HomeMy WebLinkAboutCity Council Minutes 04.17.1984Minutes of the City Council of Laurel April 17, 1984 A regular meeting of the City Cou~ci~ of the City of Laurel, Montana,~was held in the Council Chambers and called to order by Mayor Albert Ehrlick at 7:05 p.m., on April 17, 1984. COUNCIL MEMBERS PRESENT: Lonnie Kellogg Donald Meyers (late) Marvin Carter Mel Krug Bob Gauthier Fred Feuerbacher, III COUNCIL MEMBERS ABSENT: Chuck Dickerson Rob Harris INVOCATION: Invocation given by Reverend Billet. MINUTES: Motion by Alderman Carter to approve the minutes of the regular meeting of April 4, 1984, as presented, seconded by Alderman Krug. Carried. CORRESPONDENCE: Received a letter from James Kraft regarding Table Top Exercise Hazardous Materials, on Thursday, April 19th. Received the minutes of the March meeting and the March Activity Report from Air Pollution Control. Received a letter from Alden Pedersen regarding the purchase of the ambulance service and that he will attend the Ambulance Committee meeting on April 24th at 5:30 p.m. Received a letter from John L. Mohr which was referred to the City Council by the City-County Planning Board regarding a Special Review for Happy Garden Restaurant. This will be placed on the May 1st agenda for further action. Received Grant Amendment No. 2 from EPA. This will be reviewed with Jim Kaercher from NKM and placed on the May 1st agenda. CITY CLERK & CITY TREASURER'S FINANCIAL STATEMENT: The City Clerk and City Treasurer's Financial Statement for the month of March, 1984, was presented for review and approval. Motion by Alderman Gauthier to accept the City Clerk and City Treasurer's Financial Statement as presented, seconded by Alderman Kellogg. Motion carried. HABITUAL PARKING OFFENDERS ORDINANCES: Parking ordinances were presented by Joe Bradley. ORDINANCE NO. 771 {first reading) ADDING SECTION 10.68.039 TO THE LAUREL MUNICIPAL CODE, PLACING LEGAL RESPONSIBILITY FOR PARKING VIOLATIONS ON VEHICLE OWNERS. Motion by Alderman Kellogg that Ordinance No. 771 (first reading) be passed and adopted, seconded by Alderman Krug. Upon taking a roll call vote, all alder- men present voted, "YES." Motion carried 5--0. ORDINANCE NO. 772 (first reading) AMENDING SECTION 10.68.030 OF THE LAUREL MUNICIPAL CODE TO PROVIDE FOR TWO-HOUR PARKING ON CERTAIN STREETS. Motion by Alderman Kellogg that Ordinance No. 772 (first reading) be passed and adopted, seconded by Alderman Gauthier. Upon taking a roll call vote, all aldermen present voted, "YES," except Alderman Feuerbacher who voted, "NO." Motion carried 4--1. page 2 Minutes of the City Council of Laurel ORDINANCE NO. 773 {first reading) ADDING SECTION 10.68.035 TO THE LAUREL MUNICIPAL CODE, PROVIDING A PENALTY FOR HABITUAL PARKING VIOLATIONS. Motion by Alderman Kellogg that Ordinance No. 773 {first reading) be passed and adopted, seconded by Alderman Krug. Upon taking a roll call vote~ all aldermen present voted, "YES." Motion carried 5--0. ORDINANCE NO. 774 (first reading) AMENDING SECTION 10.68.040 OF THE LAUREL MUNICIPAL CODE, PROVIDING A $5.00 MINIMUM PENALTY AND A $500.00 MAXIMUM PENALTY FOR PARKING VIOLATIONS. Motion.by Alderman Kellogg that Ordinance No. 774 (first reading) be passed and adopted~ seconded by Alderman Carter. Upon taking a roll call vote, all aldermen present voted, "YES." Motion carried 5--0. AGREEMENT WITH FIRST SECURITY BANK: The City Clerk presented the following resolutionm. RESOLUTION NO. 2065 A RESOLUTION AUTHORIZING AGREEMENT WITH FIRST SECURITY BANK TO PAY FOR A METAL BUILDING FOR THE LANDFILL AND CITY SHOP. Motion by Alderman Krug that Resolution No. 2065 be passed and adopted, seconded by Alderman Carter. Motion carried 4--1 with Alderman Gauthier voting, "NO." CAPITAL PROJECTS FUND: RESOLUTION NO. 2066 A RESOLUTION TO CREATE A CAPITAL PROJECTS FUND FOR THE PURPOSE OF PURCHASING A FIRE TRUCK. Motion by Alderman Carter that Resolution No. 2066 be passed and adopted, seconded by Alderman Krug. Motion carried 5--0. COMMITTEE REPORTS: License & Building Permit Committee minutes of April 5, 1984, were presented and reviewed. Motion by Alderman Carter to grant a City license to Laura Doan, Balloon Talk, as a home occupation, seconded by Alderman Krug. Motion carried 5--0. Motion by Alderman Feuerbacher to grant a City license to Wayne's Electric, seconded by Alderman Carter. Motion carried 5--0. Motion by Alderman Carter to grant the Flowers Shoppe a City license (new owners) pending fire inspection, seconded by Alderman Feuerbacher. Motion carried 5--0. Major Brands (Town Pump) was tabled until construction is completed. Motion by Alderman Kellogg to accept