Lonnie Kellogg Marvin Carter Duane Behm Donald Meyers COUNCIL MEMBERS ABSENT: none to order by Mayor Albert Ehrlick Bill Brennan Susan Carter Rob Harris Bob Gauthier INVOCATION: Invocation given by Reverend Biller. MINUTES: Motion by Alderman Marvin Carter to approve the minutes of the regular meeting of July 20, 1982, as presented, seconded by Alderman Brennan. Carried. CORRESPONDENCE: Received notification from Montana League of Cities and Towns regarding the 1982 annual convention to be held at West Yellowstone on Septem~ ber 8, 9, 10, and lIth. Don Hackmann mentioned that in the past the City Clerk attended the con- vention as the official delegate from the City, and requested that he be per- mitted to attend again this year. Motion by Alderman Behm to grant the City Clerk permission to attend the 1982 annual Montana League of Cities and Towns convention at West Yellowstone, September 8, 9, 10 and 11, seconded by Alderman Meyers~ Carried. CLAIMS: The claims for July were reviewed by the Budget/Finance Committee and recommend that they be paid~ Motion by Alderman Gauthier to approve for payment the claims for July, seconded by Alderman Behm. Carried. ORDINANCE NO. 700-A (second reading) AN ORDINANCE AMENDING SECTION 3 OF PROPOSED SECTION 2.04.015 OF THE LAUREL MUNICIPAL CODE IN ORDER TO CLARIFY THE BALLOT ISSUE CALLED FOR UNDER SUCH SECTION. Motion by Alderman Marvin Carter that Ordinance No. 700-A be passed and adopted, seconded by Alderman Kellogg. Upon taking a roll call vote all aldermen present voted, "Yes." MARVIN CARTER - GARBAGE ORDINANCES: Alderman Marvin Carter presented several ordinances regarding garbage collection, etc. ORDINANCE NO. 712 (first reading) AN ORDINANCE AMENDING SECTION 8.12.030, LAUREL MUNICIPAL CODE, IN ORDER TO DELETE REFERENCE TO SUPERSEDED GARBAGE FEES. Motion by Alderman Marvin Carter that Ordinance No. 712 be passed and adopted, seconded by Alderman Meyers. Upon taking a roll call vote all aldermen present voted, "Yes." Ordinance passed on first reading. ORDINANCE NO. 713 (first reading) AN ORDINANCE AMENDING SECTION 8.12.034, LAUREL MUNICIPAL CODE, IN ORDER TO ESTABLISH NEW USER CLASSIFICATIONS FOR THE PURPOSE OF SETTING GARBAGE COLLECTION FEES. page 2Minutes of the City Council of Laurel Motion by Alderman Marvin Carter that Ordinance No. 713 be passed and adopted, seconded by Alderman Brennan. Upon taking a roll call vote, all aldermen present voted, "Yes." Ordinance passed on first reading. ORDINANCE NO. 716 (first reading) AN ORDINANCE REPEALING SECTION 8.12.036 IN ORDER TO ABOLISH OLD GARBAGE RATE CLASSIFICATIONS. Motion by Alderman Marvin Carter that Ordinance No. 7lb be passed and adopted, seconded by Alderman Harris. Upon taking a roll call vote all aldermen present voted, "Yes." Ordinance passed on first reading. ORDINANCE NO. 715 (first reading} AN ORDINANCE AMENDING SECTION 8.12.0b0, LAUREL MUNICIPAL CODE, DESCRIBING THE DUTIES OF THE SANITATION DIRECTOR. Motion by Alderman Marvin Carter that Ordinanoe No. 715 be passed and adopted, seconded by Alderman Behm. Upon taking a roll call vote ali alder- men present voted, "Yes." ORDINANCE NO. 7!6 (first reading} AN ORDINANCE AMENDING SECTION $.12.062, LAUREL MUNICIPAL CODE, FO ESTABLISHiANNUAL COMMERCIAL GARBAGE COLLECTION FEES.~ ~ Motion by Alderman Marvin Carter that Ordinance No. 716 be passed and adopted, seconded by Aiderman Kellogg. Upon taking a roll call vote all aldermen present voted, "Yes." Ordinance passed on first reading. ORDINANCE NO. 717 (first reading) AN ORDINANCE AMENDING SECTION 8.12.066, LAUREL MUNICIPAL CODE, PROVIDING FOR THE RECOMMENDATION OF THE SANITATION DIRECTOR ON CLASSIFICATION OF GARBAGE USERS. Motion by Alderman Marvin Carter that Ordinance No. 717 be passed and adopted, seconded by Alderman Meyers. Upon taking a roll call vote ali aldermen present voted, "Yes." Ordinance passed on first reading. COMMITTEE REPORTS: Bill Brennan - License Committee Mr. Brennan presented the License Committee minutes of August 2, 1982. Discussion regarding the bonding of contractors. Discussion regarding the possibility of contractors in the Village Subdivision not having a City business license. Larry Peterson will check with George Fox on this matter. The following Business License Applications were presented for Council approval: Don Majerus d/b/a Spa Health Club of Laurel, Inc., in the old Post Office building. License Committee recommends approval. Motion by Alderman Brennan to approve the Business License Application for Spa Health Club of Laurel, Inc~, seconded by Alderman Marvin Carter. Carried. page Minutes of the City Council of Laurel Hazel Klein and Almeada Fadness d/b/a Haus of Realty, 620 2nd Avenue. License Committee recommends approval. Motion by Alderman Meyers to approve the Business License Application for Haus of Realty, seconded by Alderman Marvin