HomeMy WebLinkAboutOrdinance No. O12-04 ORDINANCE NO. 012-04 AN ORDINANCE AMENDING SECTION 5.08.040 OF THE LAUREL MUNICIPAL CODE TITLED "CONTRACTOR'S LICENSE AND BOND REQUIREMENTS" LOCATED AT CHAPTER 5 OF THE LAUREL MUNICIPAL CODE. WHEREAS, the City Council desires to keep the Laurel Municipal Code current and enforceable by updating sections and subsections that are outdated and no longer useful or enforceable; and WHEREAS, the City's Staff identified an issue in Section 5.08.040 that needs modification by the City Council in order to fairly administer the City's issuance of Business Licenses to Contractors interested in performing work within the City Limits; and WHEREAS, the City Council has determined that adopting the suggested amendments is in the best interest of the City of Laurel follows: 5.08.040 Contractor's license . A. No person shall do business as a contractor in the city without first obtaining a city business eentractees license. Prior to the city's issuance of the license, contractor shall complete a license application and pay the fee prescribed by council resolution. fellows: B. A contractor is defined in this section as an individual, firm, partnership, corporation, association or any combination of these, who undertakes or offers to undertake or engages in the business of constructing, altering or repairing buildings or other structures or sidewalks or street pavements, including but not limited to the following: 1. General building contractors; 2. Cement or concrete contractors; 3. Masonry contractors; 4. Carpentry contractors; 5. Acoustical contractors; 6. Electrical contractors; 7. Drywall contractors; 8. Excavating contractors; 9. Fencing contractors; 10. Glazing contractors; 11. Heating, air conditioning and refrigeration contractors; 12. Lawn, chemical and fertilizer applicators; 13. Paint contractors; 14. Plastering contractors; 15. Plumbing contractors; 16. Roofing contractors; 17. Sewer and drain layers; 18. Sheet metal contractors; 19. Cleaning contractors; Ordinance No. 012 -04 Contractor's License & Bond Requirement — LMC 5.08.040 20. Window contractors; 21. Wrecking and salvage contractors; 22. Black top sealer contractors; 23. Landscaping contractors; 24. Swimming pool contractors; 25. Insulation contractors; 26. Siding contractors; 27. Sign contractors. C. 1. In the event that any of the above named contractors are licensed by any department of the State of Montana Professional and Occupational Licensing, that individual, or in the event of an entity, or an employee of that entity, must have a current license as issued by the agency regulating that profession or occupation. 2. In the event a state license is required as above, the city can require the state license number to be included on the application submitted to the city. D. If any owner of property wishes to do any of the work performed by any of the contractors as stated above on his own property, he shall not be required to obtain a business license.- : . . ' - - • . . _ ... . .. . ' . _ ... . ..., - . However, this provision does not in any way affect the owner's requirement to obtain the necessary permits to perform any of the work. E. This section does not affect the city's bond requirements for work impacting city property, including but not limited to, streets, alleys, sidewalks, parks, easements and other rights -of- way. (Ord. 97 -2 § 4 (part), 1997; Ord. 94 -6, 1994) This Ordinance shall become effective thirty (30) days after final passage by the City Council and approved by the Mayor. Introduced and passed on first reading at a regular meeting of the City Council on August 7, 2012, by Council Member McGee.
