COUNCIL MEMBERS PRESENT: Marvin Carter Susan Carter Rob Harris Bob Gauthier COUNCIL MEMBERS ABSENT: Lonnie Kellogg Bi11 Brennan Duane Behm Fred Feuerbacher,III Since there was not a quorum present, no official business was transacted; however, bids for SID 108 were opened and read aloud. Lorene Schardt gave a report on the Interlocal Cooperation Commission. BID OPENING, SID 108:- This .being the time and place advertised, all bids received were opened and read aloud. Construction Bids Empire Sand & Gravel $69,132.00 Montana Contractor's License 971-A . Bid Bond - Cashier's check for $7,500.00 (check returned and bid bond presented at 11:05 on 11/17/83) Barry O'Leary, Inc. $57,901.30 Montana Contractor's License 623-A Bid Bond attached Engineer's Estimate $61,545.00 BOND BID: One bid was received -- Yellowstone Bank, Laurel, MT., at 10.9%. LORENE SCHARDT - INTERLOCAL COOPERATION COMMISSION:. Mrs. Schardt reported on the progress of the ICC Committee, which meets on Wednesday evenings. There was discussion regarding communication, personnel, budget, Laurel Fire and Ambulance, and other areas which Laurel is concerned about if the voters should vote for consolidation in April, 1984. Meeting adjourned at 8:07 p.m. until 7:00 p.m., Thursday. A quorum was not available for the meeting on Thursday, November 17, 1983; therefore, this meeting is scheduled to resume_on Tuesday, November 22, 1983. On November 22.,.1983, at 7:03 p.m., the meeting of November 15, 1983, resumed with the following Council members present: Marvin Carter Bill Brennan Duane Behm Susan .Carter Rob Harris COUNCIL MEMBERS ABSENT: Lonnie Kellogg Bob Gauthier Fred Feuerbacher,III page 2 Minutes of the City Council of Laurel MINUTES: Motion by Alderman Brennan to approve the minutes of the regular meeting of November 1, 1983, as presented, seconded by Alderman Marvin Carter. Carried. CORRESPONDENCE: Received a thank you from Court Kaelberer from Giv-Way Auto for putting in 2~hr, parking signs. in front of his business. Received-a petition from people residing in.Murray Heights opposing the changing of garbage containers from 90-gal. to 300-gal. Received a copy of a letter from Asphalt Supply to Steve Duganz. Received the agenda and the minutes for October from Air Pollution Control. Received the Nov. 2 minutes from the Interlocal Cooperation Commission. Along with that, the City Clerk presented the budget for the City of Laurel on consolidation. Received a letter from Alpha Engineers regarding bids on SID ~k108. Received a letter from BN regarding an oversight in not extending an invitation to City officials. CITY CLERK and CITY-TREASURER'S FINANCIAL STATEMENTS: The City Clerk and City reasurer's Financial Statements for the month of October, 1983, were presented and reviewed for approval. Motion b Alderman Behm-to accept the City Clerk and City Treasurer's Finan- cial Statements as presente , seconded by Alderman Brennan. Motion carried. BIDS SID Ik108 (opened.November 15th): Motion by Alderman Marvin Carter to refer the bids to the Street & Alley Committee for review and recommendation at the December 6th meeting, seconded by Alderwoman Sue Carter. Motion carried. BN RESOLUTION: A resolution was presented to connect the City sewer system to certain property. RESOLUTION N0. 2033 AUTHORIZING BURLINGTON NORTHERN RAILROAD COMPANY TO CONNECT TO CITY SEWER SYSTEM ON CERTAIPI PROPERTY. Motion made b Alderwoman Sue Carter that Resolution No. 2033 be passed and adopted, seconded by lderman Harris. Motion carried 3--2 with Aldermen Brennan and Behm voting, "N0." An ordinance was presented for restoration of streets. ORDINANCE N0. 758 (first reading) PROVIDING FOR FEES TO BE CHARGED BY CITY UPON RESTORING OR REPAVING EXCAVATIONS AND ADDING SECTION 17..04.025, FEES REQUIRED FOR RESTORATION BY CITY, TO THE LAUREL MUNICIPAL CODE. Motion by Alderman Marvin Carter that Ordinance No. 758 be passed-and adopted, seconded by Alderman Brennan. Upon taking a roll call vote, all aldermen present voted,."YES." Motion carried 5--0. J page 3 Minutes of the City Council of Laurel ORDINANCE N0. 756 (second reading) AMENDING SECTION 11.04.015A, STREET AND ALLEY CUTS, OF THE LAUREL MUNICIPAL CODE. Motion by Alderman Harris that Ordinance No. 756 be passed and adopted, seconded by Alderman Brennan.. Upon taking a roll call vote, all aldermen preseht voted, "YES." Motion carried 5--0. ORDINANCE N0. 