HomeMy WebLinkAboutSpecial Council Workshop Minutes 10.23.2012 Minutes Special Council Workshop October 23, 2012 5:30 pm Council Chambers A Special Council Workshop was held in the Council Chambers and called to order by Mayor Ken Olson at 5:30 p.m. on October 23, 2012. COUNCIL MEMBERS PRESENT: Bruce McGee Doug Poehls Scot Stokes Mark Mace Chuck Dickerson Bill Mountsier OTHERS PRESENT: Heidi Jensen Monica Plecker Cheryll Lund Public Input (three- minute limit): Citizens may address the Council regarding any item of City business not on the agenda. The duration for an individual speaking under Public Input is limited to three minutes. While all comments are welcome, the Council will not take action on any item not on the agenda. There was none. DISCUSSION: Annexations City Planner Monica Plecker gave a power point presentation on Annexations. This presentation is meant to give the Council a better understanding of how annexation works, the City's roll in annexation, and how annexation can make a city grow. The definition of annexation is "The incorporation of a land area into an existing community with a resulting change in the boundaries of the community." Monica explained the different types of annexations and the process for each type of annexation. This presentation is being made from the City's standpoint. Contiguous Government Land Annexation Background: Montana Code Annotated (MCA) 7 -2 -4402 states "Whenever any land contiguous to a municipality is owned by the United Sates or by the State of Montana or by any agency, instrumentality, or political subdivision of either or whenever any of the foregoing have a beneficial interest in any land contiguous to a municipality, such land may be incorporated and included in the municipality to which it is contiguous and may be annexed thereto and made a part thereof in the manner provided in this part." Process: For contiguous government land, the City shall annex as follows: 1. Request by Government Official (aka: the Mayor); 2. City Council must adopt a Resolution of Intent to annex the land; 3. City Council must provide and publish notice of its intent to annex the land, as well as a 20 -day comment period, and; 4. City Council must consider comments and pass or adopt a Resolution of Annexation. Monica stated that an example of this type of annexation was done within the past year when vacant privately owned land (Richmond property) on the south side of W. 12 Street was donated to the City and the City annexed it. The property is referred to as the "Jake and Lois Bernhardt Parkway." Monica told the Council that MCA requires that all adjacent right -of -ways be annexed along with the property. This includes roads. Contiguous Land Annexation (Intent of the City) Background: MCA 7 -2 -4301 shall be deemed contiguous to such city or town even though such tracts or parcels of land may be separated from such city or town by a street or other roadway, irrigation ditch, drainage ditch, stream, river, or a strip of unplatted land too narrow or too small to be platted. Process: For Contiguous land: 1. City Council must adopt a Resolution of intent to annex the land; 2. City Council must provide and publish notice of its intent to annex the land, as well as a 20 day comment period; and 3. City Council must consider written comments (50%) and pass or adopt a Resolution of Annexation. Monica told the Council that if 50% of the effected residences protest the annexation cannot be done. An example of the Contiguous Land Annexation (Intent of the City) would be land across and above the ditch off of Beartooth (aka Dean Drive and above). Wholly Surrounded Land Background: MCA 7 -2 -4501. A city may include as part of the city any platted or unplatted tract or parcel of land that is wholly surrounded by the city upon passing a resolution of intent, giving notice, and passing a resolution of annexation. Process: For wholly surrounded lands, the City shall annex as follows: 1. City Council must adopt a Resolution of intent to annex the land; 2. City Council must provide and publish notice of its intent to annex the land, as well as a 20 day comment period; and 3. City Council must consider comments and pass or adopt a Resolution of Annexation. Examples of this type of annexation is the Richland property on the South side of W. 12 Street across from the land that was recently annexed into the City and will be named "Jake and Lois Bernhardt Parkway", and property directly west of Sid's Bar on Hwy 10 East. Annexation by Petition MCA 7 -2 -4601. Annexation by petition. 1. Receive a written petition • If signed by not less than 33 1/3% of registered electors* of the proposed area; (Petition will automatically fail if signed by less than 33 1/3 %) • If signed by more than 50% of electors or owners of the proposed area: (go to #2) 2. City Council may approve or disapprove a petition. • If approved, Resolution of Annexation. *Registered electors are registered voters who own property within the requested annexation area. Annexation with Provisions of Service Background: MCA 7 -2 -4705. Annexation by municipalities providing services. The governing body of any municipality may extend the corporate limits of the municipality under the procedure set forth in this part upon the initiation of the procedure by the governing body itself. Process: For wholly surrounded lands, the City shall annex as follows: 1. City Council must adopt a Resolution of Intent to annex the