Dan Koch, City Rep. Dick Fritzler, County Rep. Judy Goldsby, County Rep. Greg Nelson, Member at Large Don Brown, City Rep. John VanAken, County Rep. Lee Richardson, County Rep. Others present: James Caniglia, City Planner Cheryll Lund, City Secretary The meeting was called to order at 7:00 pm by Vice Chairman Greg Nelson. Approval of Minutes A motion was made by Dan Koch, second by Judy Goldsby to approve the minutes as written. The motion carried by a 7 -0 vote. At this time Hazel Klein arrived at the meeting (7:04) Public Input No public was present. Discussion: Wind Power Machines James had planned to attend a Planners meeting that was going to discuss Wind Power but was unable to go because of another conference. He has contacted the State of Montana in regards to information on wind power regulations and hasn't heard back from them. This will be put on the agenda for the June 3, 2010 meeting. Discussion: Medical Marijuana James passed out a map from Yellowstone County GIS that show all schools, churches and parks and places a 1000' buffer zone around them (in the form of a bubble) in relation to Laurel's Commercial zoning. The City Attorney suggested that Day Cares be added to the list along with churches, schools and parks. 1 James pointed out on the map that the pink areas are the areas where retail sales of marijuana and the light and dark gray areas are where marijuana growing operations can be located. The risk of fire from the grow lamps is historically known as well as the health problems that mold can create. Because of the possibility of a fire hazard and mold that goes along with the growing of marijuana the board feels that for safety and health reasons it should only be allowed to be grown in the industrial areas of town. The retail aspect of medical marijuana is that the regulations will allow businesses in commercial areas with the 1000 foot buffers. In addition, the 1000 foot buffers include other medical marijuana retail businesses. There will not be multiple retail stores next to each other because each business will be required to have a 1000 foot buffer between it and the next retail marijuana business. That same 1000 foot buffer will be applied to the marijuana grow operations in light and heavy industrial zones. James informed the board that he requested input from the Laurel Police Department and the Yellowstone County Sheriff's office regarding location of growing operations and retail sales. Both offices indicated they were in agreement with placement of growing operations being in light and heavy zoning and retail sales being in commercial zoning. The board will hold a public hearing at the June 3, 2010 meeting to receive public input. Miscellaneous There was no miscellaneous business. The meeting was adjourned at 7:40 pm.
