HomeMy WebLinkAboutOrdinance No. 926 ORDINANCE NO. 926 AMENDING SECTION 9.08.010 OF THE LAUREL MUNICIPAL CODE, ALLOWING RECREATIONAL BONFIRES BY PUBLIC ENTITIES, BY SPECIAL PERMIT ONLY IT IS HEREBY ORDAINED by the City Council of the City of Laurel, Montana, that Section 9.08.010 of the Laurel Municipal Code is hereby amended to read as follows: Section 9.08.010. Bonfires Prohibited. 1. Except as provided hereinbelow, no person shall build, kindle, ignite, maintain or allow any bonfire, rubbish fire, or any other open fire on any property within the city limits of the City of Laurel. 2. The City Fire Chief may allow a special permit to a public agency to ignite and maintain a recreational-type bonfire only, within city limits. The agency shall first apply to the Fire Chief for such permit pursuant to Article 4 of the Uniform Fire Code previously adopted by the City of Laurel, including any amendments thereto. As a condition of granting the permit, the Fire Chief shall require that the City Fire Department shall stand by, at and during the recreational bonfire for which the permit is granted. 3. The City Council may from time to time by resolution, establish or change a fee to be paid to the City by the applicant, at the time of application for a special bonfire permit. 4. Any person violating any of the provisions of this section shall be punished as set forth in Section 9.08.070 of the Laurel Municipal Code. 5. Section 15.56.035 of the Laurel Municipal Code, & its underlying Ordinance No% 738, passed by the City Council and approved by the Mayor on June 7, 1983, which are in conflict with this section, are hereby repealed. It is the intention of the Council to readopt and reinstate the provisions of the Uniform Fire Code, as amended, which were repealed by Ordinance No. 738, specifically Section ll.101(a) as the said section ll.101(a) 6. To the extent of the Uniform Fire Code, insofar is consistent with this ordinance. that any provision of the Uniform Fire Code, as adopted by the City of Laurel, including any amend- ments thereto, is in conflict with this section, then said pro- visions of the Uniform Fire Code, as amended, are hereby repealed. 7. This ordinance shall become effective thirty (30) days after final passage by the City Council and approval by the Mayor. Introduced and passed on first reading at a regular meeting of the City Council on October 20th, 1987 by Alderman Dickerson.
