In order for you to recover damages from the City of Laurel, it must be shown that the City of Laurel was negligent and that their negligence was the direct and immediate cause of your injuries. My investigation has determined that there does not appear to be any negligence on the part of the City of Laurel in regard to the injuries you sustained. Based on our conversation, it appears that you were thrown off balance by the wind and inadvertently stepped off the edge of the sidewalk, which resulted in your fall and subsequent injury. According to the uniform building codes, the sidewalk where your fall occurred is not required to be equipped with hand rails. Based on the information I have received, it appears that your injury was due to factors outside of the City of Laurel's control in the exercise of ordinary care. I can appreciate your desire to be compensated by the City of Laurel for the injury you sustained. The facts here do not, however, establish legal liability on the part of the City of Laurel and no payment will be made. Respectfully, 1 Lh c 4(//.2 Tana J.