757 (second reading) AMENDING SECTION 17.76.OlOH, OFF-STREET PARKING, OF THE LAUREL MUNICIPAL CODE. Motion by Alderman Marvin Carter to table Ordinance 48757 until the next Council meeting on December th, 1983, seconded by Alderman Brennan. Motion carried. LARRY PETERSON -.ASPHALT SUPPLY, VAPOR RECOVERY SYSTEM: Discussion regarding the odor problem. Asphalt Supply submitted a letter informing the City stating what they plan to do. CLAIM - RAINBOW .PAINTING: A claim was presented .from Rainbow Painting of Great Falls for the painting of-the standpipe at the water plant. Discussion. Motion by Alderman Harris to approve the payment of the claim from Rainbow Painting, seconded by Alderman Brennan. Motion carried 4--1 with Alderman Marvin Carter voting, "N0." Resolutions were presented for the purchase of a used ambulance, equipment and new motor. RESOLUTION N0. 2034 A RESOLUTION AUTHORIZING AGREEMENT WITH FIRST SECURITY BANK TO PAY FOR A USED AMBULANCE FROM FEDERAL REVENUE SHARING AND/OR EQUIPMENT RESERVE. Motion by Alderwoman Sue Carter that Resolution No. 2034 be passed and adopted, seconded y Alderman Marvin Carter. Motion carried. RESOLUTION N0. 2035 A RESOLUTION AUTHORIZING AGREEMENT WITH FIRST SECURITY BANK TO PAY FOR A NEW MOTOR FOR THE AMBULANCE FROM FEDERAL REVENUE SHARING AND/OR EQUIPMENT RESERVE. Motion by Alderwoman Sue Carter that Resolution No. 2035 be passed and adopted, seconded by Alderman Marvin Carter. Motion carried. RESOLUTION N0. 2036 A RESOLUTION AUTHORIZING AGREEMENT WITH FIRST SECURITY BANK TO PAY FOR EQUIPMENT FOR THE AMBULANCE FROM FEDERAL REVENUE SHARING AND/OR EQUIPMENT RESERVE. Motion by Alderwoman Sue Carter that Resolution No. 2036 be passed and adopted, seconded by Alderman Marvin Carter. Motion carried. page 4 Minutes of the City Council of Laurel ' MARVIN CARTER - CONSOLIDATION OF LAW ENFORCEMENT: Suggested we (the Council) instruct the Department Heads at the F.A.P. Fire Chief, Ambulance Director and Police Chief) to look at some alternatives in case the consolidation does go through. More discussion. COMMITTEE REPORTS: Public Utilities Committee minutes of November 8, 1883, were presented for review. Appointment: Motion by Alderwoman Sue. Carter to approve the appointment of Sharon Herman to the Public Utilities Committee, seconded by Alderman Brennan. Motion carried. Motion by Alderman Harris to accept and approve the Public Utilities Committee minutes of November 8, 193, sseconded by Alderman Marvin Carter. Motion carried. City-County Planning Board minutes of November 10, 1983, were presented for review. Motion by Alderman Brennan to accept the City-County Planning Board's recom- mendation of home occupation for Ronald & Cindy Herman of 110 Woodland Avenue, seconded by Alderman Harris. Motion carried. Discussed right-of-way at Dr. Thomas Beyl's-new office and also Murray Heights annexation. Motion .by Alderman Behm to accept and enter into the record the City-County Planning Boards minutes of November 10, 1983, seconded by Alderwoman Sue Carter. ' Motion carried: License Committee minutes of November 10, 1983, were presented for review. Motion by Alderman Brennan to grant a City license to Harold Duke dba HH&T Land & Development, seconde y Alderman Marvin Carter. Motion carried. Motion by Alderman Brennan to grant a City license to Volk Construction, seconded by Alderwoman Sue Carter. Motion carried. Motion by Alderman Brennan to grant a City license to Rodney .Halvorson dba Ben Franklin Store, seconded y Alderman Marvin Carter. Motion carried. Motion by Alderman Brennan to approve and enter into the record the License Committee minutes of November 10, 1983, seconded by Alderman Marvin Carter. Motion carried. Marvin Carter made the Council aware of the problems with garbage at dif- ferent--.locations-around town. He also commented on the Murray Heights committee about their garbage problem. Budget/Finance Committee minutes of November 1, 1983, were presented for review. Motion by Alderman Behm to enter into the record the Budget/Finance Committee minutes of November 1, 9 3, seconded by Alderman Marvin Carter. Motion carried. Park Committee minutes of October 27, 1983, were presented and reviewed. Motion by Alderman Harris to approve and enter into the record the Park Committee minutes of October 27, 1883, seconded by Alderman Marvin Carter. Motion by Alderman Marvin Carter to enter and approve the Street & Alley Committee minutes of October 27, 1883, seconded by Alderman Harris. Motion carried. MAYOR'S COP9MENT5: The Mayor rep orted that Bob Gauthier requested permission to leave the State. Motion by Alderman Marvin Carter to grant Bob Gauthier permission to leave the State, seconded by Alderman Brennan. Motion carried. City Clerk reported to the Council that .the City licenses are being put on the computer. He also reported that he has not advertised the sale of equipment in the Outlook because there was some talk of pulling some of those items off the list. This will be discussed further at a Street & Alley Committee meeting.
