Minutes of the City Council of Laurel June 15, 1982 A regular meeting of the City Council of the city of Laurel, Montana, was held in the Council Chambers and called at 7:02 p.m., on June i5~ 1982. COUNCIL MEMBERS PRESENT: Lonnie Kellogg Marvin Carter Duane Behm Donald Meyers COUNCIL MEMBERS ABSENT: none to order by Mayor Albert Ehrlick Bill Brennan Susan Carter Rob Harris Bob Gauthier INVOCATION: Invocation given by Reverend Wilhelm. MINUTES: Motion by Alderman Meyers to approve the minutes of the regular meeting of June 1, 1982, as presented, seconded by Alderman Brennan. Carried. CORRESPONDENCE: Received a letter from Larry S. Peterson, Director of Public Works and Dave Michael, Public Utilities Director, regarding a seminar in Helena sponsored~by the Montana League of Cities and Towns, E.P.A. and Montana Department of Health and Environmental Sciences. Received a letter from the Department of Natural Resources and Conserva- tion advising that they have received our application for a loan or grant funds. Received the minutes and activity report for May from the Air Pollution Control office. Received the minutes of May 24, May 26, and June 1, from the Interlocal Cooperation Commission. Received a letter from Agnes C. C~ow, Director of Se~nior Helping Hands Program requesting $2,000 of the City of Laurel's Revenue Sharing monies. Motion by Alderman Behm to continue with the $2,000 donation from Revenue Sharing for fiscal year 1982~83, seconded by Alderman Meyers. Carried. Received a letter from the Department of Health and Environmental Sciences~ Solid Waste Management Bureau, regarding the inspection of the landfill and license application for the landfill expansion. Received a letter and invitation regarding a retirement party for Dan Mizner, Executive Di~ector,.Montana League of Cities and Towns. CITY CLERK'S AND CITY T.REASURER'S FINANCIAL STA.TEMENT.S: The City Clerk's ahd City Treasurer"s' 'E'inan¢ial Statements fo~' the month of May were presented for review and approval. Peg Kamerz~ reported that 61% of the taxes have been collected as of April 30, 1982. Discussion regarding collection of SID assessments. Motion by Alderman Brennan to approve the City Clerk's and City Treasurer's Financial Statements as presented, Seconded by Alderman Meyers. Carried. Carried. MARVIN CARTER - GARBAGE COMMITTEE: Presented a letter received from Larry S. Peterson, Director of Public Works, regarding a study he did on garbage and landfill costs--City vs private hauler. Mr. Carter asked for the Council's approval for this to go to the press. Discussion. (Alderman Meyers left to answer an MDU service call.) Motion by.Alderman Behm to allow the Garbage Committee to release to the press the study done by Larry Peterson, seconded by Alderman Brennan. Carried. A public opinion poll was discussed to get input from the public regarding this study. A public hearing for a rate increase was discussed. Mr. Carter also presented a proposed new commercial garbage rate structure. Discussion. This was referped to the.committee for them to check with the Clerk's Office to see if this new rate structure would be comparable'with the current computer billing Pr0g~am~. Motion b.y Aiderman Marvin Carter to publish a notice of a public hearing as fol'lows: NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that the City Council of the City of Laurel, Montana, will hold a public hearing on July 6, 1982, at 7:00 p.m., in the Council Chambers, City Hall, 2nd floor, Laurel, Montana, to determine an increase in garbage rates as follows: single family residences $84.00 p~r year two-family residences $168.00 per year mobile homes (trailers) $84.00 pe: year page B Minutes of the City CoUncil of Laurel mobile home courts $84.00 for th~ first unit, and $75.60 for each subsequent unit apartment buildings $84.00 for t~e first unit, and $60.00 for each subsequent unit The minimum annual residential refuse cotlectionlfee shall be $84.00 per year. The proposed commercial charges will be the baseirate of $84.00 plus volume usage. I Information concerning this change and the new commercial rate schedule can be obtained at the office of the Director ofiPublic Works, City Hall. Anyone wishing to protest this rate change may a~pear at this hearing. Seconded by Alderwoman Sue Carter. Carried.~ BOB GAUTHIER - UNION CONTRACT: This past week wa have tentatively reached an agreement with the union on their contract. Motion by Alderman Gauthier to accept the p~oposed contract, seconded by AIderman Behm. , Discussion. , Alderman Behm withdrew his second. Aldermafi Gauthier withdrew his motion. Motion .by Alderman Marvin Carter to recess ~nd go into executive session for approximately 20_minu'tes to d'iscuss the proposed union contract, seconded by Alderman Kellogg. Carried. Council back in session. Motion by Alderman Gauthier that we accept ~he new union contract with the wage increase based on a weight'ed average, seconded by Alderman Marvin Carter. Carried. COMMITTEE REPORTS: Duane Beh. m - Budget/Finance Committee: Mr. Behm!presented the committee minutes of the June 1st, June 2'n'd, June 9th, and June 14tlh meetings. Motion by Alderman Behm to accept and approve the Budget/Finance Committee