AN ORDINANCE AMENDING SECTION 2.10.080(A) OF THE
LAUREL MUNICIPAL CODE TITLED "PUBLIC HEARING" LOCATED
AT TITLE 2 OF THE LAUREL MUNICIPAL CODE.
WHEREAS, the City Council desires to keep the Laurel Municipal Code current by
updating sections and subsections that are no longer useful; and
WHEREAS, LMC § 2.10.080(A) provides the City Council must wait at least one week
to make its decision after a public hearing; and
WHEREAS, the hearing affords the public an opportunity to voice its opinion on City
issues and said issues are ripe for decision immediately thereafter; and
WHEREAS, this waiting period unnecessarily prolongs City Council action on the issues
before it and creates inefficiency within the City government; and
WHEREAS, the City Council has determined that adopting the suggested amendment is
in the best interest of the City of Laurel.
IT IS HEREBY ORDAINED by the City Council for the City of Laurel, Montana, that
Section 21.10.080 of the Laurel Municipal Code is hereby amended to read as follows:
21.10.080 Public Hearing.
A. The council may conduct public hearings or may appoint a hearing officer for that
purpose as provided in Section 7 -1 -4131, MCA. When heard by the council the items will be
presented to the council in the same format as described in Section 2.10.070
. In addition, when public hearings and public interest matters
are being heard and it is anticipated that a large number of citizens may wish to present
testimony, the presiding officer, with the consent of the council, may, prior to the meeting,
establish reasonable guidelines for the conduct of the meeting.
This Ordinance shall become effective thirty (30) days after final passage by the City
Council and approved by the Mayor.
Introduced and passed on first reading at a regular meeting of the City Council on August
21, 2012, by Council Member McGee.
PASSED and ADOPTED by the Laurel City Council on second reading this 18 day of
September, 2012, upon motion of Council Member McGee
