September 6, 1983
A regular meeting of the City Council of the City of Laurel, Montana, was
held in the Council Chambers and called to order by Mayor Albert Ehrlick at
7:00 p.m., on September 6, 1983.

COUNCIL MEMBERS ABSENT: Susan Carter
INVOCATION: Invocation given by Reverend Gray.
MINUTES: Motion by Alderman Behm to approve the minutes of the regular meeting
of August 16, 1983, and special meeting of August 24, 1983, as presented,
seconded by Alderman Brennan. Carried.
CORRESPONDENCE: Received a letter from State of Montana Department of Health
& Environmental Sciences regarding Federal Sewage Works Grant.
Received a letter from St. Anthony's Church requesting a waiver of the
building permit fee.
Motion by Alderman Behm to waive the building permit fee~ seconded by
Alderman Gauthier. Motion carried. City Clerk will write a letter informing
them that the fee will be waived.
Received a letter from Rainbow Painting Company regarding the painting of
the standpipe and exterior.
Received a memo from Yellowstone County Interlocal Cooperation Commission
regarding the update of the jail situation.
A memo from the Department of Health & Environmental Sciences regarding
Emergency Medioal Services Week--1983.
Received the 1983 Annual Report from the Yellowstone City-County Board of
Health.
Received a letter from the Sandman informing the City they were filing a
lien against the City of Laurel.
Received the lien from the Sandman on September 1, 1983.
Received a letter from Department of Health & Environmental Sciences giving
authorization to award bid to Volk Construction, Inc.
CLAIMS: The claims were reviewed by the Budget/Finance Committee and recommended
that they be paid.
Motion by Alderman Behm to approve.the claims for the month of August,
seconded by Alderman Kellogg. Motion carried.
BID OPENING - REMOVAL OF FIELD LIGHTS AT THOMPSON PARK: This being ~he time and
place advertised, one bid was received, opened and read aloud.
The bid was received from Larned Tree Service $1,550.00.
The bid was referred to the Park Committee to review.
Motion by Alderman Marvin Carter to give the Park Committee
award the bid if the budget permits, seconded by Alderman Harris.

ASPHALT SUPPLY: Alderman Brennan updated on the Asphalt Supply Company and
referred it back to Council. The City Clerk has received a petition with 167
signatures on it objecting to Asphalt Supply & Service, Inc. due to the odor,
garbage, dust and also a letter from Stephen D. Schreiner showing pictures of
how the asphalt plant has damaged his property.
Alderman Brennan stated he feels there is no legal reason why they should
not be given a City license.
L. D. Collins took a sample of the rubber, asphalt and cutback and took
it to the Air Pollution Control Board. Under the present law, there is nothing
they can do about it.
Discussion regarding the dust, garbage that ends up in everyone's yards
and the smell.
Complaints from several residents living in the immediate area of the
plant.
Two gentlemen from Asphalt Supply Co. explained that they were putting up
a fence, start underloading and they have consulted an engineering firm in Bil-
lings to build a vapor recovery system to help control the odor problem.
More discussion.
Alderman Marvin Carter stated that in lieu of what we've heard the gentle-
men say tonight and if all these things get done, the fence put up, the under-
loading to start, and a device be built to heip control the odor problem, I
move that we grant them a license.
Motion by Alderman Marvin Carter that we grant Asphalt Supply Co. a business
license, seconded by Alderman Kellogg. Motion carried with Alderman Harris
voting, "NO."
BOB WEATHERMON - HERBSTFEST PARADE: Bob appeared before the Council to.ask per-
mission to have the Herbstfest Parade on Saturday, September 24, 1983, at 10:30
a.m.
Motion by Alderman Kellogg to give the Herbstfest Committee permission to
have the parade as designated on their map, seconded by Alderman Marvin Carter.
Motion carried.
LICENSING ORDINANCES:
Ordinance No. 744 (second reading)
AMENDING SECTION 5.04.080, TERM OF LICENSES, OF THE
LAUREL MUNICIPAL CODE.
Motion by Alderman Kellogg that Ordinance No. 744 be passed and adopted,
seconded by Alderman Marvin Carter. Upon taking a roll call vote, all aldermen
present voted, "YES." Motion carried 7-0.
Ordinance No. 745 (second reading)
AMENDING SECTION 5.08.040, TRANSIENT MERCHANT LICENSE
FEE, OF THE LAUREL MUNICIPAL CODE.
Motion by Alderman Brennan that Ordinance No. 745 be passed and adopted,
seconded by Alderman Behm. Upon taking a roll call vote, all aldermen present
voted, "YES." Motion carried 7-0.