minutes of June 2nd, seconded by Aiderwoman Sue Carter. Carried. Motion by Alderman Behm to enter into the record the Budget/Finance Committee minutes' of June lst.and June 9th, seconded by Ald!erman Marvin Carter. Carried. Motion b.Y Alderman Behm to accept and approve the Budget/Finance Committee minutes of June 14th, seconded by Alderman Brenngn. Carried. Bill Brennan ~ License Committee: Presented the iminutes of June 8th. Reported that they have tentatively approved Auto Electron'ics and Tuneup Specialties (Terry Eastlick) subject to the approval of the Fiire Department. This request has gone to the City-County Pla!nning Board, but the Council has not received notification of their recommenda~tion. Dave Gauslow reported that the Fire Departmelnt is not quite ready to give an OK on this license application yet. Motion by Alderman Brennan to enter into theI record the License Committee minutes of June 8, 1982, seconded by Alderman Marlvin Carter. CARRIED. Parks and Recreation Committee: Motion by Alderman Kellogg to accept and applrove the Parks and Recreation Committee minutes of June 8, 1982, seconded by Allderman Harris. Carried. page4 Minutes of the City CoUncil of Laurel SURPLUS PROPERTY BUREAU: Since there has been a Change in City personnel, the Surplus Property Bureau in Helena is requesting that the City pass a new resolution to supercede Resolution No. 1738 passe~ June 5, 1979, to authorize representatives of the City to purchase government surplus property. RESOLUTION NO. 1913 , AUTHORIZING CITY REPRESENTATIVES TO ACQUIRE FEDERAL SURPLUS PROPERTY. Motion by Alderman Kellogg that ReSolution NO. 1913 be passed and adopted, seconded by Alderwoman Sue Carter. Carried. MAYOR'S COMMENTS: Discussed the City picnic, regarding the City and employees participatin~ together in costs, etc., including ~ossible potluck. Committee members should be invited. , Motion by Alderman Marvin Carter that we hav~ a ~ity picnic and go 50/50. The City come up with half the cost and the employees come up with half the cost, seconded by Alderman Behm. Discussion. , Lonnie Kellogg felt that the City should paylall of the costs. Discussion regarding complaints from previou~ years' picnics. Division of the house called for On the moti6n. No date was set at this time. LEGAL INTERN: The Mayor reported that Art Thompssn has contacted him regarding this position for a three-month period to review ~he City Codes. Joe Bradley mentioned that Art worked for usitwo summers ago. Someone else expressed an interest, but he did not send in a l~tter of application. Discussion. Motion by Alderman Marvin Carter to turn thi~ over to the City Attorney, Joe Bradley, to hire and take care of it, seconde~ by Alderman Kellogg. Carried. The Mayor, Albert Ehrlick, requested permission to leave the State. Motion by Alderman Behm to grant the Mayor p~rmission to leave the State, seconded by Alderman Marvin Carter. Carried. Alderman Gauthier requested permission to leave the State. Motion by Alderman Brennan to grant AldermaniGauthier permission to leave the State, seconded by Alderman Marvmn Carter. C~rr~ed. Duane Behm reported that the Budget/Finance Committee minutes previously approved earlier tonight included a recommendatiofi to leave the dog catcher at half-time until the revenue is reviewed in theifinal budget. Motion by Alderman Kellogg that the dog catcher's request be referred back to the Budget Commit'tee again for further review and recommendation, seconded by Alderman Marvin Carter.' Carried. LARRY PETERSON CHURCH OF THE NAZARENE, 2nd AVE .!& llth STREET: They have completed the ground improvements of their addition and there is an area on 2nd Avenue that needs sidewalk. I would like to see that put in before their lawn gets completely grown in. Discussion regarding any agreement made by t~e former engineer, Curt McKenzie. Larry said that he could not find any ~revious agreement. Motion by Alderman Behm to authorize Larry Peterson to write a letter to the Church of the Nazarene requesting that they install the rest of their sidewalk, seconded by Alderman Marvin Carte~. Carried. Discussion and comments by Larry Peterson regarding the Catholic and Mormon Churches. DAVE MICHAEL - SWIMMING POOL: Reported that the ~ool did open today and that he has a press release set up regarding pool hour~, etc., but it won't get in the paper until next week. He also reported that there is a slight leakizn the bottom of the pool and he hopes maybe it will seal itself off. CEMETERY BOARD: The Mayor reported that according to our ordinance book we need two aldermen on the board, and we only ha~e one at the present time. The Mayor requested that Marvin Carter be appointed. Motion by Alderwoman Sue Carter to approve the appointment of Marvin Carter to the Cemetery Board, seconded by Alderma~ Harris. Carried. MIKE BLOOM - POLICE DEPARTMENT: Mr. Bloom presented the Laurel Police Depart- ment's ~Ctivity Report from October of 1981 through March B, 1982. Alderman Marvin Carter requested a meeting of the committee as a whole immediately following tonight's council meeting. There being no further business to come before the Council at this time, the meeting was adjourned at 9:48 p.m. Donald~L.
