COUNCIL MEMBERS PRESENT: Lonnie Kellogg Donald Meyers Marvin Carter Rob Harris Mel Krug Bob Gauthier Bill!Brennan couNcIL MEMBERS~ABSENT: Chuc~ Dickerson NEW COUNCIL MEMBERS PRESENT: iNorman Orr Donna Kilpatrick iL. D. Collins Ervin Wood INVOCATION: Invocation given bY Reverend Wilhelm. MINUTES: Motion by Alderman MeYers to approve the minutes of the regular meeting of December 3, 1985, as presented, seconded by Alderman Brennan. Carried. i CORRESPONDENCE: Received the ~ovember minutes and Activity Report from the Air Pollution Control. , Received a copy of a claim from Williamson Fencing against Volk Construction's bond. i Received a copy of a claim fro~ Phil R. M~rrow, Inc. against Volk Construc- tion's bond. CITY CLERK AND CITY TREASURER'S FINANCIAL STATEMENT FOR THE MONTH OF NOVEMBER: The City Clerk and City Treasurer's Financial Statement for the month of November was presented for approval. Motion by Alderman Gauthier to approve the City Clerk and City Treasurer's Financial Statement, seconded by Alderman Harris. Motion carried 7--0. PIZZA HUT - SPECIAL REVIEW: This being the time and place advertised, a public hearing was held. Proponents: Bruce Harper, Attorney, appeared before the Council to urge them to approve the Special Review on Pizza Hut so they can serve beer and wine. Opponents: none Motion by Alderman Meyerslto close the public hearing, seconded by Alder- man Harris. Motion carried 7-40. Motion by Alderman Meyers to accept the Planning Board's recommendation that the Special Review be gra~ted, seconded by Alderman Harris. Motion carried 7--0. SETTING SUN SUBDIVISION - GEORGE FIGGINS: Joe Bradley stated the changeslthat the Council wanted put in this resolution from the last meeting have be~n made. There also was more discussion on waiver of annexation. Mike Dockery, Attorney for George Figgins, brought up item #7 concerning the property owners waiver of annexation. What we propose is maybe an agree- ment that before these people 6ould use any of the services that they be annexed into the City. This document would be signed bY the people and the Council and filed on public record. This is a condition that we feel can be met. Joe Bradley This will give Mr.~ Figgins 3 years with the help of his attorney to come up with a proposal tha~ we can review. Cal Cumin The reason we recommended that the wording not be changed from the usual format is because we'ire not sure of that. Discussion on whether it's a C~ty water line that runs out there or not. Georqe Fiqqins I think I can get the people to sign the one that I gave you. I don't think they will Sign a blank waiver of protest. Mike Dockery I don't think an~ document signed now can be enforceable 15 years against a completely different owner. iRESOLUTION NO. 2177 A RESOLUTION CONDITIONALLY APPROVING SETTING SUN SUBDIVISION ~S AN ADDITION TO THE CITY oF LAUREL, MONTANA. Motion by Alderman Meyers!that Resolution No. 2177 be passed and adopted, seconded by Alderman Krug. Motion by Alderman Brenna~ to amend Resolution No. 2177, paragraph #7, page2 Minutes of the City COuncil of Laurel page 2, to say that waivers of protest to annexation or other such agreement or covenant which to the satisfaction of the City will prevent adjacent un- annexed land owners from connecting to City Utility services be received from all adjacent residents and property owners to the water and sewer main to be located in Highway No. 10 right-of-way prior to approval of the final plat or the extension of the water and sewer mains, seconded by Alderman Krug. Motion carried 5--2 with Aldermen Gauthier and Kellogg voting, "NO." A vote was taken on %he original motion as amended. Motion carried 6--1 with Alderman Gauthier voting, "NO." WORKERS' COMPENSATION INSURANCE: RESOLUTION NO. 2178 AUTHORIZING PARTICIPATION IN THE WORKERS' COMPENSATION PROGRAM OF THE MONTANA LEAGUE OF CITIES AND TOWNS INSURANCE TRUST. Motion by Alderman Kellogg that Resolution No. 2178 be passed and adopted, seconded by Alderman Gauthier. Motion carried 7--0. COMMITTEE REPORTS: --City-County Planning Board minutes of December 12, 1985, were presented and reviewed. Motion by Alderman Carter to enter into the record the City-County Planning Board minutes of December 12, 1985, seconded by Alderman Krug. Motion carried 7--0. --Public Utilities Committee minutes of November 12, 1985, were presented and reviewed. Motion by Alderman Kellogg to enter into the record the Public Utilities Committee minutes of November 12, 1985, seconded by Alderman Harris. Motion carried 7--0. --Public Utilities Committee minutes of December 12, 1985, were presented and reviewed. Motion by Alderman Kellogg to enter into the record the Public Utilities Committee minutes of December 12, 1985, seconded by Alderman Harris. Motion carried 7--0. --Insurance Committee minutes of December 10, 1985, were presented and reviewed. Motion by Alderman Gauthier to enter into the record the Insurance Committee minutes of December 10, 1985, seconded by Alderman Krug. Motion carried 7--0. --General Revenue Sharing/Handicap Committee minutes of December 4, 1985, were presented and reviewed. Motion by Alderman Kellogg to authorize the churches' use of portable handicap signs, on a volunteer basis, seconded by Alderman Carter. Motion carried 7--0. Motion by Alderman Carter to enter into the record the General Revenue Sharing/Handicap Committee minutes of December 4, 1985, seconded by Alderman Krug. Motion carried 7--0. --Fire Committee minutes of November 18, 1985, were presented and reviewed. Motion by Alderman Carter to enter into the record the Fire Committee minutes of November 18, 1985, seconded by Alderman Meyers. Motion carried 7--0. COMMENTS FROM AUDIENCE:~none COMMENTS FROM ALDERMEN AND DEPARTMENT HEADS: Motion by Alderman Meyers to have a special meeting with HKM on December 23, 1985, at 5:00 p.m., to review the claim from Volk Construction and that Volk Construction be notified, seconded by Alderman Krug. Don announced that Lud Erlenbach's public retirement reception will be held on January 10, 1986, from 2:00--4:30 p.m., in the Council Chambers. Bob Gauthier stated there is an opening on the Metra Board. Dwight McKay contacted Bob and stated they would like someone from the Laurel area to apply and get on the Board. Alan Crowe stated that as of today Jack Broadhurst has completed his one- year probation period with the Police Department. page3 Minutes of the City Council of Laurel The Mayor appointed Jack Broadhurst as a permanent member of the Police Department. Motion by Alderman Meyers Go confirm the Mayor's appointment, seconded by Alderman Harris. Motion carried 7--0. Marvin Carter wished the new Council and Mayor good luck in the next four years. Dave Michael thanked the retiring Mayor and Council for their years of service and a job well done. MAYOR'S COMMENTS: Albert Ehrlick wished everyone a Merry Christmas and wished the new officers well. There being no further business to come~f~e the Council at this time, the meeting was adjourned at 8:14 p.m. Donald L.
