COUNCIL CHAMBERS MEMBERS PRESENT: OTHERS PRESENT: Lonnie Kellogg, City Rep. Chuck Dickerson, City Rep. Merrill Watkins, County Rep. Don Gudgell, County Rep. Clarence Foos, County Rep. Jim Ziegler, County Rep. Larry Thomas, City Rep. Cal Cumin, City Planner Cheryll Lund, City Secretary Mr. & Mrs. Glen Watts, 3455 Old Hardin Rd., Blgs. Hazel Klein, 411 W. 14th, Laurel Dale and Nadine Stahl, 9 Aspen Way, Park City Sandra Nelson, 136 Byam Rd., Laurel Elmer & Diana Treftz, 1715 Bitterrot Dr., Blgs. Motion by Merrill Watkins, seconded by Ziggy Ziegler, to approve the minutes of the March 1995 meeting. Motion carried. Motion by Ziggy Ziegler, seconded by Merrill Watkins, to approve the administrative services bill for April 1995 of $200, and $3,375 for Jan.- Feb.- Mar. 1995 services of Cumin Associates. Motion carried. Preliminary Plat- Laurel Industrial Park Subdivision' Hazel Klein presented the preliminary plat for Laurel Industrial Park Subdivision. Cal recommends approval subject to: 1) The plat meets the standards of the City Engineer in regards to water and sewer lines; 2) Easements as requested by utility companies. Don Gudgell mentioned that he had talked to Rob Harris, owner of Fiberglass Structures that is located in the same area of this plat, and Rob could see no problem with approving the plat. Motion by Don Gudgell, seconded by Larry Thomas, to approve Laurel Industrial Park Subdivision pre-liminary plat subject to: 1) The plat meets the standards of the City Engineer in regards to water and sewer lines; 2) Easements as requested by utility companies. Motion carried. Montana Watts -Nuttinq Brothers Subdivision- Blocks 7 & 8 Montana Watts, 3455 Old Hardin Road, Billings, Montana, was present getting the boards opinion on a zone change on Nutting Brothers Subdivision, blocks 7 & 8, to a commercial zone. She would like to put in a mini-storage, which she feels would be used by the people in the mobile home courts located in the same area. She also states that the land is just sitting there as empty fields and is of no use to anyone as it sits now. Cal stated that he does not recommend doing so because it does not coincide with the comprehensive plan that Laurel has'established. He also feels that a commercial zone does not belong in the middle of residential zone. Larry Thomas also stated that he would not go along with putting a commercial zone in a residential area. Mrs. Watts questioned as to whether she residential or residential mobile home zone. could, but in order to get water and sewer would have to be annexed into the City. could change the zone to She was told that yes, she lines put in, the property (Note from Cheryll: We have had several people inquiring on this property in regards to annexation and zone changes in the past few months. Those people have expressed that if they do apply for a zone change they would request a change to residential or residential mobile home, not commercial. No one has put in an official zone change or annexation request yet.) Preliminary Plat- Sandra Subdivision Elmer Treftz presented the preliminary plat for Sandra Subdivision which is located off Byam Road on Highway 310. The intent of this preliminary plat is to divide a 3 acre tract into 2 parcels. The owner lives on the 1.089 acres tract and intends to sell the other 1.911 acre tract for residential use. The plat shows 2 accesses off of Byam Road for roads going in and out of both tracts. Cal recommends approval subject to: 1) Utility easements as requested by utility companies; 2) Both accesses get proper approval from the County; 3) Stipulations of convents are adhered to. Motion by Chuck Dickerson, seconded by Don gudgell, to approve the preliminary plat of Sandra Subdivision, subject to the following: 1) Utility easements as requested by utility companies; 2) Proper accesses are provided with proper approval from the County; 3) To the stipulations are spelled out in the subdivision improvements. Motion 2 carried. Cal received a complaint on the horses that are pastured in the public park on W. 9th Street. The complaint is that the park is being overused by the horses and is in poor shape because of the overuse. Lonnie Kellogg will check with Donna Kilpatrick, Park committee chairman, in regards to the complaint and they will go check out the validity of it. Cal mentioned the new subdivision being proposed east of Montana Meadows right next toMoss Main. Cal starts that there will be approximately 16 lots with about 1 acre in each lot. Cal explained that the Entertainment Subdivision is still going ahead with the zone change, and they will also submit a preliminary plat to plat the property into sellable lots. The reason the proposal fell through was due to 2 similar projects that are being built in the City of Billings. The backing behind the golf course is a 1 million dollar trust fund, and the waterslide is being built right now with an anticipated finish date of May 31st. Cal had a request to put Thiel Road within our zoning jurisdiction. Because it is out of the one mile jurisdiction it will take quite a bit of work on the part of the people wanting the zoning jurisdiction extension.
