AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
LAUREL, MONTANA, ADOPTING A TECHNICAL AMENDMENT TO
ORDINANCE NO. 011-01 TO RESOLVE A TYPOGRAPHICAL ERROR IN THE
PREVIOUSLY ADOPTED ORDINANCE.
WHEREAS, the City Council adopted Ordinance No. 011 -01 on February 15, 2010
modifying a portion of the City's Zoning Ordinance; and
WHEREAS, the draft ordinance that was distributed contained an error that was
overlooked by staff until after adoption by the City Council; and
WHEREAS, the error must be resolved to avoid inconsistencies in the City's Ordinances.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Laurel,
Montana, that Ordinance No. 011 -01 is amended as follows:
17.08.761 Medical marijuana dispensary or dispensary.
"Medical marijuana dispensary or dispensary" shall mean a property or structure used to sell,
distribute, transmit, give, dispense or otherwise provide marijuana in any manner to patients or
primary caregivers pursuant to the authority contained in MCA §50 -46 -101 et. seq. and the
implementing administrative regulations promulgated thereto. The City shall not license a
Medical marijuana mien dispensary facility or cultivation dispensary facility within one
thousand (1,000) feet of any private or public preschool, elementary, secondary, vocational or
trade school, any child care center, place of worship or religious assembly, any public or private
park, pool, playground or recreational facility, any juvenile or adult halfway house, correctional
facility, or substance abuse rehabilitation or treatment center as provided in Title 5, Chapter
5.70.050.
This Ordinance shall become effective thirty (30) days after final passage by the City
Council and approved by the Mayor.
Introduced and passed on first reading at a regular meeting of the City Council on March
1, 2011, by Council Member Nelson
PASSED and ADOPTED by the Laurel City Council on second reading this 15th day
of March , 2011, upon motion of Council Member Nelson