AMENDING SECTION 5.t2.020, JUNK DEALERS LICENSE FEE,
OF THE LAUREL MUNICIPAL CODE.
Motion by Alderman Kellogg that Ordinance No. 746 be passed and adopted,
seconded by Alderman Brennan. Upon taking a roll call vote, all aldermen
present voted, "YES." Motion carried 7-0.
Ordinance No. 747 (second reading}
AMENDING SECTION 5.16.030, SECOND HAND STORES LICENSE
FEE, OF THE LAUREL MUNICIPAL CODE.
Motion by Alderman Brennan that Ordinance No. 747 be passed and adopted,
seconded by Alderman Behm. Upon taking a roll call voter all aldermen present
voted, "YES." Motion carried 7-0.
Ordinance No. 748 (second reading)
AMENDING SECTION 5.24.040, JUKEBOX LICENSE FEES, OF
THE LAUREL MUNICIPAL CODE.
Motion by Alderman Behm that Ordinance No. 748 be passed and adopted,
seconded by Alderman Marvin Carter. Upon taking a roll call vote, all aldermen
present voted, "YES," except Alderman Kellogg who voted, '!NO." Motion carried
6-1.

AMENDING SECTION 5.32.030, TAXICAB FEES, OF THE LAUREL
MUNICIPAL CODE.
Motion by Alderman Behm that Ordinance No. 749 be passed and adopted,
seconded by Alderman Harris. Upon taking a roll call vote, all aldermen present
voted, "YES." Motion carried 7-0.

REPEALING CHAPTER 5.44, MISCELLANEOUS, OF THE LAUREL
MUNICIPAL CODE.
Motion by Alderman Brennan that Ordinance No. 750 be passed and adopted,
seconded by Alderman Harris. Upon taking a roll call vote, all aldermen present
voted, "YES." Motion carried 7-0.

ADDING SECTION 5.44.010, GENERAL BUSINESS LICENSE FEES,
TO THE LAUREL MUNICIPAL CODE.
Motion by Alderman Kellogg that Ordinance No. 751 be passed and adopted~

present voted, "YES." Motion carried 7-0.

present voted, "YES." Motion carried 7-0.

Motion by Alderman Brennan that Ordinance No. 753 be passed and adopted,

present voted, "YES." Motion carried 7-0.

ADDING SECTION 5.44.030, APARTMENTS, HOTELS, MOTELS,
BOARDING HOUSES LICENSE FEES, TO THE LAUREL MUNICIPAL
CODE.
Motion by Alderman Brennan that Ordinance No. 754 be passed and adopted,
seconded by Alderman Behm. Upon taking a roll call vote, all aldermen present
voted, "YES." Motion carried 7-0.
Ordinance No. 755 (first reading)
ADDING SECTION 16.02.020, PROHIBITING CERTAIN ACTIVITIES
AT SOUTH POND, TO THE LAUREL MUNICIPAL CODE.
Motion by Alderman Feuerbacher that Ordinance No. 755 be passed and adopted,
seconded by Alderman Harris. Upon taking a_roll call vote, all aldermen present
voted, "YES," with Aldermen Kellogg and Marvin Carter voting, "NO." Motion
carried 5-2.
The City Clerk presented the following resolutions:
Resolution No. 2020
BEING A RESOLUTION LEVYING AND ASSESSING A SPECIAL TAX
AGAINST CERTAIN PROPERTY DESIGNATED AS GARBAGE DISTRICTS
IN THE CITY OF LAUREL, FOR THE REMOVAL OF GARBAGE AND
REFUSE.
Motion by Alderman Behm that Resolution No. 2020 be passed and adopted,
seconded by Alderman Marvin Carter. Motion carried.
Resolution No. 2021
BEING A RESOLUTION REQUESTING THE PURCHASE OF STREET PAINT
FROM THE STA'I'E OF MONTANA.
Motion by Alderman Behm that Resolution No. 2021 be passed and adopted,
seconded by Alderman Feuerbacher. Motion carried.
Public Utilities Director, Dave Michael, presented the following resolution:
Resolution No. 2022
APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND
VOLK CONSTRUCTION, INC., SAID AGREEMENT RELATING TO
CONSTRUCTION OF THE WASTEWATER TREATMENT PLANT.
Motion by Alderman Marvin Carter that Resolution No. 2022 be passed and
adopted, seconded by Alderman Brennan. Motion carried.

