatrick, City Rep. Chuck Dickerson, City Rep. OTHERS PRESENT: Cal Cumin, City Planner Cheryll Lund, City Secretary Steve Barlow, Laurel Outlook Denise Younkin, 2741 Alpine View Brad Anderson, Billings Jon Dehler, Billings Gay Easton, Councilman Bob Graham, Councilman Chuck Rodgers, Mayor Motion by Billielou Lance, seconded by Clarence Foos, to approve the minutes of the September 8, 1994 meeting. Motion carried 11--0. Motion by Billielou Lance, seconded by Lonnie Kellogg, to approve the bill for administrative services for $200 and the bill for Cumin Associates (August-September-October 1994) for $3775. Motion carried 11--0. ANNEXATION REQUEST- JON DEHLER AND BRAD ANDERSON An annexation request has been submitted by Jon Dehler and Brad Anderson of Billings to annex 49.4237 acres into the city limits of the City of Laurel. The property is described as "that portion of N 1/2 NW 1/4 Sec. 15 T 2S R 24E, less E 25', N of 1-90 ROW" and is presently being used as farmland. It is located just east of Equipment Finders, and west of Hoffman's Greenhouse, north of the highway. The proposed intent is to use it in a recreational manner and put in a family entertainment center which will be named "Wild-Wild West Family Fun Center". The proposal includes a waterslide, mini golf course and a go cart track. The land is actually bigger than they need. acres. They need only 20 The center will be built in phases with the ground breaking being in the spring of 1995, if all goes as planned. Plenty of research was done on this before deciding what to actually build. They have also been waiting for the right timing with the Billings economy. They feel that time is now. The miniature golf co~rse will be unlike anything the area has seen. They plan a play area for kids, a basketball center, and a party room where people can have birthday parties for their children. There will also be a go-cart track and a waterslide. They plan to put in a camping area sometime in the future. They will keep with the wild west theme, something that will draw the crowd in and remind them that they are in Montana. Question on where the entrance to the park will be. They are hoping to send the traffic to E. Railroad and have them enter that way. But, there are actually several ways that they can enter the area. Question on whether or not the City services (water and sewer) are adequate for the future waterslide? Cal states that the amount of water to run the waterslide is minimal because you just fill up the waterslide once and the only water it loses is through evaporation. Cal also states that when they are ready to put in the campground these same questions will be brought up, discussed and fine tuned to meet the needs of a campground. Cal recommends approval subject to include the survey of record with the application. Motion by Donna Kilpatrick, seconded by Billielou Lance, to recommend to the City Council approval of this application subject to including the survey of record with the application. Motion carried 11--0. Cal suggested that the developer get with the City, and school district when they begin to plan the swimming complex. Maybe there is a way of combining the cost of the complex with the City and school so that everyone could share in the cost and benefits of the proposed complex. 2 Cal stated that this recreation area will be a big plus for Laurel. Not only will the City benefit from the taxes they will receive on the piece of land, but also from the extra revenue it will bring to the local businesses. TRAFFIC COUNTERS Cal stated that the County Planning Office in Billings is willing to set up their traffic counters, free of charge, on Airport Road. We needs to let them know, as soon as possible, where we would like the counters placed. It was decided to have one counter put somewhere after the Cemetery entrance and before the entrance to the airport. The second counter should be put on Airport Road after 72nd Street on the west side of the railroad tracks prior to Seitz Ronan Road. Chuck Dickerson suggested sending a letter of thanks to the County Planning Board for setting up the counters for our use. HOME OCCUPATION FORM-REVISED This revised form will be considered at the October meeting and there is a resolution to adopt the form. an ordinance on the agenda to establish a fee occupation. 18th council There is also for a home MERLE CHERRY- UPDATE Cal stated that Merle Cherry has come to him and notified him that he is not going to be able to build a house on the property that this Board gave him special permission to build a shop on (with a house to follow within an allotted time frame). This is one of the problems that sometimes comes about when we make an exception for someone. Now the next owner of the property will have to come before the board and we will give them an allotted amount of time to build a house in. In the meantime Merle continues working in his shop and Cal has received complaints about the noise and clutter it creates. The property is located in the 1200 block of 4th Avenue, which is in the county. Ziggy told Cal that he needs a letter sent to the County office in order to re-appoint Clarence Foos to the Board. Motion by Billielou Lance, seconded by Donna Kilpatrick, to adjourn the meeting. Motion carried 11--0. Only parcels of land adjacent to the City of Laurel municipal limits will be considered for annexation. "Adjacent to" also includes being across a public right of way. If the parcel to be annexed is smaller than one city block in size (2.06 acres), the City Council must approve consideration of the request; the applicant must make a separate written request to the City Council (for parcels smaller than a city block) stating their wish to annex a parcel of land less than one city block in size--and do so prior to fillip out and submitting this Request for Annexation. r 2. A map suitable for review of this application of the proposed area to be annexed must be submitted with this application. 6. A written Waiver of Protest must accompany this application, suitable for recording and containing a covenant to run with the land to be annexed, waiving all right of protest to the creation by the City of any needed improvement district for construction or maintenance of municipal services. This Waiver of Protest must be signed by the applicant prior to annexation by the City. 7. Requests for annexation are referred to the City-County Planning Board for recommendation to the City Council. Applicants should contact the planning representative prior to filling out this application. 8. Within thirty (30) days after receiving the properly filled out application with all required accompaniments and after conducting a duly advertised public hearing, the City- County Planning Board shall make recommendation to the City Council as to this Request for Annexation. If more information is needed from the applicant during the review of the application, such application shall be deemed incomplete and the timeframe for reporting to the City Council extended accordingly--if needed. 9. An application fee of one hundred dollars ($100) must accompany the submission of this application.
