OLD COUNCIL CHAMBERS MEMBERS PRESENT: OTHERS PRESENT: Chairman- Donna Kilpatrick Ron Marshall Bob Graham Don Hackmann Chuck Rodgers Gay Easton Jim Flisrand Dave Michael Discussion regarding expanding on the snow removal, plowing and sanding of streets to include other street maintenance, per MCA 7-12-4401. There was no assessment in 1994, but normally the assessment was from $4.00 to $7.00 per 4200 sq. foot lot. The proposed assessment for 1995-96 "street maintenance" is $10.50 per 4200 sq. foot lot, which would amount to $58,359. The decrease in mills assessed for the FAP and storm sewer bonds will pretty much off set the increase in the street maintenance assessment. Motion by Ron Marshall, seconded by Bob Graham, to expand the snow removal, plowing and sanding district to include other street maintenance and to assess $10.50 per 4200 square foot lot for 1995- 96 street maintenance. Motion carried. FAP COMPLEX G.O. BONDS No assessment this year. The bonds will be paid off 1995. Last years assessment was 2 1/2 mills. in June of STORM SEWER G.O. BONDS Decrease Storm Sewer G.O. bond assessment from 14 mills to 12 mills. It appears that the 12 mills would be assessed in 1995, 1996, 1997 and 8 1/2 mills in 1998. The bonds will be paid off in June of 1999. LIGHT DISTRICT ~2- RESIDENTIAL Discussion regarding a decrease in the Light District %2 assessment from $23,366 to $18,693. The expenditures are projected to be $18,252. There is cash on hand to allow for future increases for several years. Motion by Bob Graham, seconded by Ron Marshall, to reduce the Light District #2 assessment from $23,366 to $18,693.00 (approximately 20%). Motion carried. LIGHT DISTRICT #3- COMMERCIAL AREA Recommend to leave the assessment the same as last year which is $14,809. The expenditures are projected to be $12,480. There is cash on hand to allow for future increases for several years. Nothing in 7-12-4351 through 7-12-4354 prevents the city or town council from eliminating un- necessary lights, relocating individual lights, upgrading lights and lighting- related facilities in the interest of energy conservation, or making other minor modifications in a special improvement lighting district without following the procedures described in 7-12-4351 through 7-12-4353. District cost excluded from municipal budget, 7-6-4222. 7-12-4401. Street maintenance district authorized - definition. (1) Whenever the council of any city or town desires to create a district for the maintenance of all or any part of the streets or avenues of its city or town as provided in this part, it shall provide by ordinance a method of doing said work and of paying for the same under the restrictions and regulations provided in this part. (2) "Maintenance" as used in this part includes but is not limited to sprinkling, graveling, oiling, chip sealing, seal coating, overlaying, treating, general cleaning, sweeping, flushing, snow removal, and leaf and debris removal. A resolution shall be adopted dividing the whole or any part of the city or town into maintenance districts, to be known and designated by number. Said resolution shall plainly define the boundaries of the district or districts and describe the streets, alleys, and public places or any part thereof constituting the district or districts. Manner of providing maintenance. The maintenance in districts so established may be done by contract or by forces employed by the city or town or by both, in such manner as the council may elect. • 625 IMPROVEMENT DISTRICTS 7-12-4422 History: En. (1) Cities and towns are hereby authorized and em- powered to prepare and improve streets, avenues, and alleys within the maintenance districts so that the maintenance will be of a durable and continuing benefit. The city or town council shall provide by ordinance a method or methods of doing said work and improvements. . (2) Cities and towns are authorized to maintain the work and improve- ments made under subsection (1). The city or town clerk must give notice of the introduction of such proposed ordinance and of the time it will be up for final adoption: (1) by publication three times in a daily newspaper or in a weekly newspaper for two successive issues in such city or town; or (2) if there be no such newspaper, then by posting for at least 10 days in three public places in each of the wards of said city or town. No further action shall be taken upon the proposed district for 1 year if a written protest against passage of the proposed ordinance is filed by: (1) owners of property within the proposed maintenance district having a taxable valuation, when aggregated, representing not less than 50% of the total taxable valuation of property within the district; (2) not less than 50% of the owners of property within the district; or (3) owners of property within the proposed maintenance district having projected assessments, when aggregated, representing not less than 50°/0 of the total projected assessments for property within the district. The assess- ments for the costs and expenses of maintaining streets, alleys, and public places shall be made against all of the property embraced within each maintenance district by one of the methods provided in 7-12-4422.
