HomeMy WebLinkAboutCity Council Minutes 01.04.1983held Minutes of the City Council of Laurel January 4, 1983 A regular meeting of the City Council of the City of Laurel~ Montana, was in the Council Chambers and called to order by Mayor Albert Ehrlick at 7:05 p.m., on January 4, COUNCIL MEMBERS PRESENT: 1983. Lonnie Kellogg Marvin Carter Donald Meyers COUNCIL MEMBERS ABSENT: Duane Behm Bill Brennan Susan Carter Rob Harris Bob Gauthier MINUTES: Motion by Alderman Kellogg to approve the minutes of the regular meeting of December 21, 1982, as presented, seconded by Alderman Harris. Carried. CORRESPONDENCE: Received a thank you from the employees at City Hall for the Christmas gift certificates given to them December 30, 1982. Received a letter from Shirley and James Carmony, 517 2nd Street West, regarding a claim for water damage. This was referred to the Public Utilities Committee for review and possibly their referral to City's insurance carrier. At this time Larry Peterson reported on the Emineth claim and said it had been turned over to the insurance company; and he had talked with them today, and they should have an answer back to us by the end of the week. Discussion regarding.the notification of customers when the water is shut off because of a water leak. Received a memorandum from Lieutenant Governor George Turman regarding the reservation of Room 209 at the Capitol, every Friday at 3:00 p.m., to exchange information, to take stock of the progress of legislation or whatever. CLAIMS: Statement of Items Released for Payment for the month of December was presented for review and approval. Motion by Alderman Meyers that the claims for the month of December be approved for payment as presented, seconded by Alderman Keiiogg. Carried. PUBLIC HEARING - ANNEXATION OF TRACT A-2 TRACT "A" AMENDED CERTIFICATE OF SURVEY NO. 1642~ SITUATED IN SE¼~ SE¼. OF SECTION 8 T2S, R24E, PMM: This being the time and place advertised, a public hearing was held. There were no opponents at the hearing. The Laurel-Yellowstone City-County Planning Board recommended that the petition for annexation be granted. RESOLUTION NO. 1957 EXTENDING THE BOUNDARIES OF THE CITY OF LAUREL, MONTANA, TO INCLUDE TRACT A-2 TRACT "A", AMENDED CERTIFICATE OF SURVEY NO. 1642, SITUATED IN SE¼SE¼ OF SECTION 8, T2S~ R24E, PMM, YELLOWSTONE COUNTY, MONTANA. Motion by Alderman Meyers that Resolution No. 1957 be passed and adopted, seconded by Alderman Brennan. Carried. page 2 Minutes of the City CoUncil of Laurel RESOLUTION NO. 1958 CHANGING THE BOUNDARIES OF WARD ONE TO INCLUDE CERTAIN TRACT, TRACTS AND PARCELS OF LAND AND DIRECTING CERTIFICATION OF THE ALTERED BOUNDARIES. Motion by Alderman Meyers that Resolution No. 1958 be passed and adopted, seconded by Alderman Brennan. Carried. ORDINANCE NO. 721 (second reading) SALARY OF THE CITY JUDGE Motion by Alderman Kellogg that Ordinance No. 721 be passed and adopted, seconded by Alderman Harris. Upon taking a roll call vote, all aldermen present voted ,"YES." Motion carried 7--0 on second reading. Larry Allen, Reed iPoint, requested to be on the agenda, but he was not present tonight. NKM - SEWER RATE INCREASE - JIM KAERCHER & STEVE QUAIL: Mr. Kaercher reported that the construction plans and specifications have been completed, and they are in the printing process now and should be done by Friday. From this point the plans will be sent to the State for their review and approval. The Corps of Engineers will review them and the City will get a copy also for them to review also. The State has notified HKM that the grant increase request has been approved, but EPA has to sign off on it yet. A rate hearing date and requirements were discussed. RESOLUTION NO. 1959 BEING A RESOLUTION SPECIFYING A PERMANENT SEWER RATE TO BECOME EFFECTIVE TEN (10) DAYS AFTER-BEING FILED WITH MUNICIPAL CLERK AND REVISED RATE SCHEDULE FILED WITH THE PUBLIC SERVICE COMMISSION. Motion by Alderman Brennan that Resolution No. 1959 be passed and adopted, seconded