HomeMy WebLinkAboutCity Council Minutes 05.01.1984Minutes of the City Council of Laurel May 1, 1984 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Albert Ehrlick at 7:03 p.m., on May 1, 1984. COUNCIL MEMBERS PRESENT: Lonnie Kellogg Chuck Dickerson Marvin Carter Donald Meyers Mel Krug Rob Harris Fred Feuerbacher, III Bob Gauthier (late) COUNCIL MEMBERS ABSENT: None. INVOCATION: Invocation given by Ed Speare. MINUTES: Motion by Alderman Carter to approve the minutes of the regular meeting of ~ril 17, 1984, as pre~ented, seconded by Alderman Feuerbacher. Carried. CORRESPONDENCE: Received a copy of a letter from Cai Cumin to Leslie H. Zuck regarding the final piat for the addition to Sunhaven Mobile Home Park. Received a copy of a memo to Les & ~ohn Zuck from Larry S. Peterson re- garding final review of plans for the addition to Sunhaven Mobile Home Park. Received notification from the State of Montana, Department of Highways, regarding the Gas Tax allocation for next fiscal year. Received an application for annexation of property in Murray Heights Subdivision, Second Filing. Motion by Alderman Krug to refer the appiication for annexation to the City-County Planning 'Board, seconded by Alderman Dickerson. Motion carried 7--0. CLAIMS: Statement of Items Released for Payment for the month of April was presented for review and approval. The claims were reviewed by the Budget/ Finance Committee and recommended that they be paid. Motion by Alderman Kellogg to approve the claims for the month of April, seconded by Alderman Carter. Motion carried 7--0. Alderman Gauthier arrived for the Council meeting at this time. WASTEWATER TREATMENT PLANT CONSTRUCTION PROGRESS: J.im Kaercher, HKM Associates, presented a series of slides on the progress of the wastewater treatment plant construction. Also, he presented a written report. Approximately 23.4% of the project has been completed and construction is currently on schedule. EPA GRANT AMENDMENT NO. 2 ON WASTEWATER ~REATMENT PLANT: Jim Kaercher reported on the decrease in the grant from $'3,794,970 to ~3]~08,095, a decrease of four or five hundred thousand dollars. Motion by Alderman Feuerbacher that before the Mayor signs it, that the State show us that we can go back to them if needed and the funds will be available, seconded by Alderman Meyers. Motion carried 8--0. Jim Kaercher will contact Craig Brawner. Mayor announced that Jim Straw, one of our County Commissioners, is in the audience tonight. LES ZUCK - FINAL FLAT OF SUNHAVEN TRAILER COURT ADDITION: Cai Cumin stated that he and Larry Peterson had reviewed the plat last week. Also discussed Improvements Agreement. The following resolution was presented at this time. page 2 Minutes of the City Council of Laurel RESOLUTION NO. 2067 APPROVING BLOCK 5, NUTTING BROS. SUBDIVISION SUNNAVEN TRAILER COURT EXPANSION AS AN ADDITION TO THE CITY OF LAUREL, YELLOWSTONE COUNTY, MONTANA. Motion by Alderman Carter that Resolution No. 2067 be passed and adopted, seconded by Alderman Dickerson. Motion carried 8--0. Darlene Kohl, Laurel Women in Business, not present. HAPPY GARDEN RESTAURANT: City Attorney, Joe Bradley, stated that a letter was presented at the last Council meeting requesting a waiver of special review. Now the attorney for Happy Garden, John L. Mohr, has applied, so that will be going before the City-County Planning Board, so the Council will not even have to consider it. FIRE PROTECTION RESOLUTIONS: The foliowing resolutions were presented in connection with agreements with Fire District #8 and the Airport Authority regarding fire protection: RESOLUTION NO. 2068 APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND CARBON COUNTY FIRE DISTRICT NO. SAID AGREEMENT RELATING TO FIRE PROTECTION. Motion by Alderman Carter that Resolution No. 2068 be passed and adopted, seconded by Alderman Harris. Motion carried 8~-0. RESOLUTION NO. 2069 APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND LAUREL AIRPORT AUTHORITY, SAID AGREEMENT RELATING TO FIRE PROTECTION. Motion by Alderman Carter that Resolution No. 2069 be passed and adopted, seconded by Alderman Krug. Motion carried 8--0. ORDINANCE NO. 771 (SECOND READING): regarding parking violations. ORDINANCE NO. 771 (second reading} ADDING SECTION 10.68.039 TO THE LAUREL MUNICIPAL CODE, PLACING LEGAL RESPONSIBILITY FOR PARKING VIOLATIONS ON VEHICLE OWNERS. Motion by Alderman Kellogg that Ordinance No. 771 (second reading} be passed and adopted, seconded by Alderman Dickerson. Discussion. Upon taking a roll call vote, all aldermen present voted, "YES." Motion carried 8--0. ORDINANCE NO. streets. (2) 772 (SECOND READING): regarding two-hour parking on certain ORDINANCE NO. 772 (second reading} AMENDING SECTION 10.68.030 OF THE LAUREL MUNICIPAL CODE TO PROVIDE FOR TWO-HOUR PARKING ON CERTAIN STREETS. Motion by Alderman Kellogg to amend the ordinance as follows: