Minutes of the City Council of Laurel April 28, 1982 A Special meeting of the City Council of the City of Laurel, Montana, was held in the Council_Chambers and called to order by Mayor Albert Ehrlick at 7:05 p.m., on April 28, 1982, for the purpose of holding a publ£c hearing on annexation of a port~o~ of U. S. Highway #10 lying east o£ Laurel. COUNCIL MEMBERS PRESENT: Lonnie Kellogg Marvin Carter Donald Meyers Bill Brennan Susan Carter Rob Harris Bob Gauthier COUNCIL MEMBERS ABSENT: Duane Behm PUBLIC HEARING: This being the time and was held. No written protests were received by the City Clerk. Proponents: Ken Tolliver requested that the Council pass the Resolution Annex so that they can proceed with the plans for Village Subdivision. Opponents: none present place advertised, a public hearing to Discussion by..t.he. City .C.ouncil: Lonnie Kellogg - If we pass this resolution and the project does not go throu'gh, ~oes that mean the City will own that "flagpole" stretch of highway? Ken Tolliver It means it will be within the City boundaries. It doesn't mean you will own it. According to the communications between Joe Bradley and the Highway Dept. you can't tax them, they can't change the maintenance duties, it only changes the boundary. The discussion got off of the topic of annexation and centered around the Charge for a sewer hookup. The public hearing recessed at 7:20 p.m., and resumed at 7: 51 p.m. Discussion regarding the covenants of the proposed Village Subdivision. RESOLUTION NO. 1907 EXTENDING THE BOUNDARIES OF THE CITY OF LAUREL, MONTANA, TO INCLUDE CONTIGUOUS GOVERNMENT LAND. Motion b~ Alderman Marvin Carter that Resolution No. 1907 be passed and adopted, seconded by Alderman Brennan. Discussion. Lonnie Kellogg - It seems to me that we are getting the cart before the horse. We have problems that are down the road that should be solved before this annexa- tion. Because it is an unnecessary annexation if we can't get the things that have come up resolved beforehand. Marvin Carter - You also have to get this horse going down the road before you can find out if he can pull the cart. That is something that has to be worked out. Both parties realize that there is a problem. Lonnie Kellogg - It seems to me that we should get the problems resolved before the annexation. Sue Carter - This is just a Resolution of Intent now. The effective date of ~nnexati-~ is June 5th0 This is the way I understand it. page 2 Minutes of the City Council of Laurel Ken Tolliver - The annexation will come finally effective in June. This resolution is the Resolution of Annexation.. That resolution does not become finally effec- tive until June under the statutes. Sue Carter - Anytime between now and then ..... Lonnie Kellogg - It could be changed. Ken Tolliver - It could be rescinded. ©uestion - Motion carried.