Motion by Alderman Brennan to grant a City license to Suk Byung Park dba
Park's Karate & Kung Fu School, seconded by Alderman Kellogg. Motion carried.
Motion by Alderman Brennan to grant a City license to Thomas & Carol Brown
dba Grandma's Kitchen, seconded by Alderman Behm. Motion carried.
Motion by Alderman Brennan to enter into the record the License Committee
minutes of August 30, i98B, seconded by Alderman Marvin Carter. Motion carried.
Public Utilities Committee minutes of August 29, 1983, were presented and
reviewed. Discussion regarding K-Decorators and also Engard's warranty.
Motion by Alderman Kellogg to enter into the record and approve the Public
Utilities Committee minutes of August 29, 1983, seconded by Alderman Brennan.

FAP Committee minutes of August 25, 198B~ were presented and reviewed.
Motion by Alderman Feuerbacher to adopt and enter into the record the FAP

Park Committee minutes of August 23, 1983, were presented and reviewed.
Motion by Alderman Feuerbacher to adopt and enter into the record the Park

Police Committee minutes of August 24, 1983, were presented and reviewed.
Discussion regarding the Policy & Procedure Manual for the Laurel Reserve and
Auxiliary Police.
Motion by AIderman Brennan to enter into the record the Police Committee

Airport Authority Committee minutes of August 23, 1983~ were presented and
reviewed.
Motion by Alderman Kellogg to enter into the record the Airport Authority
minutes of August 23, 1983~ seconded by Alderman Brennan. Motion carried.
- Aldermen Behm, Harris, and City Clerk, Don Hackmann, requested permission
t~ leave the State.
Motion by Alderman Kellogg to grant these three people permission to leave
the State, seconded by Alderman Marvin Carter. Motion carried.
Alderman Feuerbacher reported on the Chamber of Commerce building. The
Park Committee did not look into the Retired Men's Club problem. The Chamber
has formed a committee of their own, one member which is also on the Park Com-
mittee. They are meeting with the Retired Men on this matter. The Park Com-
mittee has taken a stand that we will stay out of it for now because the City's
lease agreement with the Railroad calls for just that to be an information
bureau.
MAYOR'S COMMENTS: The Mayor appointed Lee Barndt to the Cemetery Board.

Motion by Alderman Marvin Carter to confirm the appointment of Lee Barndt
to the Cemetery Board, seconded by Alderman Harris. Motion carried.
The Mayor appointed Eugene Edward Eckhardt to the Laurel Police Reserve.
Motion by Alderman Marvin Carter to confirm the appointment of Eugene
Eckhardt to the Laurel Police Reserve, seconded by Alderman Brennan. Motion
carried.
Alderman Marvin Carter complimented Lonnie Kellogg and Sue Carter on the
fine City picnic. In the future, it would be a good idea that all Council
members be available for preparing the picnic and also for cleanup.
There being no further business to come before the Council at this time,
the meeting was adjourned at 9:25