by Alderman Kellogg. Motion carried. Steve Quail recommended that the contract with Burlington Northern be negotiated and modified to be consistent with the proposed rate structure. The Public Utilities Committee will follow up on this. Discussion regarding the sale of bonds. COMMITTEE REPORTS: Ambulance Committee The minutes of August 24, 1982, were presented for review and approval. Motion by Alderwoman Sue Carter to accept and approve the minutes of August 24, 1982, seconded by Alderman Meyers. Carried. The Ambulance Committee minutes of December 29, 1982, were presented for review and approval. Motion by Alderwoman Sue Carter tb accept and approve the minutes of December 29, 1982, seconded by Alderman Harris. Carried. Garbage Committee The minutes of December 27, 1982, were presented for review and approval. page 3 Minutes of the City Council of Laurel Discussion regarding a Resource Recovery program. Motion by Alderman Marvin Carter to accept and approve the Garbage Committee minutes of December 27, 1982, seconded by Alderman Meyers. Carried. Retirement Gifts - Don Meyers A cash gift was discussed based on the length of service. Because IRS requires that a cash gift has to be included in gross in- come, it was decided to buy each retiree a gift certificate from the store of their choice. RESOLUTION NO. 1960 A RESOLUTION ESTABLISHING A POLICY FOR AN EMPLOYEE RETIREMENT GIFT. Motion by Alderman Meyers that Resolution No. 1960 be passed and adopted, seconded by Alderman Marvin Carter. Motion carried. Personnel Committee - Sue Carter The committee met and reviewed the resumes' from candidates for the position of City Judge and decided that the entire Council should pick the person. The candidates are as follows: Joan Hapeman Wanda J. Goick Arthur J. Thompson Larry D. Herman Henry B. Hardy Mary M. Korth Discussion regarding schooling. Joe Bradley reported that the way.the law is set up there is supposed to be a special orientation course right after an election that an attorney or previous judge wouldn't have to attend, but any other person would. In addition to that there are two annual mandatory training sessions that everyone has to attend. Ballots have been distributed to each council person; and Duane Behm, because of his work schedule, could not attend the council meeting, but he did cast a ballot prior to the council meeting. Motion by Alderman Marvin Carter to accept Alderman Behm's ballot in absentee, seconded by Alderman Brennan. Motion carried. After taking a vote by secret ballot, the results are as follows: Wanda J. Goick 1 vote Arthur J. Thompson 2 votes Larry D. Herman 5 votes Motion by Alderman Kellogg that Larry D. Herman be appointed to fill the unexpired term of Walt Menello ~ effective February 1, 1983, seconded by Alder- woman Sue Carter. Motion carried. MAYOR'S COMMENTS: Larry Peterson, Director of Public Works, announced that a CPR training class will be held here at City Hall January 25th and 26th from 7--10 p.m. for City employees. We have a certified Red Cross instructor on the crew of the City who will teach this class for $5.00 a person. Appointments The Mayor reappointed Director, per Ordinance No. 639. the possibility of making the CPR training Dave Michael for one year as Public Utilities Motion by Alderwoman Sue Carter to confirm the reappointment of Dave Michael for one year, seconded by Alderman Meyers. Motion carried. Marvin Carter reported that he has written a letter to Cenex stating that the City will not accept any more half barrels of tar at the landfill. Discussion. Keno Machine License Alderman Brennan wanted some advice as to the licensing of Keno machines. Discussion. Motion by Alderman Kellogg that Keno machines be licensed at $750.00 for the f~i-~ a-~ ~ach for any thereafter, seconded by Alderman Meyers. Motion carried. Discussion regarding Par$or licenses. There being no further business to come before the Council at this time, the meeting was adjourned at 8:07 p.m.~~H~.
