ADDING SECTION 13.04.105 , m0 THE I,AURFJ MUNICIPAL
CODE, TO PROVIDE FOR A DEPOSIT m0 COVER THE COST
OF TESTING WATER METERS
IT IS HEREBY ORDArNED by the City Council of the City
iurel, Montana, that Section 13.04.105 is hereby added to
U-~. ,aurel Municipal Code, to read as follows:

10 ~° ~ 7 J.. When any water user makes a complaint to the C.i.ty
the municipal ~•~ater. or waste water charges at certain
arty for anv particular bi_1J.ing period appear_ to be
excessive, the City shall, upon request by t_he water user.,
re-read and inspect the user's water meter. in the event that
re-reading and .inspecting the meter does not satisfy the water
user as to the accuracy of the billing, then the user may
request the City to test the water meter involved. Any water_
user requesting that a meter be tested steal]. first make a
deposit of money with the City to cover the cost of making the
test. Upon receiving the said deposit, the City shall. then
test the meter involved.
In the event that upon *_esting, the meter is discovered
to show a registration in excess of ±hree (3 °s) nercent in favor
of the City, then the amount deposited f_or the ta_st shall be
refunded to the user in full, and the City shall make an
adjustment for th.e estimated exces^ billed amount for. the
period of time that the meter was registering incorrectly, but
in no event shall any adjustments in bi.lli_ngs he made for.
periods other than the three (3) i.mmed.iateJ.y preceeding bill.i_ng
periods. The excess registra*_i_on on the reading for th.e

corrected billing periods shall be credited to the customer's
account.
Where no error in meter .registrati.on is da.scovered upon
test_nq, then the amount deposited by the water user for the
test shall be retained by the City to cover the expense of
performing the test.
2. The amount of the deposit for meter testing is
hereby initially estab Lshed at $ 25.00 The City public
utilities committee may from time to time alter. or chance said
amount based upon its determination of the average cost of
testing meters in the future.
3. This ordinance shall become effective thirty (30)
days after final passage and approval.
