Lonnie Kellogg Marvin Carter Donald Meyers COUNCIL MEMBERS ABSENT: Duane Behm to order by Mayor Albert Ehrlick Bill Brennan Susan Carter Rob Harris Bob Gauthier INVOCATION: Invocation given by Reverend Biller. MINUTES: Motion by Alderman Marvin Carter to approve the minutes of the regular meeting of August 3, 1982, and the two special meetings on August 4, 1982, and August 9, 1982, as presented, seconded by Alderman Kellogg. Carried. CORRESPONDENCE: Received an Activity Report for the month of July from the Yellowstone County Air Pollution Control Board. Received a letter from the County Commissioners dated August 3rd approving our request to transfer t±t~e'~of Tract 2 of C/S ~975 Amd[ to the Cit~ of Laurel for use as a park. Received a letter from the County Commissioners dated August 9th stating that they find it necessary to retain Tract 2 of C/S 975, Amd. since it is still a viable county gravel pit. Received the Annual Report from the Yellowstone County Council on Aging. CITY CLERK'S AND CITY TREASURER'S FINANCIAL STATEMENTS: City Clerk's and City Treasurer's financial statements for the month of July were presented for review and approval. Motion by Alderman Marvin Carter to approve the financial statements as presented, seconded by Alderman Meyers. Motion carried. GARBAGE ORDINANCES: ORDINANCE NO. 712 (second reading) AN ORDINANCE AMENDING SECTION 8.12.030, LAUREL MUNICIPAL CODE, IN ORDER TO DELETE REFERENCE TO SUPERSEDED GARBAGE FEES. Motion by Alderman Meyers that Ordinance No. 712 be passed and adopted, seconded by Alderman Kellogg. Upon taking a roll call vote ail aldermen present voted, "Yes." Motion carried. ORDINANCE NO. 713 (second reading) AN ORDINANCE AMENDING SECTION 8.12.034, LAUREL MUNICIPAL CODE, IN ORDER TO ESTABLISH NEW USER CLASSIFICATIONS FOR THE PURPOSE OF SETTING GARBAGE COLLECTION FEES. Motion by Alderman Meyers that Ordinance No. 713 be passed and adopted, seconded by Alderman Marvin Carter. Upon taking a roll call vote all aldermen present voted, "Yes." Motion carried. ORDINANCE NO. 714 (second reading} AN ORDINANCE REPEALING SECTION 8.12.036 IN ORDER TO ABOLISH OLD GARBAGE RATE CLASSIFICATIONS. page 2 Minutes of the City Council of Laurel 714 be passed and adopted, sail vote all aldermen ORDINANCE NO. 715 (second reading) AN ORDINANCE AMENDING SECTION 8.12.040, LAUREL MUNICIPAL CODE, DESCRIBING THE DUTIES OF THE SANITATION DIRECTOR. Motion by Alderman Meyers that Ordinance No. 715 be passed and adopted, seconded by Alderman Harris. Upon taking a roll call vote all aldermen present voted, "Yes." Motion carried. ORDINANCE NO. 716 (second reading) AN ORDINANCE AMENDING SECTION 8.12.042, LAUREL MUNICIPAL CODE, TO ESTABLISH ANNUAL COMMERCIAL GARBAGE COLLECTION FEES. Motion by Alderman Meyers that Ordinance No. 716 be passed and adopted, seconded by Alderman Brennan. Upon taking a roll call vote all aldermen present voted, "Yes." Motion carried. ORDINANCE NO. 717 (second reading) AN ORDINANCE AMENDING SECTION 8.12.046, LAUREL MUNICIPAL CODE, PROVIDING FOR THE RECOMMENDATION OF THE SANITATION DIRECTOR ON CLASSIFICATION OF GARBAGE USERS. Motion by Alderman Meyers that Ordinance No. 717 be passed and adopted, seconded by Alderwoman Sue Carter. Upon taking a roll call vote all aldermen present voted, "Yes." Motion carried. MARVIN CARTER - GARBAGE RESOLUTIONS: RESOLUTION NO. 1932 ANNUAL RESIDENTIAL REFUSE COLLECTION FEES Motion by Alderman Marvin Carter that Resolution No. 1932 be passed and adopted effective in 30 days, seconded by Alderman Meyers. Motion carried. RESOLUTION NO. 1933 ANNUAL COMMERCIAL REFUSE COLLECTION FEES. Motion by Alderman Marvin Carter that Resolution No. 1933 be passed and adopted effective in 30 days, seconded by Alderman Meyers. Motion carried. ANGIE DE CARLO - STREET LIGHT (not present): DeCarlo would like another street light between his place and IGA. Montana Power said they would put one in if it's okayed by the