HomeMy WebLinkAboutCity Council Minutes 04.06.1982Minutes of the City Council of Laurel April 6, 1982 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Albert Ehrlick at 7:05 p.m., on April 6, COUNCIL MEMBERS PRESENT: COUNCIL MEMBERs ABSENT: MINUTES: 1982. Lonnie Kellogg Marvin Carter Duane Behm Susan Carter Rob Harris Bob Gauthier Donald Meyers Bill Brennan Motion by Ald~.rma~ Gauthier to approve the minutes of the regular meeting of March 16, 1982, as presented, seconded by Alderman Meyers. Carried. CORRESPONDENCE: Received a thank you card from Dick and Mary Ellen Metzger. Received a memo from Olivia S. Lee of the Williams Agency regarding damage to George M. Merchen's property located at 622 Locust Avenue, Laurel, Montana. This was referred to the Budget/Finance Committee for recommendation. Received a letter from A.F.S.C.M.E. Local 316 expressing a desire to open negotiations. Received an order from the State of Montana, Department of Labor and Industry, Labor Standards Division, to pay Donald Lenhardt for a group insurance premium claim in the amount of $1,028.34. Motion by Alderman-'Carter to make the payment of $1,028.34 to the Labor Standards Division as ordered, seconded by Alderman Meyers. Carried. Received a letter from Yellowstone County Interlocal Cooperation Commission regarding meetings being held through the month of April each Wednesday at 7:00 p.m. in the Billings Public Library. Received a copy of the minutes of the Interlocal Cooperation Commission meetings of March 10th, 17th, and 24th. Received a letter from Alpha Engineers expressing a desire to seek an agreement to provide services in plaoe of the City Engineer who just retired. APPLICATION FOR BUSINESS LICENSE: East 6th Street, Laurel, MT. this Planning Board. Glenn G. Klein dba Magic City Chip C. Watts, dba C. C. Sprinkling, 1303 application was referred to the City-County Lot Sweeping, Rt. 1, Park City, MT. Motion by Aldermaq Kellogg to grant the license for Magic City Lot Sweeping with approval of the License Committee, seconded by Alderman Behm. Carried. FmHA 601 GRANT: The "601" grant which was applied for in 1979 was received on March 29, 1982. Since this was not in the current budget, Don Pooley of the Department of Administration was contacted. According to him, all that is needed and required is a resolution to authorize the expenditures of the grant. RESOLUTION NO. 1901 AUTHORIZING THE EXPENDITURES OF A $15,000.000 FmHA 601 GRANT FOR THE SANITARY LANDFILL OPERATION Motion b.y .Alderman Marvin Carter that Resolution No. 1901 be passed and adopted, ~econded '~y' Alderma'h Behm. Carried. ps e 2 Minutes of the City Council of Laurel CLAIMS: A copy of the "Statement Of Items Released for Payment" for the March claims was presented to the council for review and approval. Motion by Alderman Gauthier to approve the March claims as presented, seconded by Alderman Meyers. Carried. CLOSE OUT SID CONSTRUCTION CASH ACCOUNTS: Per auditor's recommendations and pursuant to State law: RESOLUTION NO. 1900 BEING A RESOLUTION TRANSFERRING CERTAIN FUNDS OF THE CITY OF LAUREL, MONTANA. Motion .by Alderman Marvin Carter that Resolution No. 1900 be passed and adopted, seconded b~ Alderman Kellogg. Carried. DAVE GAUSLOW - FIRE DISTRICT NO..5: Mr. Gauslow presented the agreement for 1982-8B in the amount of $2,900.00. RESOLUTION NO. 1902 A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND RURAL FIRE DISTRICT NO. 5, SAID AGREEMENT RELATING TO PROVIDING FIRE PROTECTION TO SAID DISTRICT. Motion by Alderman Behm that Resolution No. 1902 be passed and adopted, seconded by Alderman Mar~in Carter. Carried. DUANE BEHM - BUDGET/FINANCE/PERSONNEL COMMITTEE: Mr. Behm presented and reviewed the minutes o t e March 25th and ~-~ meetings. There was a motion passed by the committee to limit the amount of accumu- lated comp time to 40 hours. Motion b~ Alderman Behm to amend the motion which was passed by the com- mittee to have no limit on the accumulation of comp time, but to limit the pay out at termination by any salaried employee to 40 hours, seconded by Alderman Gauthier. Discussion. It was suggested that a committee be set up to study the comp time situation. Motion by Alderman Marvin Carter to table the previous motion, seconded by Alderman Behm. Division of. the house: Alderman Gauthier ~ "no" Alderman Kellogg "no" Alderman Harris "yes" Alderman Marvin Carter - "yes" Alderman Behm - "yes" Alderman Meyers "no" Mayor Albert Ehrlick broke the tie with a "yes" vote. Motion carried. The Comp Time Committee appointed is as follows: Duane Behm Joe Bradley Marvin Carter Sue Carter Don Meyers Albert