HomeMy WebLinkAboutCity Council Minutes 11.17.2009MINUTES OF THE CITY COUNCIL OF LAUREL November.17, 2009 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by President Doug Poehls at 6:30 p.m. on November 17, 2009. COUNCIL MEMBERS PRESENT: Emelie Eaton Kate Hart Chuck Rodgers COUNCIL MEMBERS ABSENT: Alex Wilkins OTHER STAFF PRESENT: Mary Embleton Sam Painter Doug Poehls Mark Mace Chuck Dickerson Norm Stamper Bill Sheridan Kurt Markegard President Poehls led the Pledge of Allegiance to the American flag. President Poehls asked the council to observe a moment of silence. MINUTES: Motion b Council Member Eaton to approve the minutes of the regular meeting of November 3, 2009, . as presented, seconded by Council Member Dickerson. There was no public comment or council discussion. A vote was taken on the motion. All six council members present voted aye. Motion carried 6-0. CORRESPONDENCE: State of Montana, Department of Labor and Industry: Notice of Public Hearing on proposed amendment of ARM 24.17.127 related to prevailing wage rates for public works projects - building construction services, heavy construction services, highway construction services, and non- construction services. PUBLIC HEARING: None. CONSENT ITEMS: . • Clerk/Treasurer Financial Statements for the month of November 2009. 0 Approval of Payroll Register for PPE 11/01/2009 totaling $165,049.25. • Receiving the Committee Reports into the Record. --Bud et/Finance Committee minutes of November 3, 2009 were presented. --.City-County Planning Board minutes of November 5, 2009 were presented. Council Workshop minutes of November 10, 2009 were presented. --Laurel Urban Renewal A enc minutes of October 12, 2009 were presented. --Cemetery Commission minutes of November 9, 2009 were presented. President Poehls asked if there was any separation of consent items. There was none. Motion b Council Member Hart to approve the consent items as presented, seconded by Council Member Eaton: There was no public comment or council discussion. A vote was taken on the motion. All six council members present voted aye. Motion carried 6-0. CEREMONIAL CALENDAR: None. Council Minutes of November 17, 2009 REPORTS OF BOARDS AND COMMISSIONS: None. AUDIENCE PARTICIPATION (THREE-MINUTE LIMIT): Larry Tanglen, Laurel Outlook, read the following portions of a press release he received today. "The U.S. Senate today unanimously approved legislation by Senator Jon Tester that would put the new Yellowstone County Veterans' Cemetery in the running to become a national veterans' cemetery, which would be maintained by the federal government. Tester included a provision in the Military Construction and Veterans Affairs Appropriations Act requiring the National Cemetery Administration to study the possibility of creating a national cemetery in Montana, Wyoming, North Dakota, Idaho, or eastern Washington. Tester's language specifically directs the agency to consider turning the Yellowstone County Veterans' Cemetery in Laurel into a national cemetery. The measure must now be combined with the House's version of the bill before signing into law by the President." Larry stated that this is good news for Laurel. President Poehls thanked Larry and stated that it is very good news as many people have done a lot of work on that issue. SCHEDULED MATTERS: Confirmation of Appointments: None. Ordinance No. 009-11: Ordinance amending Section 2.68.100 of the Laurel Municipal Code, amending the procedure to modify the City Judge's salary. First reading. Motion b Council Member Mace to adopt Ordinance No. 009-11, seconded by Council Member Hart. There was no public comment or council discussion. A roll call vote was taken on the motion. All six council members present voted aye. Motion carried 6-0. The public hearing for Ordinance No. 009-11 will be on the December I" council agenda. • Resolution No. R09-127: A resolution authorizing the Mayor to execute an amendment to the City's. agreement with the State of Montana Department of Transportation for the City's Laurel Northeast Community Transportation Enhancement Program "CTEP". Motion b Council Member Eaton to approve Resolution No. R09-127, seconded by Council Member Hart. There was no public comment or council discussion. A vote was taken on the motion. All six council members present voted aye. Motion carried 6-0. • Resolution No. R09-128: A resolution authorizing the Mayor to execute an agreement with the Municipal Code Corporation for a legal review of the Laurel Municipal Code. Motion b Council Member Dickerson to approve Resolution No. R09-12$, seconded by Council Member Rodgers. There was no.public comment or council discussion. A vote was taken on the motion. All six council members present voted aye. Motion carried 6-0. ITEMS REMOVED FROM THE CONSENT AGENDA: None. COMMUNITY ANNOUNCEMENTS (ONE-MINUTE LIMIT): None. COUNCIL DISCUSSION: Council President Poehls stated that the Emergency Services Committee would not meet in November or December, but the committee will meet again in January 2010.
