CITY-COUNTY PLANNING BOARD
AUGUST 10, 1995 7:00 P.M.

Motion by Billielou Lance, seconded by Merrill Watkins, to
approve the minutes of the July 13, 1995 meeting. Motion carried
6--0.
Motion by Chuck Dickerson,
approve the City administrative

At this time Donna Kilpatrick arrived at the meeting.
PRELIMINARY PLAT- 13TH STREET ESTATES
Jim Worthington was present regarding the 3 tract preliminary plat.
He is representing Bob Floyd, owner of the property.
Lot 1 would be the 3 1/2 acres that Mr. Floyd's house is located
on. It is improved with grass.
Lots 2 and 3 are unimproved lots that are fenced in.
Cal recommends approval subject to: 1) Park land money required
(approximately $1800) be made in cash; 2) Roads need to meet the
standards set by Yellowstone County Surveyor's office; and 3)
Paragraph needs to be added regarding the status of irrigation
ditches on property and they need to be added to the drawing.
Motion by Donna Kilpatrick, seconded by Billielou Lance, to
recommend approval of this preliminary plat, subject to the
recommendations Cal made. Motion carried 7--0.
PROPOSED ZONING ORDINANCE CHANGES
Cal proposed several changes to the zoning ordinances.
He feels that we should put in an allowance for animals in the
larger residential zoned areas.
He would also like to change the RE 20,000 requirements to require
"stick built-on site" housing. He feels specific wording needs to
be put directly into the ordinances. He would like to have a
public hearing on these changes in September and act on them right
away once they receive the Attorney General's opinion on the
O'Toole residence.
Cal also recommends that the people drawing up subdivision
covenants have the same "stick built on-site" clarification put
into those covenants.
Motion by Chuck Dickerson, seconded by Don Gudgell, to have
Cal draft up the proposed zoning changes and have a public hearing
at the September 14, 1995 meeting. Motion carried 7--0.
UPDATE- O'TOOLE PROPERTY- 1819 W. MARYLAND
Cal reported to the board that the City Attorney has requested an
Attorney General's opinion regarding this issue. We can expect the
opinion to take up to 90 days.
Ruby Hansen, asked whether or not these proposed sone changes would
effect the situation at 1819 W. Maryland? Will it make it so that
the O'Toole's home will have to be moved? She is wondering whether
we are making up a rule, after the fact?
Cal stated that we will propose to change the zoning to require
stick-built on-site houses.
She is also wondering what the City is going to do if the state and
federal laws are different than what our proposed changes are?
Cal stated that it will not be a problem.
BUILDING PERMIT JURISDICTION CHANGE
Cal would like to send a letter from the Planning Board to the
Department of Commerce in support of expanding our building permit
jurisdiction outside the city limits.
Cal feels that expanding the permit area would eliminate some of
the problems that we have had, such as the O'Toole situation.
Motion by Chuck Dickerson,
give Cal permission to send a
building permit jurisdiction,
Motion carried 7--0.

Cal stated that the last legislative session made somewhat of a
mess of some of the subdivision laws. We haven't changed our laws
from the last session. As soon as the laws go into effect in
September he will have a draft of the changes we need to make.
Motion by Billielou Lance, seconded by Donna Kilpatrick, to
adjourn the meeting. The meeting was adjourned at 7:30 p.m.
