HomeMy WebLinkAboutCity Council Minutes 05.06.1997Minutes of the City Council of Laurel May 6, 1997 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Chuck Rodgets at 7:00 p.m., on May 6, 1997. COUNCIL MEMBERS PRESENT: Gay Easton Bud Johnson Norman Orr Miles Walton Gary Temple Dirk Kroll Donna Kilpatrick William Staudinger COUNCIL MEMBERS ABSENT: None INVOCATION: Invocation was given by Alderman Kroll. MINUTES: Motion by Alderwoman Kilpatrick to approve the minutes of the meeting of April 15, 1997 as presented, seconded by Alderman Staudinger. carried 8--0. regular Motion CORRESPONDENCE: Received a letter from the Laurel Chamber of Commerce regarding a Carson & Barnes Circus on August 8, 1997. A certificate of liability insurance from the circus company was attached. Received a newsletter from the Montana League of Cities & Towns along with a dues notice. Received two letters from the Montana Department of Transportation regarding Buffalo Trail, north of Laurel. Received a letter from Larry Thomas regarding the water rate increase. Received a letter from American Medical Response regarding the ambulance service. Received a letter from Margit Thorndal, Principal of West Elementary School, regarding a street closure. Received minutes of January 9, 1997, February 27, 1997, and March 27, 1997, from the Yellowstone City-County Board of Health. Received a notice from the City of Billings regarding a Landfill Users Summit meeting on Wednesday April 23, 1997. Received a memo from the Montana Department of Commerce regarding Legislative Update and BARS Workshop in Billings at MSU-B on Thursday, June 26, 1997. Received a MMIA Newsletter dated April 1997. CLAIMS: Claims for the month of April were reviewed by the Budget/Finance Committee and recommended that they be paid. Motion by Alderwoman KilDatrick to approve the claims in $4S5,478.54 for the month of April, seconded by Alderman Easton. the amount of Motion carried JIM TAYLOR - CARSON & BARNES CIRCUS: Jim Taylor, representing Laurel Chamber of Commerce, requested the City Council's approval to have the Carson & Barnes Circus, sponsored by the Chamber, on August 8, 1997. There will be two shows, one at 4:30 p.m. and one at 7:30 p.m. The site for the circus will be the forty acre tract on East Railroad Street (the old Canttell place). The Chamber hopes to make the circus a primary fund raiser for the renovation of the log cabin. Jim handed out copies of a map showing the location for the circus and copies of the Certificate of Insurance to the council. He asked permission to use water from the hydrants at the location and to have garbage cans provided at the site. Mayor Rodgers announced that these provisions have been granted for the circus in the past and there have been no problems. Minutes of the City Council of Laurel Page 2 Council Meeting of May 6, 1997 Motion by Alderman Staudinger to grant permission for the Laurel Chamber of Commerce to hold the Carson & Barnes Circus on August 8, 1997, to allow the use of water~ with the Chamber being responsible for the costs incurred for water used by the circus, and to allow the use of garbage cansl seconded by Alderman Temple. Motion carried 8--0. CANYON CREEK RIDGE SUBDIVISION: T~is item was removed from the agenda. CEMETERY COMMISSION - ESTABLISH RULES AND REGULATIONS: ORDINANCE NO. 097-3 (first reading) AN ORDINANCE PROVIDING THAT THE ESTABLISH RULES AND REGULATIONS MANAGEMENT OF THE CEMETERY CEMETERY COMMISSION MAY FOR THE CONTROL AND Joe Leckie, City Attorney, stated that the ordinance was drafted to amend the Laurel Municipal Code. The old ordinance indicated that if the Cemetery Commission passed rules and regulations, it would have a force of ordinance. He feels this is improper and unconstitutional, the council cannot pass the authority to pass ordinances on to any other body. The council is the only body authorized to pass an ordinance. The ordinance will allow the committee to propose rules and regulations which the council would adopt by resolution. Any amendments to the rules and regulations would come before the council and be adopted by resolution. Motion h2_Alderwoman Kilpatrick that Ordinance No. 097-3 (first reading) be passed and adopted, seconded by Alderman Johnson. A roll. call vote was taken and all aldermen voted "YES". Motion carried 8--0. HOME GRANT - AUTHORIZE THE MAYOR TO SIGN ALL DOCUMENTS: RESOLUTION NO. R97-16 A RESOLUTION AUTHORIZING THE MAYOR TO SIGN ALL DOCUMENTS FOR THE HOME INVESTMENT PARTNERSHIP PROGRAM Motion bY Alderman Orr that Resolution No. R97-16 be passed and adopted, seconded by Alderman Johnson. Motion carried 8--0. COMMITTEE REPORTS: --Budget/Finance Committe~ minutes of April 15, 1997 were presented and reviewed. Motion by Alderwoman Kilpatrick minutes of April 15, 1997, into the Motion carried 8--0. to enter record, the Budget/Finance seconded by Alderman Committee Johnson. --Budget/Finance Committee minutes of of April 28, reviewed. 