HomeMy WebLinkAboutCity Council Minutes 04.05.1983Minutes of the City Council of Laurel April 5, 1985 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Albert Ehrlick at 7:00 p.m., on April 5, 1983. COUNCIL MEMBERS PRESENT: Lonnie Kellogg Bill Brennan Marvin Carter Rob Harris Duane Behm Bob Gauthier Fred Feuerbacher, III COUNCIL MEMBERS ABSENT: Susan Carter INVOCATION: Invocation given by Reverend Wilhelm. MINUTES: Motion by Alderman Kellogg to approve the minutes of the regular meeting of March 15~ 1983, as presented, seconded by Alderman Harris. Carried. CORRESPONDENCE: Received a "thank you" card from Fred and Colleen Feuerbacher for flowers sent to her. Received a memo from Harold F. Nanser, .Yellowstone County Attorney, regarding a meeting on March 31, 1983~ pertaining to the Yellowstone County Jail. {The memo had been previously distributed to the Council members.) CLAIMS: Statement of items released for payment for the month of March, 1983, was presented for review and approval. Motion by Alderman Behm to approve the claims as presented, seconded by Alderman Kellogg. Motion carried. BID OPENING - GROUP HEALTH PROPOSALS: This being the time and place advertised, all proposals received were opened and read aloud. Proposals were received from Blue Cross, Transamerica Occidental Life, Prudential, Blue Shield and Washington National (Montana League of Cities and Towns). See attached schedule. Motion by Alderman Behm to refer all proposals to the Insurance Committee for review, seconded by Alderman Marvin Carter. Motion carried. BID OPENING - PAINTING WATER RESERVOIR AND STANDPIPE: This being the time and place advertised, all bids received were opened and read aloud. Bids were received from K-Decorators, Inc., Billings, MT.; Mooney Painting, Inc., Billings, MT.; United Industrial C6atings, Cheyenne, WY.; Rainbow Painting Co., Great Falls, MT.; Oxentenko & Sons, Inc., Bismarck, N.D.; Northwest Bridge and Tank Co., Sheridan, WY. See attached schedule. Motion by Alderman Behm to refer all bids to the Public Utilities Committee for review, seconded by Alderman Harris. Motion carried. WARD BOUNDARIES: Motion by Alderman Brennan to adopt the proposal for new ward boundaries as presented by Dave Halland, Yellowstone County Election Administrator on December 21, 1982, seconded by Alderman Gauthier. Motion carried. COMMUNITY HOPE - FOOD AND CLOTHING BANK: Carol Sabol said that this is a new organization to meet the needs of people who are down on their luck. The Ministerial Association of Laurel agreed to promote and sponsor the Food Bank ~nd the 1st Sunday of each month is designated as Food Bank Sunday. On this day people who want to can bring their food to the participating churches. Also to a non-religious point not yet determined. The organization is currently looking for a small store front or storage area from which to work. page 2 Minutes of the City Council of Laurel An account has been opened at Yellowstone Bank to handle cash contributions. Later on this program will also include clothing. She said that they will handle all requests for help with concern and con- fidentiality. WALLACE HALL - BUILDING CODES: Mr. Hall mentioned that he lives at 1006 1st Avenue, and on October 2, 1979, he bought the residence on First Avenue; and later found out in November while MDU was investigating a leak in the alley, that the garage which was built in April, 1975, had been placed directly over the service main to ~he house. The builder had legally obtained a building permit. Speaking with the girls downstairs they said that no City inspection had ever been made at'the time the garage was built. Therefore it cost me $210.00 for the fact the City did not do the inspection. Mr. Hall submitted the bill for $210.00 he received from MDU. This was referred to the Budget/Finance Committee. The $210.00 was the cost of laying a new line around the garage. Discussion. Dave Michael reported that when he goes out to inspect footings~ etc., he has never been instructed to locate the gas line. That is part of the property owner's responsibility. Discussion. Mr. Hall mentioned that he had talked with a former Councilman, and he told him that it was his opinion that one of the aspects of a building permit was that the City notifies the utilities. Discussion. TRUCK PARKING ORDINANCE: Joe Bradley said that he was asked by the Street and Alley Committee to draw up an ordinance prohibiting certain heavy vehicles from being parked within the City except on Main Street and First Avenue north and south. Discussion. ORDINANCE NO. 732 (first reading) ADDING SECTION 10.51.015, PARKING OF CERTAIN TRUCKS PROHIBITED~ OF THE LAUREL MUNICIPAL CODE. Motion by Alderman Kellogg that Ordinance No. 732 be passed and adopted, seconded by Alderman Marvin Carter. Upon taking a roll call vote~ all aldermen present voted, "YES." Motion carried 7--0. POLICE POLICY MANUAL: on March 15, 1983, for reviewed by the Union~ Alderman Brennan distributed these manuals to the Council review and recommendations. These manuals have also been Police Committee~ and Personnel Committee. Mr. Brennan recommended that the manual RESOLUTION NO. APPROVING AND ADOPTING THE POLICE PROCEDURES MANUAL. be adopted. 