East Main Street from Idaho Avenue to Wyoming Avenue south First Street (east and west) from alley between Pennsylvania Avenue Colorado Avenue to 3rd Avenue(south). and page 3 Minutes of the City Council of Laurel Seconded by Alderman Dickerson. Motion carried 8--0. Motion by Alderman Dickerson to accept Ordinance No. 772 (second reading) as amended, seconded by Alderman Kellogg. Discussion regarding referring this ordinance to the Parking Committee, Teresa Gremmer read a requirement on off-street parking from Chapter 17.76 on parking regulations and requested the City to provide parking spots for about seven more employees. Ke~Harris., as a businessman's point of view, would like to see the bugs worked out on the two-hour parking. Peg Arnold stated her main concern over at the library is security for the employees. It would be helpful to have a designated parking spot. Maryann Vaughn~ owner of Flower Shoppe, asked if maybe they could buy a parking ticket or permit to park closer to the store. Possibiy the Parking Committee could check into a delivery permit. Parking Committee consists of Gene ~Barsness, Vern Halvorson, Gary Temple, Marvin Carter, and L. D. Collins. Add Dean Rankin and Lonnie Kellogg. Bob Ack~rman asked about the park located on Main Street, south, belonging to Burlington Northern. Has it ever been pursued further about it being a parking lot? Fred Feuerbacher III The City does not own the park. We lease it from Bur- lington Northern, and they stipulate exactly what we can and cannot do in it. Dean Rankin The City of Laurel has a definite parking problem. Feels the committee has to really look into the situation. Bob Baldner, owner of Price Pharmacy, stated he is pleased with the progress~ that has been done already on two-hour parking. He feels that if part of the parking lot was turned into two-hour parking, it would benefit the whole town. Kathy Ackerman, business owner on Main Street, is opposed to the unrestricted parking on the south side of Main Street. Sedley Barsness, owner of Gene's Pharmacy, complained of people that park in front of their business all day and spend most of their time in the bar. Chuck Dickerson has noticed how much easier it is to find a parking spot in Laurel now since the two-hour parking has really been enforced. Don Meyers commented about business peopSe who are parking in front of their own places for all day. These business people are the ones that have abused it and caused the problems in the first place. Kent Harris stated he does not feel the parking lot should be used exclusively for apartment tennants, employers and employees. That's exactly what is hap- pening. Gary Temple Keep a positive attitude. Don't vote the ordinance down -- table it. The Chamber and various business people have tried to keep a positive attitude on this. Lonnie Kellogg These ordinances go along hand-in-hand with the budget. I would hate to see this ordinance staved off. I'm afraid that if we stall this off, it's going to be just like it has been for the ten years that I've been in business -- on the back burner and nothing gets accomplished. Rob Harris feels that the committee really needs to check into this further. Maybe if we set a time limit on the committee (perhaps by next Council meeting) so it doesn't stay on the back burner. We've had two-hour parking on these almost same streets, with the exception of the south side of Main for how many years? What's the problem with the two-hour parking out here? Mayor Ehrlick I think we should get the input from the downtown businessmen. That's the problem I think. Gary Temple We were a little unclear as far as the outlining description of the parking area. The only objection that we could see was the south side of Main Street from 1st Avenue up to PennsyIvania Avenue. We did not unregulate it. That was the reason for denial. Upon taking a roll call vote~ ail aldermen present voted, "NO," except Aldermen Dickerson and Kellogg, who voteO, "YES." Motion failed 6--2 on Ordinance No. 772, second reading. Motion 773 (SECOND READING): regarding, penalty for habitual parking ORDINANCE NO. 773 (second reading) ADDING SECTION 10.68.035 TO THE LAUREL MUNICIPAL CODE, PROVIDING A PENALTY FOR HABITUAL PARKING VIOLATIONS Motion by Alderman Kellogg that Ordinance No. 773 (second reading) be passed and adopted, seconded by Alderman Dickerson. Discussion. Darrell L. McGillen, owner of Palace Bar & Lanes, spoke on behalf of his patrons. If people bowling during the day league, it usually takes three hours to bowl one shift. Are these people going to be considered habitual offenders? This is a unique problem for me. Fred Feuerbacher III stated that this is Something the Parking Committee should look in to. Sedley Barsness stated that a lot of cars are parked on the street and they aren't bowling, they are in the bar drinking. Maybe the Parking