and enter into the record the License and Building Permit Committee minutes of April 5, 1984, seconded by Alderman Carter. Motion carried 5--0. Budget/Finance Committee minutes of April 4, 1984, were reviewed at the last Council meeting. page 3 Minutes of the City Council of Laurel Motion by Alderman Gauthier to approve and enter into the record the Budget/Finance Committee minutes of April 4, 1984, seconded by Alderman Feuerbacher. Motion carried 5--0. Budget/Finance Committee minutes of April 9, 1984, were presented and reviewed. Motion by Alderman Gauthier to enter into the record the Budget/Finance Committee minutes of April 9, 1984, seconded by Alderman Kellogg. Motion carried 5--0. Budget/Finance Committee minutes of April ii, 1984, were presented and reviewed. Next Budget/Finance Committee meeting will be April 24, 1984, at 7:30 p.m. City-County Planning Board minutes of April 12, 1984, were presented and reviewed. Motion by Alderman KellogE to enter into the record the City-County Planning Board minutes of April 12, 1984, seoonded by Alderman Carter. Discussion regarding zoning jurisdiction. No further discussign, the motion carried 5-0. Public Utilities Committee minutes of April lip 1984, were presented and reviewed. Motion by AIderman Krug that the Council instruct the Mayor to write a letter in protest for the City of Laurel to the Public Service Commission con- cerning the Montana Power rate increase, seconded by Alderman Kellogg. Motion carried 5--0. Alderman Kellogg also reported on his trip to Livingston to see their new sewer piant. Motion by Alderman Kellogg to approve and enter into the record the Public Utilities Committee minutes of April 11, 1984, seconded by Alderman Carter. Motion carried 6--0. Alderman Meyers arrived prior to the above motion. Airport Authority Committee minutes of March 16, 1984, were presented and reviewed. Motion by Alderman Meyers to enter into the reoord the Airport Authority minutes of March 16, 1984, seconded by Alderman Carter. Motion carried 6--0. Airport Authority Committee minutes of March 29, 1984, were presented and reviewed. Motion by Alderman Meyers to enter into the record the Airport Authority minutes of March 29, 1984, seconded by Alderman Carter. Motion carried 6--0. Garbage Committee will meet Monday, April 23rd at 5:00 p.m. Garbage alley.pickup will start Monday the 23rd on the east end of town. Saturday the 28th the.Women In Business would like a spot truck downtown as they plan on eleaning the alleys, etc. Don Meyers will make sure this is taken care of. Alderman Meyers reported on the metal building being purchased for the landfill and also the City shop. Marvin Carter asked that when we came to the change of ownership at the Flower Shoppe and said we needed a fire inspection on their license and building, do we do the same thing when we sell major apartment buildings? page Minutes of the City Council of Laurel Don Meyers stated that this was something that was not done in the but any past, they (the committee) are starting right now. This will be the practice for business or apartment, anything that requires a license. The City Clerk reported that Municipal Clerks of District "D" will have a meeting on May 18th at the S-Quire Restaurant in Billings. Everyone on the Council is invited to attend. Don Meyers reported on the work order systems that was started on Monday, April 16, 1984. Don feels this will work out real well. If anyone has any different ideas or changes, let Don Meyers, Larry Peterson, or Dave Michael know. Mel Krug asked about burning ditches. There are two in particular: 1) Ditch by Chip Watts' trailer court 2) Ditch between Wyoming and the High School Don Meyers said that maybe we could get a control burn from the Fire Department and, in turn, the Fire Department would have to get a permit from the Yellow- stone County Air Pollution. Don Meyers left on a fire call. Mel Krug stated that the Laurel Women in Business would like to put planters on the street corners. It was suggested that Darlene Kohl meet with Chief Crowe and Fire Chief McGillen on what will be allowed. Also that she be put on the May 1st agenda. Marvin Carter asked about the yellow line on the corner of Colorado and East Main. Chief Crowe said there should be some State regulation as to how far back you paint the yellow'line. Alan will find out the legalities and turn it over to the Street & Alley Committee before their April 25th meeting. Mel Krug brought up the situation on small garbage cans concerning Women In Business. Maybe have these ladies also come to the Garbage meeting on the 23rd of April.
