HomeMy WebLinkAboutCity Council Minutes 08.04.1981 Minutes of the City Council of Laurel August 4, 1981 A regular meeting of the City CounciI of the City o~ Laurel, Montana, was held in the Councii Chambers and called to order by Mayor Larry D. Herman, at 7:00 p.m., on August 4, 1981. COUNCIL MEMBERS PRESENT: Albert Ehrlick Bill Brennan Duane Behm Susan Carter (late) Donald Meyers Terry Fink Ervin Metzger COUNCIL MEMBERS ABSENT: Harold Burns INVOCATION: Invocation given by Reverend Wilhelm. MINUTES: Minutes of the regular meeting of July 21~ 1981, approved as presented. CORRESPONDENCE: The Mayor mentioned that he had turned a letter over to the City Attorney about some papers that were served regarding the Nutting Brothers Subdivision. Some people are quieting a title on land over there. We have our ditch and street going through this parcel of land, but no problems are anticipated; however, we do want to protect our interest. There was another letter received regarding the Magnus Subdivision. Back in 1952 when the Magnus Subdivision was subdivided there was an un- recorded Contract for Deed, and the people (Metzger) who purchased from Magnum want us to vacate an alley. This has been turned over to the City- County Planning Board for review and recommendation. CLAIMS: A copy of the "Statement of Items Released for Payment" for the July claims has been presented to the Council for review and approval. Motion by Alderman Metzger to approve the July claims presented~ seconded by Alderman Behm. Carried. CITY CLERK'S AND CITY TREASURER'S FINANCIAL STATEMENTS: City Clerk's and City Treasurer's Financial Statements for the month of June were presented for review and approval. Motion by Alderman Metzgerto approve the City Clerk's and City Treasurer's Financial Statements as presented, seconded by Alderman Ehrlick. Carried. MAYOR'S COMMENTS: The County elections office has asked that we pass a resolution in the case of the City Judge, which is a non-partisan office. When only two or less file for this office, it does not have to be placed on the primary ballot. RESOLUTION 1878 (nunc pro tunc as of 8/B/81} DECLARING IT UNNECESSARY TO PLACE THE NON-PARTISAN OFFICE OF CITY JUDGE ON THE PRIMARY BALLOT TO BE HELD ON SEPTEMBER 15, 1981. Motion by Alderman Ehrlick that Resolution No. 1878 be passed and adopted (nunc pro tunc), seconded by Alderman Brennan. Carried. DUANE BEHM - BUDGET COMMITTEE: Reviewed the minutes of July 27th and 28th. Motion by Alderman Behm that the Budget Committee minutes of July 27th and 28th, 1981~ be entered into the record, seconded by Alderman Metzger. Carried. ALBERT EHRLICK: Fence at 1612 East 8th Street. Discussion regarding a request by Paul Elsenpeter to place a fence on or near his property line. The City Engineer was asked to look into this and possible referral to the Board of Adjustment. page 2 Minutes of the City Council of Laurel DON MEYERS - PROPOSED SID 106: Curt, I thought the deal was that the City haul the gravel in and now we're cutting the street and everything. How come we're doing more than we bargained for? That's taxpayers' money. Curt McKenzie responded by saying that when we started out we assumed that there was as much gravel on 8th as the other streets. Eighth Avenue is exposed to heavy traffic, and it has much less gravel than any other street in the whole subdivision. Without putting sub-surfacing under that, the road wouldn't stand up anywhere the length of time it takes to pay for it {15 years)~ We are still staying within the dollar amount allocated for this project. There was further discussion regarding the use of the City's smalI dump trucks for hauling gravel and the feasibility of having it hauled by someone else. Duane Behm asked Dick Metzger if there was any chip sealing going to be done this week. Dick said, "No," because they were working on 8th Avenue preparing for SID 106. There being no further business to come before the Council at this time, the meeting was adjourned at~.m. 'Donald L.
