Minutes of the City Council of Laurel June 16, 1981 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Larry D. Herman, at 7:03 p.m., on June 16, 1981. COUNCIL MEMBERS PRESENT: Albert Ehrlick Harold Burns Donald Meyers received The fees: Bill Brennan Susan Carter Terry Fink Ervin Metzger Cheryl Garcia John VanAken Ray Moran Discussion. Robert Wetch Barbara Smith Delores Stahley RESOLUTION 'NO. 1854 RE©UIRING"OUT OF CITY RESIDENTS~'TO PAY CERTAIN FEES & CHAR~ES FOR THE USE OF THE CITY SWIMMING POOL. Motion by A.ld.e.r.ma9. Brennan that Resolution No. 1854 be passed and adopted, seconded by Alderwoman Carter. Carried, with Alderman Fink voting A petition from residents in the area of 412 East 6th Street was received and entered into the record. It was regarding the clean-up of a burned structure. BIBS - FRONT-END LOADER: The bids were opened on June 2, 1981, and referred to the Street and Alley Committee for review; and they have recommended that the bid be awarded to Western Equipment Co. on a lease/ purchase. COUNCIL MEMBERS ABSENT: Duane Behm INVOCATION: Invocation given by Reverend Billet. MINUTES: Minutes of the regular meeting of June 2, 1981, approved as presented. CORRESPONDENCE: Received a letter from the Area II Senior Health Program, requesting $2,000 of Revenue Sharing money for fiscal year 1981-82. This was forwarded to the budget committee. Received letters from Boise-Cascade Corporation regarding lease assignment on industrial revenue bonds. CITY CLERK!S AND CITY TREASURER'S FINANCIAL STATEMENT: City Clerk's and City Treasurer's Financial Statements for the month of May were presented for review and approval. Motion .by Alde.rman Metzger to approve the City Clerk's and City Treasurer's Fi'ha'nc'iai State'me'nts as presented, seconded by Alderwoman Carter. Carried. SUE CARTER SWIMMING POOL: The Park Committee has changed their recom- mendat'io'n on s'w'i'm'm'i'n~' "f'e'e's for outside city residents from 75~ daily to $10.00 for single and $25.00 for family season tickets. Carried. BID OPENING - STREET MATERIAL . This being the time and place advertised, all bids received Wer'e'opened and read aloud. 0nly one bid was received, which was from William Krug and Sons in the amount of $31~825.00. Motion by Alderman Fink to accept the bid from William Krug and Sons, seconded by Alderman Ehrlick. Carried. BID OPENING INSURANCE: This being the time and place advertised, all bids received Were opened and read aloud as follows: Williams Agency $25,321.00 Reiter Insurance Agency 38,228.00 Rollins-Burdick-Hunter of Montana, Inc. Option 1 39,439.00 Option 2 40,639.00 Option 3 41,439.00 Harris Agency 31,339.00 The bids were referred to the Insurance Committee fop review and a special meeting was called for 5:00 p.m., Wednesday, June 17, 1981, to award the bid. ORDINANCE NO. 695 (second reading) AMENDING CHAPTER 17.44 OF THE LAUREL MUNICIPAL CODE REGARDING HOME OCCUPATION DESIGNATIONS. Motion by Alderman Brennan that Ordinance No. 695 be passed and adopted, seconded by Alderman Meyers. Upon taking a roll call vote, all aldermen present voted "yes." ORDINANCE NO. 696 (second reading) Diseussion. Motion by Alderwoman Carter to amend the ordinance by removing "from 9:00 a.m. to 12:00 noon" and inserting "for a minimum period of three (3) hours," seconded by Alderman Brennan. Upon taking a roll call vote all aldermen voted "yes," exoept Alderman Ehrlick and Fink, who voted "no." Carried. ORDINANCE NO. 696 as amended SETTING FORTH THE BUSINESS HOURS OF THE POLICE COURT OF THE CITY OF LAUREL. Motion by Alderwoman Carter that Ordinance No. 696 be passed and adopt~-~ as amended, seconded ~-~-Alderman Meyers. Upon taking a roll call vote, all aldermen voted "yes," except Alderman Ehrlick, who voted TOM BRADLEY - SID NO. 106: Mr. Bradley presented a resolution of inten- tion to create SID No. 106. page 3 Minutes of the City Council of Laurel RESOLUTION NO. 1851 A RESOLUTION DECLARING IT TO BE THE INTENTION OF THE COUNCIL OF THE CITY OF LAUREL, MONTANA, TO CREATE SPECIAL IMPROVEMENT DISTRICT NO. 106 DESIG- NATING AND DESCRIBING THE NUMBER AND BOUNDARIES OF SAID DISTRICT, STATING THE GENERAL CHARACTER OF THE IMPROVEMENTS WHICH ARE TO BE MADE THEREIN, THE APPROXIMATE ESTIMATED COST OF SAID IMPROVE- MENTS, AND THE TIME WHEN AND THE PLACE WHERE THE COUNCIL OF THE CITY OF LAUREL, MONTANA, WILL HEAR AND PASS UPON ALL PROTESTS OF THE MAKING OF SAID iMPROVEMENTS AND THE CREATION OF SAID DISTRICT. Motion b.y Alderman Meyers that Resolution No. 1851 be passed and adopted, seconded by A~derman Brennan. Carried. Carried. ERVIN METZGER - BUDGET COMMITTEE: Mr. Metzger presented and reviewed the Budget Committee minutes of June 1, 1981, and June 9, 1981. Without any objections from the Council, these minutes were entered into the record. PROTESTED GARBAGE FEES: Alderman Metzger had discussed this with the City Attorney and was advised that the fees paid under protest did not have to be kept in a separate fund if the people had not filed suit within 90 days giving the reason why they protest, then the money can go to the garbage operating cash account. Motion by Alderman Metzger that all fees paid under protest which is over 90 days old and no suit has been filed be transferred to the garbage operating cash account, seconded by Alderman Ehrlick. Carried. page Minutes of the City Council of Laurel The City Treasurer was granted permission to leave the state June 29th and BOth and July 1st. MAYOR'S COMMENTS: I have proposed a resolution concerning the ambulance service compensations. I have talked this over with various members of the ambulance crew, although I have not talked it over with the Ambulance Committee. Discussion. RESOLUTION NO. 1855 ESTABLISHING VOLUNTEER AMBULANCE SERVICE COMPENSATION. Motion by Alderman Ehrlick that Resolution No. 1855 be passed and adopted, second'ed by Alderman Meyers. Carried. Alderman Metzger announced that there will be an Insurance Committee meeting immediately after the Council meeting. DONNA KILPATRICK - BUSINESS COMMITTEE OF THE LAUREL CHAMBER OF COMMERCE: Mrs. Kilpatrick was requesting permission to close two streets on August lst: 1st Avenue between Main and 1st Street and 1st Street between 1st and 2nd Avenues, for the purpose of a flea market, rummage sale and craft show. Discussion. Motion by Alderman Ehrlick to grant permission to close the streets as requested~ seconded by Alderman Metzger. Carried. Dick Metzger mentioned that Orr Wilmot from Widjac Corporation would be in town Thursday at 8:00 a.m. to discuss the garbage rate survey.