land; and 2. City Council must provide and publish notice of its intent to annex the land, as well as a 45 day comment period; and 3. City Council must consider comments and pass or adopt an ordinance which must include a statement of intent to provide service; and 4. A Tong -range plan must be provided showing how the municipality plans to extend services. Services are defined as water, sewer, garbage, police and fire. Services are provided at city expense. Water and Sewer tie -ins to the house are at the expense of the property owner. Long -range means no less than 5 years. Additional Facts • MCA 7 -2 -4303. Restrictions on annexation power. This deals with annexation of land use of industrial, railroad or manufacturing use. • MCA 7 -2 -4211. Inclusion of roads and right -of -ways in annexation. Laurel Municipal Code 16.12. Annexation Conditions: 1. The property and improvements are in the same condition as is required for properties and improvements within City Limits; and 2. The city system is capable of serving the area; and 3. The extension is in the best interest of the city; and 4. The cost of the extension shall be at the expense of the requesting party; and 5. The city council has granted its approval; and 6. The property is annexed. Monica stated that the (above) conditions are important requirements to assure that annexed property meets the current city standards. When property comes into the city you want that property to provide the same infrastructure and adhere to the city's Public Works Standards. There are areas within the city that the current infrastructure is not capable of serving. There are also areas where an extension of the city limits could not be done at the best interest of the city because it would be costly for the city. Monica gave an example of condition # 2 where the city is challenged to provide services. On the west side of Laurel off of 8th Avenue and to the east of Foundation Avenue is an area of town where there are no sewer lines and no infrastructure that would support placement of sewer lines without the placement of booster stations. Monica made reference to a map that rates the Ease of Annexation in grades A, B, D & F. Grade A references areas the city could annex at the most ease. Not to say it would be easy because infrastructure has been estimated to cost between $400,000 and $500,000 for the largest designated parcel in Area A. Grade B references the annexation of city owned Riverside Park. The major issues with annexing Riverside Park would be dealing with a high water table on the property and having to figure out how to run water and sewer lines across the river. Grade D references areas that the city would have to add infrastructure in order to serve with water and sewer. Grade F references a grade of "fail." The property referenced has been deemed impossible to annex mostly due to its high water table and a pump station that would have to be installed for sewer lines. Monica referenced a 2006 study that was done by Morrison Maierle, Inc. to identify potential growth areas in Laurel. The map gave specific (2006) cost estimates for adding sewer line infrastructure in 3 areas of Laurel. In the NW part of Laurel it would cost $3.2 million; SW would cost $3.3 million and Areas 4 & 5 (northern /northeastern area) would cost $9 million. The cost for infrastructure for water lines is estimated to be for every $1 spent on sewer an additional $2 would have to be spent on water. This map was presented tonight to give the City Council an idea of what is involved to annex property and what amount of resources the city would have to come up with to annex what might look like a simple piece of property. A discussion was held on planning ahead for future infrastructure growth. The council realizes that there will have to be some planning ahead done for several issues that are facing the city down the road. One of those issues is the 1 -90 interchange that MDT is contemplating for the west side of Laurel. There are major obstacles regarding providing infrastructure to potential future commercial growth in that area. Monica said that the Growth Management Plan that she and the Planning Board are working on sets goals not only for 20 years down the road but also for goals 5 years down the road that are easily attainable. The GMP is meant to not only be a guide for the future goals, but for prioritizing projects and funds to accomplish those goals. Monica goes on to say that there needs to be a lot of planning and collaboration between the Planning Board and Public Works to help get the ball rolling and define which areas are short range and long range goals. Monica told the council that she hoped the presentation helped them understand the process of annexation and some of the obstacles that keep the city from annexing some properties bordering city limits. The Mayor told the council that at this time they are in Phase I of reviewing the Capital Improvement Plan which prioritizes city funding and spending. Once the costs of various city projects are determined than they can start to prioritize them and move ahead. Once that is done issues can be brought forward to the Council for consideration. The Mayor thanked Monica for the presentation. Monica stated that the Growth Management Plan rough draft should be ready around January2013 with a 2 " draft around April. She hopes the plan can be adopted by the council by July 2013. The meeting was adjourned at 6:50 pm.
