HomeMy WebLinkAboutOrdinance No. 1052ORDINANCE NO. 1052 ADDING SECTION 9.22.030 TO THE LAUREL MUNICIPAL CODE, REQUIRING IDENTIFICATION OF MINORS AND POSTING OF NOTICES, AND PROHIBITING MISREPRESENTATION BY MINORS OF AGE OR IDENTITY. IT IS HEREBY ORDAINED by the City Council of the City of Laurel, Montana, that Section 9.22.030 is hereby added to the Laurel Municipal Code, as follows: Section 9.22.030. Identification of minors and posting of notices required; misrepresentation of age or identity prohibited. (1) A person selling tobacco products, supervising a tobacco product vending machine, or distributing tobacco product samples shall require proof of age from a prospective purchaser or recipient if a reasonable person would conclude on the basis of appearance that the prospective purchaser or recipient may be under eighteen (18)years of age. (2) It is unlawful for a minor to ~isrepresent his or her identity or ag~, or to use any false identification, for the purpose of purchasing or receiving any tobacco product or sample. (3) The owner of an establishment 'at which tobacco products are sold at retail or a person distributing samples shall conspicuously post, at each place on the premises at which tobacco products are sold or samples distributed, an 8-inch by lO-inch sign, with large, bold print, black letters, stating: "It is illegal to sell or distribute tobacco products or samples to persons under eighteen (18) years of age." A 5-inch by 7-inch sign with the same notice must also be conspicuously attached to all tobacco product vending machines. (4) It shall not constitute "entrapment" or any other violation of the law for law enforcement authorities to have an individual under the age of eighteen (18) years attempt to purchase tobacco products for the purpose of monitoring compliance with this article. (5) Any person who shall violate any of the provisions of this ordinance shall, upon conviction thereof, be punished in accordance with Section 1.36.010 of this Code.
