July 20, 1982
A regular meeting of the City Council of the City of Laurel, Montana,
was held in the Council Chambers and called to order by Mayor Albert Ehrlick
at 7=0~ p.m., on July 20, 1982.

INVOCATION:
MINUTES= Motion by Alderman Meyers to approve the minutes of the regular
mee~of July 6, and the 2 Special meetings of July 12, 1982, as pre-
sented, seconded by Alderman Marvin Carter. Carried.
Joe Bradley introduced Art Thompson, the summer intern, who will work
for a month and revise and bring ail the Ordinances up to date.
CORRESPONDENCE= Received a hole from A.A. Woinowski and Mrs. Bert Hopple
supporting the spraying for mosquitos.
Received a letter from L. John MacMartin regarding the transfer of
ownership on Tract 2 of C/S 975 Amended. This land is owned by the County
and is adjacent to the park land which was dedicated to the public with
the subdivision of Village Subdivision, First Filing.
Motion by Marvin Carter to write a letter to the County
requesting that the land be transferred to the City of Laurel
land purposes, seconded by Alderman Meyers. Carried.

Received a letter from Federal Emergency Management Agency regarding
the necessity for Laurel to adopt a Floodplain Management Ordinance.
Received the Interlocal Cooperation Commission minutes of May 25, 1982.
Received a letter from the Yellowstone County Interlocal Cooperation
Commission recommending consolidation of the Law Enforcement Agencies and
the suggested wording for the ballot.
Received the ge~:~Ce Plan for the Yellowstone County Law Enforcement
Agency.
Received the minutes and activity report for June from the Air
Pollution Control office.
Received the annual report of the Yellowstone City-County Health
Oepartment, for July 1, 1981-June 30, 1982.
CITY CLERK*S AN0 CITY TREASURER'S FINANCIAL STATEMENTS: The City Clerk*s
and City Treasurer's Financial Statements for the month of June were
presented for review and approval.

ROBERT WITTMAN-Civil Defense (not present)
MEL TIENSVOLD= LAUREL JC's. Requested permission to launch hot air
balloons from Thompson Park on Saturday, July 31, 1982. It will involve
some driving on the lawn, but we will keep it down to as little as
possible.
Motion by Alderman Marvin Carter- to grant the Laurel JC~s permission
to launch hot air balloons from Thompson Park on July 31, seconded by
Alderman Harris. Carried.

JOF BRADLEY-ORDINANC~ 7OD-A: It clarifies the previous Ordinance that
the Council passed that established an Ordinance for non-partisan elections,
and we didn't word the ballot issue quite right so we just have to amend it on
the suggestion of the Election office in Billings. The actual ballot
is voting for or against the Ordinance, not voting for or against non-
partisan elections. It is really the same thing but you got to word it,
so the public understands that you are voting for or against the Ordinance.
That is the only changes.
ORDINANCE NO. 7OO-A
AN ORDINANCE AMENDING SECTION 3 OF PROPOSED
SECTION 2.04.015 OF THE LAUREL MUNICIPAL CODE
IN ORDER TO CLARIFY THE BALLOT ISSUE CALLED
FOR UNDER SUCH SECTION.
Motion bv Alderman HeYers that Ordinance No. 700-A be passed and adopted,
seconded by Alderman Brennan. Upon taking a roll call vote all alderman
present voted "yes". Motion carried on 1st reading.
PRELIMINARY BUDGET AND ANNUAL TAX LEVIES:
Motion by Alderman Meyers to adopt the preliminary budget as presented,
seconded by Alderman Harris. Carried.
RESOLUTION NO. 1915
BEING A RESOLUTION LEVYING TAXES FOR GENERAL AND
SPECIFIC PURPOSES FOR THE CITY OF LAUREL, MONTANA,
FOR THE FISCAL YEAR BEGINNING JULY I, 1982.
Motion bv Alderman Meyers. that Resolution No. 1915 be passed and adopted,
seconded by Alderman Gauthier. Carried.
RESOLUTION NO. 1916
BEING A RESOLUTION LEVYING AND ASSESSING ALL OF THE
PROPERTY EMBRACED WITHIN SPECIAL IMPROVEMENT DISTRICT
LIGHT NO. 2~ OF THE CITY OF LAUREL, MONTANA, WITH
THE ENTIRE COST OF MAINTENANCE AND ELECTRICAL CURRENT
FOR THE YEAR 1982.
Motion by Alderman Sue Carter that Resolution No. 1916 be passed and
adopted, seconded by Alderman Brennan. Carried.

RESOLUTION NO. 1918

RESOLUTION NO. 1929

Motion by Alderman KelloRq that Resolution No. 1929 be passed and adopted,
seconded by Alderman Marvin Carter. Carried.
COMMITTEE REPORT~;
Marvtn Carter - Garbaae Cqll~littee I have handed you a sheet from the
Garbage Committee and they are proposing a 10 hour day, q day work week.
With that it shows a schedule of the garbage men and landfill operators
and they have agreed to this type of scheduling. We would like to try
it on a trial basis. I have talked to Andy Loebe, who is a member of
the union, and they are having a meeting in August and if we tried it
on a trial basis and there is something brought up at the union, we could
abate it at that time.
We also worked out the idea of what is going to happen when a men
who's day off is Monday~ and Nonday is a holiday. He will then work his
32 hours that week to make sure he is not taking 2 more hours from
city pay and rest of the members of the work force.
We ask that if we adopt this type of work plan,
during Daylight Savings Time. We would like to try
starting July 26th.