Carter. Carried. Randy Johnson d/b/a Interstate Exxon, 305 South 1st Avenue. License Committee recommends approval. Motion by Alderman Meyers to approve the Business License Application for Interstate Exxon, seconded by Alderman Marvin Carter. Carried. Aidermen Meyers, Marvin Carter, and Rob Harris were excused to answer a fire call. Discussion regarding Transient Business License Applications. Bill Brennan said that he would contact Joe Bradley regarding a possible amendment to the present ordinance. Mike Bloom informed the Council that there isn't such a thing as a "Green River Ordinance." If a person has a Business License there isn't anything anybody can do to the people who go door to door. If they purchase a license it's unconstitutional for them not to be able to go door to door. About a year ago, Billings lost a Supreme Court case regarding the Green River ordinance. Motion by Alderman Brennan to accept and approve the License Committee minutes of August 2, 1982, seconded by Alderman Kellogg. Carried. Bob Gauthier - Budget/Finance Committee Mr. Gauthier presented the minutes of July 27, 1982. The Committee recommends a water rate increase of 12% and that the sewer rate should be reviewed also. This was referred to the Public Utilities Com- mittee. Motion by Alderman Gauthier to accept and approve the Budget/Finance Committee minutes of July 27, 1982; seconded by Alderman Behm. Carried. Alderman Gauthier presented the non-union salary schedule for 1982-83. Motion by Alderman Gauthier to accept and approve the non-union salary schedule for 1982-83, seconded by Alderman Brennan. Carried. MIKE BLOOM - UNIFORM CODE: Mr. Bloom presented the Basic Uniform Regulations for sworn personnel of the Laurel Police Department. ~ Discussion regarding uniform code. Discussion regarding the payment of the uniform allowance. This came up one other time at a Council meeting that we not issue a one-time check. In light of that there was considerable discussion and since three aldermen are not here at this time, through no fault of their own, Alderman Kellogg suggested we table this until another time. Motion by Alderman Kellogg to table this until the next meeting. Alderman Kellogg withdrew his motion. Motion by Alderman Behm to approve the Uniform Code A-O as stated in the page Minutes of the City Council of Laurel letter of July 28~ 1982, seconded by Alderman Brennan. Carried. The method of payment will be determined at a later date and according to the union contract. INTERLOCAL COOPERATIVE COMMISSION: The Commission has presented a joint resolution calling for a special election on the consolidation of law enforce- ment for Yellowstone County. Discussion. RESOLUTION NO. 19B1 CALLING A SPECIAL ELECTION ON THE QUESTION OF CONSOLIDATION OF LAW ENFORCEMENT FOR YELLOWSTONE COUNTY. Motion by Alderman Behm that Resolution No. 19B1 be passed and adopted, seconded by Alderwoman Sue 'Carter. Carried ~--1 with Alderman Brennan voting, The City Clerk requested vacation from August 11--2~; however, in talking with the auditors they would like their deadline extended from August BOth to September 15th. Motion by Alderman Behm to extend the auditor's deadline to September 15, 1982, to allow the Ci't'y Clerk time to go on vacation, seconded by Alderman Kellogg. Carried. The City Clerk requested permission to leave the State August 11--2~. Motion by Alderman Behm to grant permission for the City Clerk, Don Hackmann, to leave the State August 11--2~, seconded by Alderman Kellogg. Carried. LARRY ?ETER$ON announced that Thursday morning at 8:00 a.m. the EMCO people will have a Rapid Rail type of garbage truck in town for demonstration. He informed the Council that the LDS Church has passed a couple of dead- lines for installing curb and gutter. Last Friday Larry met with their architect from Billings and as soon as he is finished with the plans, they w±ll let the contract. It is expected that the sidewalk and curb will be done by the end of the month. Larry presented the Council with an application for the City to become an AMS/Oil dealer so that they can buy their products at wholesale from a warehouse in Billings. The City would designate one person as their buyer. He would be given an identification number that the City could use to send whoever they wanted to go get the products. There is a $500.00 minimum order. Discussion. Motion by Alderman Behm to give Larry Peterson and Don Hackmann authority to fill out the AMS/Oil Dealer Application for the City and to pay the annual $12.00 fee, seconded by Alderman Brennan. Carried ~--1 with Alderman Kellogg voting, "No." Alderman Kellogg commended the Laurel JC's for an excellent air show this past weekend. They did a super job. There being no further business to come before the Council at this time, the meeting was adjourned at 8:15 p.m~,~ Donald L.
