AMENDING SECTION 17.40.010 (D), FENCES, OF
THE LAUREL MUNICIPAL CODE.
BE IT ORDAINED by the Council of the City of Laurel, Montana,
that Section 17.40.010 (D) is hereby amended to read as follows:
Section 17.40.010 (D) Fences
1. In R-7500, R-6000, RLMF, RMF, RMH, PUD, RP, NC, and P zones,
fence heights in front yards shall not exceed three (3)
feet except as noted in (a) below; side and rear yard
fence heights in these same zones shall not exceed six (6)
feet; on corner lots adjacent to a street, houses with a
front yard facing a side street (or at 90 degrees, approxi-
mately, from the adjacent front lots), and with a side
yard or back yard adjacent to a front yard in the same
block (see accompanying illustrations for examples) shall
not have a back yard fence higher than three (3) feet where
adjacent to a front yard, or a side yard fence paralleling
the street higher than three (3) feet except as noted in
(a) below.
(a) Chain link, woven wire, or other similar type
fences which provide no more than ten percent
(10%) obstruction to visibility through the
fence when constructed can extend to four (4)
feet in height in front and side yard areas,
otherwise restricted in height to three (3) feet.
2. There are no fence height requirements in AG, RE-20,000,
CBD, CC, HC, LI and HI zones.
3. Electric fences shall not be permitted in any commercial
or residential zones except AG and RE-20,000 zones.
4. No fence shall be located in a public right-of-way.
5. The height of a fence shall be the vertical distance from
the highest top board, rail, or wire to the ground directly
below.
6. These provisions shall not apply to fences required to
surround and enclose existing junkyards and public utility
installations or to enclose schoo~ grounds and public
playgrounds.

7. it shall be unlawful ~o~ any peIson to erect o~ maintain
any barbed wire ~ence in or along a ~esidential area in
the City o~ LauIel. Fuither, any barbed wire ~ence
erected in other areas of the City shall, along any public
street oI sidewalk, maintain the lowest stiand o~ barbed
wile at least six (6) ieet above sidewalk glade, over the
top o~ a non-barbed ~ence over private p~opeity and at
least six (6) inches inside pIope~ty line.
8. Fences p~oposed to surround three (3) o~ mole houses and
designed as part o~ the landscape and development approval
requirements in new subdivisions shall be ~evi~w~d du~ing
the subdivision review process. Fences p~oposed to surround
three (3) o~ mo~e houses in existing subdivisions shall
be reviewed th~ou§h the Special Review process.
This ordinance shall become ei~ective 30 days a~ter ~inal
passage by the Laurel City Council.