1997 were presented and Motion by Alderwoman minutes of April 28, 1997, carried 8--0. Kilpatrick to enter the Budget/Finance into the record, seconded by Alderman Kroll. Committee Motion --Budget/Finance Committee minutes of April 30, 1997 were presented and reviewed. Motion by Alderman Easton to enter the Budget/Finance Committee minutes of April 30, 1997, into the record, seconded by Alderman Kroll. Motion carried --City Council Committee of the Whole minutes of April 15, 1997 were presented. Minutes of the City Council of Laurel Page 3 Council Meeting of May 6, 1997 --Police Committee minutes of May 1, 1997 were presented and reviewed. Motion by Alderman Kroll to enter the Police Committee minutes of May 1, 1997, into the record, seconded by Alderman Orr. Motion carried 8--0. --Street & Alley Committee minutes of April 22, 1997 were presented and reviewed. Motion by Alderman Easton to enter the Street & Alley Committee minutes of April 22, 1997, into the record, seconded by Alderman Staudinger. Alderman Walton asked for more explanation on the curb and gutter requirements on the east side of the Caboose Saloon and west side of 7th Avenue. Alderman Easton explained there has been a problem with parking on the east side of 7th Avenue, next to the motel. Parallel parking can be enforced with curb and gutter along the street, instead of cars parking horizontally up to the motel. The Street and Alley Committee recommends that the Caboose Saloon be required to put curb and gutter on 'the west side of 7th Avenue, which will create parallel parking on both sides of 7th Avenue. Alderman Orr questioned how the diagonal parking on the east side of the Caboose ever got started? Alderman Easton said parking was not controlled until there was an ordinance requiring curb and gutter and the city enforced parallel parking. The owners of the motel would like curb and gutter along the east side of 7th Avenue to control horizontal parking next to the motel. Jim mentioned that parking along the motel has become a problem for the motel owners. It is the Street and Alley Committee's concern that curb and gutter is needed on both sides of the street;, which the city can require. Alderman Walton asked where this leaves the city in regards to the moose encroachment? Alderman Easton said the problem with the moose encroachment is still there. Curb and gutter would lessen the liability. Joe Leckie explained that the curb and gutter clearly defines the right-of-way, in terms of the street. Having curb and gutter on both sides of the street, creates a clearly defined street. If someone would run into the moose, the risk and liability potential is substantially less. Even though the moose is still in the city right-of-way, the city has clearly defined what the right-of-way is by the curb and gutter on both sides. A vote was taken on the motion. Motion carried 8--0. POLICE ACTIVITY REPORT: The Police Department's activity report for April 15, 1997 to May 6, 1997 was distributed. APPOINTMENTS: Mayor Rodgers appointed Jim Stevens as Fire Chief effective April 1, 1997. Motion by Alderwoman Kilpatrick to as Fire Chief, effective April 1, 1997, carried 8--0. confirm the appointment of Jim seconded by Alderman Staudinger. Stevens Motion Mayor Rogers re-appointed Jim Worthington to the Yellowstone Conservation Board, for three years. Motion bfff Alderman StaudineF~ir-r to confirm the re-appointment Jim Worthington to the Yellowstone Conservation Board, seconded by Alderman Johnson. Motion carried 8--0. MAYORS COMMENTS: Mayor Rodgers announced that Friday, May 23, 1997 will be proclaimed Poppy Day in recognition of all those in our community who have served this great nation in the armed services. Minutes of the City Council of Laurel Page 4 Council Meeting of May 61 1997 OTHER COMMENTS: Alderwoman Kilpatrick thanked Jim Flisrand for all the work he did with the Bright & Beautiful clean-up in Laurel on April 26, 1997. She noted it was a successful day with a lot of groups participating and a lot of garbage was hauled.