Council. This matter tabeled until DeCarlo makes the request. LARRY PETERSON - PAINT FROM THE STATE: Each year the City is supposed to paint the curbs and crosswalks. In order to purchase the paint from the State at a substantial savings they need a resolution from the City requesting that we buy it from them. ~ ~ : ~ ~ RESOLUTION NO. 1934 BEING A RESOLUTION REQUESTING THE PURCHASE OF STREET PAINT FROM THE STATE OF MONTANA. Motion by Alderman Meyers that Ordinance No. seconded by Alderman Brennan. Upon taking a roll present voted, "Yes." Motion carried with Alderman Gauthier voting, "No."~ GEORGE FOX - UPDATE ON VILLAGE SUBDIVISION: Mr. Fox reported on the progress of Village Subdivision. He stated that about 71% of the pipe is in the ground and hopefully they can start on the streets next week. The sale of lots is going quite well and they have sold in excess of 50 lots. Alderman Marvin Carter asked if they could put a fire road in. It would really help the fire department. Carter also commended Fox for hiring Dick Metzger. They feel he will do a first class job. Fox also asked if they could meet with the Public Utilities Committee regarding the sewer surcharge fee. Larry to notify Fox when they have their next meeting. COMMITTEE REPORTS: Bill Brennan - License C.o~m. ittee presented and reviewed the committee minutes of August 16, 1982. ' Motion by Alderman Brennan to accept the committee,s recommendations and issue a City license to the first five names on the list (Wilbur Hein, James McIntosh, George Fox, Paul Thomae, and James Stevens), seconded by Alderman Marvin Carter. Motion carried. Motion by Alderman Brennan to accept and approve the License Committee minutes of August 16, 1982, seconded by Alderman Marvin Carter. Motion carried. Bob GaUthier - Nego~atin~ Com~ttea presented and reviewed the committee minutes of July 21, 1982. Discussion regarding a lump sum payment for clothing allowance for policemen. Gauthier has asked that the Council review this matter and he will bring it up at the next Council meeting. Bob Gauthier - Budget/Finance Committee presented and reviewed the committee minutes of August 3, 1982. Motion by Alderman Kellogg to accept and approve the Budget/Finance Committee minutes of August 3, 1982, seconded by Alderwoman Sue Carter. Motion carried. Marvin Carter - Garbage Committee stated that the Garbage Committee has come up with a recommendation for new landfill hours as follows: Monday Tuesday & Thursday Wednesday Friday Saturday 8--7 8--4 9--7 These hours will go into effect on Monday, August 23rd. The Garbage Committee would like to ask Council approval to go out for bid on a steel wheel compactor. Both new and used. Motion by Alderman Marvin Carter that the Council go on record as accepting the Garbage Committee's recommendation of going out for bids on a garbage com- pactor, seconded by Alderman Meyers. Motion carried. The Garbage Committee also recommended that we go out for bids on a new garbage truck or new packers put on the present garbage trucks. They would like it bid both ways. page 4 Minutes of the City Council of LaUrel Motion by Alderman Marvin Carter to take the Garbage Committee's recom- mendation and go on record to bid for a new truck and/or the outer components for the present trucks, seconded by Alderman KeZlogg. Motion carried. Marvin Carter reported that Orville Wilmont will be in town August 25th with information about.some diesel trucks that he wants to talk about. The committee also want to talk to him about the recycling burn system that they have in Livingston. Ed Flapp, Director of the Livingston system and Pete Knutson, Chairman, wilI be at the September 7th Council meeting to discuss their first three months of operations. Don Meyers - Boom Truck reported that Montana Power Co. in Billings has a 1970 GMC boom truck that they are putting up for bid on August BOth. The committee will go look at it next week.