1978 POLICIES AND Motion by Alderman Brennan that Resolution No. 1978 be passed and adopted~ seconded by Alderman Feuerbaeher III. Motion carried 7--0. page 3 Minutes of the City Council of Laurel COMMITTEE REPORTS: Budget/Finance Committee minutes of March 16, 1983, were presented and reviewed. Motion by Alderman Behm to enter the minutes of March 16, 1983, into the reoord, seconded by Alderman Gauthier. Motion carried 7--0. The minutes of March 21~ 1983, were presented and reviewed. Motion by Alderman Behm to enter into the record the minutes of March 21, 1983, seconded by Alderman Brennan. Motion carried 7--0. The minutes of March 22, 1983, were presented and reviewed. Motion by Alderman Behm to enter into the record the minutes of March 22, 1983, seconded by Alderman Kellogg. Motion carried 7--0. The minutes of March 30, 1983~ were presented and reviewed. Motion by Alderman Gauthier to enter into the record, the minutes of March 30, 1983~ and also to grant the City Clerk permission to draw up a letter of Certification and send to the County and also to express our feelings towards this new bill, seconded by Alderman Behm. Motion carried 7--0. The minutes of April 5, 1983, were presented for review and approval. Motion by Alderman Behm to enter the minutes of April 5, 1983, into the record and to approve ail recommendations, seconded by Alderman Harris. Motion carried 7--0. Street & Alley Committee minutes of March 15, 1983, were presented for review and approvai. Motion by Alderman Feuerbaeher III to accept and enter into the record the minutes of March 15, 1983, seconded by Alderman Marvin Carter. Motion carried 7--0. The minutes of March 23, 1983, were presented and reviewed. Motion by Alderman Feuerbacher III to accept and enter into the record the minutes of March 23, 1983, seconded by Alderman Marvin Carter. Motion carried 7--0. License Committee minutes of March 30, 1983, were presented for review and approvai. Motion by Alderman Brennan to enter into the record the minutes of March 30, 1983, and approve the recommendations for Cit~ licenses, seconded by Alderman Marvin Carter. Motion carried 7--0. Cemetery Committee minutes of March 21, 1983, were presented and reviewed. Discussion. Motion by Alderman Harris to accept and approve the minutes of March 21, 1983, seconded by Alderman Keliogg. Motion carried 7--0. MAYOR'S COMMENTS: Don Hackmann reported on the Montana Institute for Municipal Clerks held at MSU in Bozeman on March 21-~25. Marvin Carter introduced the new Fire Chief, Darrell L. McGillen. Motion by Alderman Marvin Carter to accept the appointment of Darrell L. McGillen as the new Fire Chief of Laurel, seconded by Alderman Harris. Motion carried 7--0. Alderman Marvin Carter and Alderman Brennan requested permission to Ieave the State. page 4 Minutes of the City Council of Laurel Motion by Alderman Behm:to grant permission for Marvin Carter and Bill Brennan to leave the State, seconded by Alderman Feuerbacher III. Motion carried. Mayor Ehrlick mentioned that he had received a letter f~om the County Commissioners requesting permission to hold four meetings a year here, and that he has responded by saying it would be okay. The dates will be set at a later time. The Mayor would like to appoint all of the Working Foremen to the appropriate committees, Motion by Alderman Marvin Carter to accept the appointments of the Working Foremen to committees, seconded by Alderman Brennano Motion carried 7--0. Dave Michael reported that the moving of the gas and crude oil lines at the Wastewater Treatment Plant was considerably less than the Engineer's Estimate. The MDU line.engineer's estimate was $43,936 and actual cost was $39,480, and the Continental Pipeline engineer's estimate was $69,600 and actual cost was $48,338. Be also reported that the plans should be back from the State, and after corrections are made by HKM~ it will be going Out for bid. Dave also commented that the new garbage truck should be delivered by the end of next week. Discussion regarding the sale of bonds for the Wastewater Treatment Plant project.
