December 22, 1981
A special meeting of the City Council of the City of Laurel, Montana,
was held in the Council Chambers and called to order by Mayor Larry D. Herman,
at 5:15 p.m., on December 22, 1981.
The purpose of this meeting is to discuss solid waste disposal for
Juniper and Briarwood Subdivisions.~

JOHN MacMARTIN: I have two subdivisions that Cumin Associates has done some
work on. Both subdivisions are located down near the Billings landfill. As
you know the City of Billings and Yellowstone County can not seem to agree
upon what fee they are going to charge the county residents or what fee the
county is going to pay the city to allow continued use of their landfill by
the county. These two subdivisions are in their planning stages yet and
they still have to go to the State Department of Health for review. One of
the criteria bhe Department of Health uses is the ability to have solid
waste picked up first by a licensed hauler and secondly that the solid
waste is going to be dumped in a licensed landfill. D & F Sanitation will
pick up solid waste from both of these subdivisions, but ~he City of Bii-
lings won't sign off on the forms because the subdivisions are located in
the county and not the City of Billings. The projects basically are stopped
at that point right now and can not even proceed and try to go to the final
plat and be put of record in the courthouse because of the bickering between
the City of Billings and the county. I have been asked by both clients to
approach the City of Laurel to see if they would sign off and indicate that
they would accept the solid waste from those subdivisions. The clients are
aware that they would be paying on a per-load basis and have no problems
with that. In all reality you probably never will see solid waste from
either one of these two subdivisions. In both cases they would be looking
at not even opening up for development or initial occupancy for another 20
or 36 months. But because of the way the approval process is structured,
they need to continue on today. Juniper Subdivision involves about 25 or
26 lots and Briarwood Subdivision is much more encompassing. It includes
almost a thousand acres and eventually will be housing sites for well over
950 units. I doubt that you will see the day when solid waste is hauled
from down there, since they are adjacent to the Billings Landfill. This is
just a procedural point.
Discussion.
The consensus of the council was that the approval and the mis-use of
the approval could be controlled by adjusting the dumping fee to be paid by
the hauler.
Motion by Alderman Meyers to give the Mayor authority to sign the Depart-
ment of Health Solid Waste approval form for the Juniper and Briarwood Sub-
divisions, seconded by Alderman Brennan. Carried, with Alderman Burns voting
There being no further business to come before the Council at this time,
