Based on the City Council Resolution R10-17 approved on February 2, 2010, by the City Council, Morrison-Maierle,
Inc.'s contract for the completion of the Phase 2A2 design (Task Order 2) was terminated. Therefore, in compliance
with the conditions of the engineering services contract, Morrison-Maierle has enclosed our work progress to date
as well as a final invoice for these services.
Pursuant to the engineering services contract, Paragraphs 6.05 B (1)(a), 6.05 C, and 6.05 D Morrison-Maierle, Inc.
has completed tasks whose value would otherwise be lost, prepared notes as to the status of completed and
uncompleted tasks, an assembled Task Order materials in orderly files. With. this provision in mind, we have made
any edits to drawings that were contemplated by the time of the termination and compiled a notebook containing
design correspondence, calculations, and pertinent information. The drawing set includes a table of contents that
includes a listing of the drawings that were anticipated, whether they had been started or not. The notebook also
includes a table of contents that identifies the information included in the notebook. We have also included an
electronic copy of each drawing on a CD.
Our invoice includes all charges on this project from December through February 5, 2010. We chose not to process
and send the December invoice once we received the letter dated January 19, 2010 to suspend work on the project,
pending resolution. We suspended work on January 21, 2010 upon receipt of your letter. Upon receiving your next
letter of January 29th, with subsequent Council action on February 2"d, our work on this project was limited to the
contractual requirements of "completing tasks whose value would otherwise be lost". Charges from December
through January 21St for regular project progress and from January 22"d through February 5th for necessary project
wrap-up are included on this final invoice for Task Order 2.
We regret that Morrison-Maierle did meet your expectations for this project and are disappointed that we were not
able to come to a resolution regarding this issue. We are under contract to complete the Phase 2A1 construction
administration services under Task Order 3. Morrison-Maierle, Inc. commits to successfully completing this project
to your satisfaction.