Ehrlick page 3 Minutes of the City Council of Laurel Motion by Alderman Behm to accept and enter into the record, except the motion regarding the maximum of 40 hours of comp time to be accumulated, the Budget/Finance/Personnel Committee minutes of March 26~ 1952, seconded by Alderman Meyers. Carried. Motion by Alderman Behm to accept and enter into the record the Budget/ Finance/Personnel Committee minutes of March 25, 1982, seeonded by Alderman Meyers. Carried. VILLAGE SUBDIVISION: that the council pass Highway 10 lying east Discussion. Ken Tolliver - At this time I would like to request a resolution of Intention to Annex a portion of U. S. of Laurel. RESOLUTION NO. 1903 A RESOLUTION OF INTENTION TO ANNEX CONTIGUOUS GOVERNMENT LAND Motion by Al~erma.~ Mey.ers that Resolution No. 1903 be passed and adopted, seconded by Alderman Gauthier. Carried. The City Clerk, Don Hackmann, reported on the Clerk's Institute held at MSU in Bozeman March 22-26. MAYOR'S COMMENTS: Mayor Ehrlick presented proposed ordinances regarding the City ~ngineer, Maintenance Director, and Director of Public Works. Discussion. These ordinances will be put on the agenda for the April 20th meeting. MARK VERLANIC - LAUREL KEY CLUB: Requested permission from the council to hold a '!~ega's Night" on May 7th for the purpose of raising funds for their organization. Discussion. No money is involved. A donation is made and in return they receive play money. Motion by Alderman Meyers to grant permission to the Laurel Key Club to hold a "Vegas Night" on May 7th, seconded by Alderman Kellogg. Carried. Mayor Ehrlick reported that he had pardoned two (2) people who got tickets for parking across sidewalks. These people felt they should have received warnings because they have parked this way for years and never received any tickets. A notice was put in the Outlook regarding the illegal parking, and anyone in the future will be cited. Mike Bloom had indicated to the Mayor J' that 200 warnings had been issued for parking violations. The people who were pardoned are as follows: Herman Kukes Robert Robinson DON MEYERS: Inquired as to an ordinance regarding cluttered up yards, etc. Joe Bradley reported that we do have an ordinance prohibiting people from accumulating junk~ boards, automobile parts etc. The Police Chief would give them a certain amount of time to clean it up, and if they don't we could clean it up and assess them for it. MARVIN CARTER: There is a little trailer by Laurel Cable TV which I don't know what it is doing there by the sidewalk, but it should be checked in to. page Minutes of the City Council of Laurel I also question the stop signs which were put on 8th Avenue. I thought it was recommended that stop signs be put on 6th Street and 8th Avenue to make the stop coming down from the north before they go to the West School and the other one on 4th Street where they would have to stop and then go past the school so that we would not have the speeding going by the school. Discussion. Mike Bloom stated that stop signs are a touchy situation because when you put a traffic control device in like that you have to have some kind of criteria. Discussion. MARVIN CARTER - LANDFILL: In our committee meeting we have been discussing the possibility of putting out for bid the pit digging and I would like the council's approval for this. Discussion. This will be put in next year's budget, unless funds are available in the current fiscal year. Since the estimated cost is $3,000 no formal bid is necessary. DUANE BEHM: Reported that he has had complaints about drivers not adhering to the rule of the 4-way stop at 1st Avenue and 1st Street. Mike Bloom indicated that he will try to have this patrolled a little more closely. MARVIN CARTER: Reported that he and Sue went to the Mayor's Races in Red Lodge back in February and that he did well for Laurel -- won the race and beat Bil- lings. MIKE BLOOM: Reported on the series of burglaries in the community during the past three weeks and that several arrests have been made. Also, with reference to the Interlocal Commission Study on the consolida- tion of law enforcement,~I think you should watch this very closely. It could be very advantageous or very detrimental to the City of Laurel, however they decide to make the proposal on the consolidated effort. When the commission is ready to make their proposal to the county, I will be prepared to give the council an overview of my personal feelings on the issue, if the council desires. DAVE GAUSLOW: Reported that on April 17th and 18th the fire department will be burning a house down at 520 Wyoming Avenue.