Committee could check into this also, Upon taking a roll call vote, all aldermen present voted,"YES," except Alderman Harris who voted, "NO." Motion carried 7--1. ORDINANCE NO. 774 (SECOND READING): $5.00 minimum penalty and a $500.00 maximum penalty for parking violations. ORDINANCE NO. 774 (second reading) AMENDING SECTION 10.68.040 OF THE LAUREL MUNICIPAL CODE, PROVIDING A $5.00 MINIMUM PENALTY AND A $500.00 MAXIMUM PENALTY FOR PARKING VIOLATIONS. Motion by Alderman Carter that Ordinance No. 774 (second reading) be page 5 Minutes Of the City Council of Laurel passed and adopted, seconded by Alderman Dickerson. Discussion. Upon taking a roll call vote, all aldermen present voted, "YES," except Alderman Meyers, who voted, "NO." Motion carried 7--1. WATER SYSTEM ANALYSIS: Larry Peterson made a presentation regarding a computer model of a water system master plan to assist in planning when developers are requesting to bring property into the City of Laurel. Discussion. Bob Gauthier will review the programs and systems with HKM and Morrison- Maierle. ORDINANCE NO. 775: regarding installation of water meters ORDINANCE NO. 775 {first reading) AMENDING SECTION 13.04.080, INSTALLATION, OF THE LAUREL MUNICIPAL CODE. Motion by Alderman Kellogg that Ord'inance No. 775 {first reading) be passed and adopted, seconded by Alderman Meyers. Upon taking a roll call vote, all aidermen present voted, "YES." Motisn carried 8--0. COMMITTEE REPORTS: Park Committee minutes of April 24, 1984, were presented and reviewed. Motion by Alderman Feuerbacher to hire Don Nelson as caretaker at River- side Park, seconded by Alderman Meyers~ Motion carried 8--0. Motion by Alderman Meyers to permit the Little Girls Softball Organization to use City land located at Alder Avenue and 7th Street for a parking lot pro- viding they maintain it, seconded by Alderman Dickerson. Motion by Alderman Meyers to grant City licenses to T & M Sewing Service, L & R Video, Simcox Construction and Kinder Kloset, seconded by Alderman Krug. Motion carried 8--0. Investment Committee minutes of April 30, 1984, were presented and reviewed. Motion by Alderman Gauthier to authorize expenditure for four airpacks for the fire department, seconded by Alderman Meyers. Motion carried 8--0. Airport Authority minutes of February 27, 1984, were presented and reviewed. FAP Committee minutes of April 19, 1984,.were presented and reviewed. Discussion regarding the maintenance contract with Encode Corporation. Don Meyers will do some checking regarding getting estimates for someone else to check the heating systems. Motion by Alderman Feuerbacher to permit Alan Crowe to remodel the inter- view room at the complex, seconded by Alderman Krug. Motion carried 8--0. Motion by Alderman Feuerbach~r to enter into the reeord the FAP Committee minutes of April 19, 198~', seconded by Alderman Krug. Motion carried 8--0. Public Health & Garbage Committee minutes of April 23, 1984, were presented and reviewed. The warrant that was made out to Ruben Batt in the amount of $42.00 in December is not to be refunded. The warrant is to be ~oided. Motion by Aiderman Meyers to leave garbage in truck overnight with garbage packed tight in truck, seconded by Alderman Krug. Motion was defeated. Motion by Alderman Meyers to enter into the record the Public Health and Garbage Committee minutes of April 23, 1984, seconded by Alderman Krug. Motion carried 8--0. Ambulance Committee minutes of April 24, 1984, were presented and reviewed. Discussion regarding the selling of ~he ambulance service. A meeting will be set up between the Attorney, Aiden Petersen, the client interested in pur- chasing the ambulance service, the Ambulance Committee, and the Mayor, Council and City Attorney. They wiI1 be notified of the time and place. Motion by Alderman Kellogg to accept and enter into the record the Ambulance Committee minutes of April 24, 1984, seconded by Alderman Dickerson. Motion carried 8--0. Fire Committee minutes of April 2, 1984, were presented and reviewed. Motion by Alderman Carter to enter into the record the Fire Committee minutes of April' 2, I984, seconded by Alderman Krug. Motion carried 8--0. Don Meyers asked permission to leave the State. Motion by Alderman Feuerbacher to grant Don Meyers permission to leave the State, seconded by Alderman Harris. Motion carried. Alderman Kellogg withdrew his motion to grant Gene Amestoy a City license, and Alderman Meyers withdrew his second. Motion by Alderman Dickerson to accept the Planning Board's recommendation to grant a home occupation to Gene Amestoy. Motion carried 8--0. CITY CLERK - PERSONNEL POLICY MANUAL: Motion by Alderman Meyers to give Don ~--~m~-~u-~ho---~-~-~ p~ on developing a personnel policy manual, seconded by Alderman Dickerson. Motion carried 8--0. DAVE MICHAEL reported on garbage truck problems. Everything is on schedule again.
