April 1, 1982
A special meeting of the City Council of the City of Laurel, Montana,
was held in the Council Chambers and called to order by Mayor Albert Ehrlick
1982, for the purpose of discussing the Village
at 7:00 p.m., on April l,
Subdivision, 1st filing.

a very substantial project, and f'or it to be successful will require your
cooperation.
Our purpose tonight is to discuss with you in detail any aspect of the
proposed plan for Village Subdivision.
I would like to touch upon what has occurred already. Some time ago a
proposed plat was submitted to the Department Heads with the City of Laurel
to analyze the proposal for water, fire and sewer design. The plat was
approved with certain conditions attached. We have then proceeded to meet
those conditions.
One of the conditions was to place the property in position to be
annexed to the City of Laurel. It was your requirement that you would not
provide sewer and water until the property was brought into the city limits.
We have procured the permission from the State Department of Highways to
annex the portion of land running down U. S. 10 to the City of Laurel, which
is so called "flag pole~" and will authorize the city to annex the Village
Subdivision tract.
We have prepared a standby annexation agreement which we will execute
and deliver to your city which allows you to annex the property.
A draft of the Subdivision Improvement Agreement was presented. This has
been reviewed by the City Attorney and John MacMartin.
Mr. Tolliver also reviewed the Restrictive Covenants.
This morning we met with the County Commissioners and received their
assurance that they will allow the area that is now owned by the county as a
gravel pit, to be utilized as a park. We don't want to use this as a substitute
for our park dedication, but it was suggested by Mr. MacMartin that it would
be good to put this together with our park dedication to make a better park.
The layout of the plat is pretty much the same as the preliminary approval.
What we would do is run a forced main down U. S. Highway 10. We have dis-
cussed with the State Highway Department the right to place a utility line
alongside the road in the barrow pit-utility easement, they would allow it,
to a forced main lift station. The water system would enter the property
from the western boundary.

Mr. Tolliver talked about the creation of a Special Improvement District
from a financial viewpoint. I am aware, as everyone involved in this aspect~of
the project, George (Fox), Sandy (Sanderson), to the underwriter, that there have
been problems with the slow down of construction in SIDs. Developers who have
created the districts have relied upon the revolving fund to fund the districts.
We have negotiated with D. A. Davidson on some special terms and conditions that
we are willing to do in order to give a strong assurance to the City of Laurel
that their SID will not become a burden on your revolving fund.
We are willing to commit the entire revenue from this project, not simply
the amount that is assessed for the SID, but also the amount that is paid on
the lot, to the payment of the Special Improvement District itself. It will
take about 35 to 40 lots to service the bond issue. The revenue from all the
lots will be available to secure the SID. Additionally we have added to the
terms and conditions of the contract for deed upon which we will sell the lots.
An amount of 1~2 of the annual SID payment, to be included in the monthly pay-
ment. We will accumulate that money and pay it to the city.
In addition to this we will issue personal guarantees, executed by all
the principles in the development, to where if the money isn't there, you can
come to us personally. We don't want you nor the underwriter to have the im-
pression that we're simply asking the City of Laurel to take a chance.
The SID is estimated to be $550~000 for water, sewer, and curbs. Streets
would be put in the following year at an estimated cost of $80,000. We would
like to request that sidewalks be deleted from the subdivision. The reason
for that is the sidewalks cost $88,000. There will be driveways on each lot.
In addition we waive the right to protest any SID you want to put in there.
We are also going to put garbage containers on concrete slabs.
Discussion regarding sidewalks and rollover curbs.
Discussion regarding keeping the yards neat, clear and the street covenants.

The lots vary in size from 6,000 sq. ft. and up -- one is 15,000 sq. ft.
There was discussion regarding the assessment to each lot owner.
Discussion regarding amortization of the bond issue.
Sanmy Sanderson estimated the average cost per lot for the SID would be
$5,100.00, and a 20-year bond issue was mentioned.
The time tables for the SID was reviewed.
John MacMartin reviewed annexation laws, paving and parks. There is about
20 acres of parks proposed for this area.
Discussion.
Ken Tolliver mentioned that this was an informational meeting to bring
everyone up to date on what we want to do and also to take a reading from you.
Because this will not fly this year unless there is close cooperation between
the developer and the City Council.
John MacMartin explained the "flag pole" annexation anO the water line to
the Village Subdivision.
An easement has been obtained.from Louie yovetich to allow a water line
to be extended across his property.

There was discussion regarding the annexation of an easement. It was
mentioned by John MacMartin that we do not annex Eleanor Roosevelt, Ponderosa,
or the easement. Because if we annex that 18 ft. easement, Louie would have
the right to tap on the water line and use the water within that 18 ft. If
the hose ran 20 ft. and sprinkled past the 18 ft~ easement, technically Louie
would be in violation.
There was d~iscussion about Louie being servieed City water through BN
right now and what is preventing him to hook up to the new line since they
are already getting City water. The BN line is in very bad condition and
also has pressure problems.
More discussion regarding water service and annexation in the general
area of the new water line.
It was suggested that George Fox and Ken Tolliver get

More diseussion regarding annexation.
There was concern about Louie receiving city services and not being
annexed to the City.
Sandy Sanderson mentioned that there is no way Louie can develop his
land under the existing sewer regulations. He cannot hook into the force
main and can't put in septic tanks. So he eannot develop it beyond what he
has got.
More discussion regarding water and sewer lines and service boundary.
John MacMartin asked the question, "Could Couie or Sid's Place or anyone
else buy. a mechanism that will allow them to tap onto that forced main?"
Sandy Sanderson answered, "Yes." If they want to be annexed and you agreed
to it, they could put in a miniature lift station with check valving, etc.
to protect them and they could actually get into the forced main. So if
they wanted to eome into the City and hook up to the forced main, you could
allow it. The main would be big enough to handle it.
More discussion regarding sewer lines and lift stations.
It was mentioned that there would be 127 lots in the 1st filing.
Discussion regarding garbage containers.
Ken Tolliver asked the council if you want us to go ahead? If you give
us the green light we will be back here during the next two months asking for
your cooperation.
Motion by Alderman Meyers that we give them the go ahead according to
their schedule, seconded by Alderman Brennan. Carried.
There being no further business to come before the Council at this time,
the meeting was adjourned at 9:15 p.~~ ~