Notion bv Alderman Marvin Carter that upon the recon~endation of the
Garbage Committee, we try the 10 hour day, ~ day work week on a trial
basis for at least one month or up untilthe date of the union meeting,
seconded by Alderman Brennan. Carried.
After reviewing the Public Hearing, the Garbage Committee
recow~aended the ~ollowing rate changes.

Convoy Company from 600 to 50~
In your books you have a resolution regarding charges for residential refuse
collection fees for 1982.
RESOLUTION NO. 1930
ANNUAL RESIDENTIAL REFUSE COLLECTION FEES.
Motion bv Alderman Marvin Carter that Resolution No. 1930 be passed and
adopted, seconded by Alderman Meyers.
There was discussion regarding the changing of the Ordinance before

any resolution is passed setting a new rate, because the commercial
rate is tied in with the residential base rate and the commercial
charges would have to be based o~ multiples of the residential base
rate.

but if the Ordinance establishes the base rate now, probably better
change that first. Then say that from now on the rate will be estab-
lished by resolution from time to time.

Marvin Carter reported that Joe Bradley is in the process of re-
writing the Garbage Ordinance and the residential will be in a separate
one from the commercial.
Joe Bradley reported that an amendment to the present Ordinance
may be all that is necessary.
Alderman Meyers withdrew his second to the motion and Alderman
Marvin Carter withdrew his original motion on adopting Resolution
No. 1930.
The Garbage Cornnittee went on record the other night to not
allow any more 90 gallon containers; we'll use 300 and qOO gallon
containers.
There was discussion regarding the matter, and subdivision
agreements will need to be checked.
Alderman Carter announced the trip to Livingston on July 30, to
look at their Steam Generating Plant.
Larry Peterson said that while we are there, we should also tour
the Waste Water Treatment Plant, which is very similiar to the one
we are having constructed.
Motion by Alderman Marvin Garter to remove from the table, the
motion of May 18th, "to adopt the committees recommendation that the
City get out of the garbage business", seconded by Alderman Meyers.
Carried.
Question was called on the original motion made on May 18th,
adopt the committees recommendation that the City get out of the
garbage business. Hotton was defeated.

Motion by Alderman Marvin Carter that the City of Laurel retain
its landfill operation and garbage businesst seconded by Alderman Meyers.
Carried.

BILL BRENNAN - LICENSE COMMITTEE:
Mr. Brennan presented and reviewed the committee minutes of
July 1~, 1982.
Motion by Alderman 8rennan to adopt the recommendation of the
License Committee to issue Poncho's Tacos a City Business License,
seconded by Alderman Sue Carter. Carried.
Motion by Alderman Brennan to adopt the recommendation of the
License committee to issue Jack Mattson of Park City a City Business
License for cement finishing, seconded by Alderman Meyers. Carried.
Motion by Alderman Brennan to accept and approve the License
Committee minutes of July 1~, 1982, seconded by Alderman Gauthier.
Carried.
BOB GAUTHIER - BUDGET/FINANCE COMMITTCE;
Mr. Gauthier presented the Committee minutes of July 6, 1982.
Motion by Alderman Gauthier to accept and approve the Budget/
Finance Committee minutes of July 6, 1982, seconded by Alderman
Kellogg. Carried.
Mr. Gauthier announced that there will be a Budget/Finance
Committee meeting on Tuesday, July 27th at 7:00 p.m.
MARVIN CARTER - CONCESSION STAND;
Mr. Carter requested permission to have a concession stand
for the Laurel American Legion Baseball tournament this coming week-
end at Thompson Park.
Motion by Alderman Meyers to grant the American Legion permission
to have a concession stand this coming weekend, seconded by Alderman
Harris. Carried.
MAYORS COMMENTS: Budget Transfer for fiscal year 1981-82.
RESOLUTION NO. 1930
BEING A RESOLUTION AUTHORIZING BUDGET TRANSFERS
OR REVISIONS.
Motion by Alderman Meyers that Resolution No. 1930 be passed and adopted,
seconded by Alderman Sue Carter. Carried.
The Mayor reminded the Council of the Special meetings on August
qth and August 9th.
Alderman Kellogg requested permission to leave the State.

Joe Bradley reported that he had written a letter to the owner
of the Jolly Wagon and returned his check for the license fee. He was
told that he could re-apply and be investigated properiY~.~. But until
he does, he should refrain from selling in the City. I have not
received a reply from him.
Don Meyers announced that there will be a Street & Alley Committee
meeting tomorrow night with the Highltne Ditch Company at 7:30 p.m.,
in Walter Eetter~s office regarding the SID that is trying to be
formed up on 1~th Street and Beartooth.
Don Meyers commended Dave Hfchaei, Larry Peterson and the City
Crew for getting Riverside Park into condition for the Good Sam Club.
They had 215 trailers down there and everything went well except
for the mosquitos, and by Saturday , they finally got over that.
