HomeMy WebLinkAboutCity Council Minutes 05.07.1985 Minutes of the CitY Council of Laurel May 7, 1985 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Albert Ehrlick at 7:02 p.m., on May 7, 1985. COUNCIL MEMBERS PRESENT: Lonnie Kellogg Chuck Dickerson Marvin Carter Donald Meyers Mel Krug Bob Gauthier Bili Brennan COUNCIL MEMBERS ABSENT: Rob Harris ~INVOCATION: Invocation given by Reverend Padilla. MINUTES: The City Clerk informed the Council that the motion at the April 16, 1985, Council meeting to reconsider Ordinance No. 802 did in effect pass, because it did not require 5 votes. Therefore, the minutes are corrected to reflect this and now Ordinance No. 802 may be reconsidered, and will probably come up later during this meeting. Motion by Alderman Meyers to approve the minutes of the regular meeting of April 16, 1985, as corrected, seconded by Alderman Brennan. Carried. CORRESPONDENCE: Received the Legislative Bulletin from the Montana League of Cities and Towns. Received the membership dues notice from Montana League of Cities and Towns. Received a memo from Montana League of Cities and Towns regarding the District #1l meeting to be held at the Parmly Library in Billings on May 21st at 2:00 Received a copy of a letter addressed to the claims representative of Firemen's Fund Insurance Company from Clifford Schleusner, Attorney at Law, regarding a claim against Hammer Painting at the Wastewater Treatment Plant. Received a synopsis of the Council meeting April Brd and 4th of the Northwest Planning Council. Received a summary from Sharon Herman regarding the Clerk's Institute that she attended in Bozeman. Received a letter addressed to the Mayor from the Laurel Chamber of Commeroe thanking the City Crew for helping out with cleanup of the downtown area. Received a letter addressed to Jim Flisrand from Yellowstone County Air Pollution Control Board regarding Pine Grove Subdivision. This will be coming up later in the public hearing. CLAIMS: Claims for the month of April, 1985, were reviewed by the Budget/ Finance Committee. Motion by Alderman Gauthier to pay the claims for the month of April, seconded by Alderman Dickerson. Motion carried 7--0. JIM KAERCHER, HKM - PROGRESS REPORT ON WASTEWATER TREATMENT PLANT: Jim presented a written and oral report on the Wastewater Treatment Plant. The construction is approximately 88% complete. Also received a copy of a letter to the Mayor from HKM regarding additional services by the engineer at the Laurel Wastewater Treatment Plant. Don Meyers asked what the inspection fee will be per day. Jim Kaercher Ken Bowersox cost or wages for time is 2.5% markup. It's all spelled out in the original agreement. It will vary. Some days he will be down there fulltime and some days he won't. It will be tapering off. A full days inspection is worth about SB00. There's items that are involved in our contract and items involved with the cost exten- sion would be field inspections, contract administration, that would be informing the Council, writing letters, meeting with the contractor~ on top of the field inspection. Items that would not fall into that.category would consist of material testing, plant start up - that's not covered~ operator training which we're involved in - O & M manual~ we've gone through and mailed to the State, we will be upgrading that over the next year, and that's not included, continue operation assistance, that's not included, and then project closeout. So under the original contract agreement the only things that we would state at this time would be extra costs for field inspection, contract administration. Motion by Alderman Kellogg to give the Mayor and the City Clerk authorization to sign the additional services agreement, seconded by Alderman Meyers. JIM KAERCNER PICKETING: The contractor has asked for the City's involvement page 2 MinUtes of the City Council of Laurel Joe Bradley stated he didn't think the City should decide tonighton who~ the attorney is for the contractor. I'll have to talk to him and see exactly what they want. Discussion regarding the painting at the Wastewater Treatment Plant~ First of all, I think the claim is only for approximately $5,000, was a sub to a sub of Volk, and Hammett of Great Falls which was a sub of Volk went bankrupt, and it wasn't because of this job. STEVE MC MULLENi FISHy WILDLIFE & PARKS - SOUTH POND: Steve stated the reason they got involved was because a person who had been ice fishing was chased off by a policeman. We get a lot of requests from people in Laurel and Billings that want to fish close to town. The Laurel Pond, Lake Elmo and Lake Josephine in Billings each have the potential.. We urge the Council to reconsider the ordinance prohibiting the use of boats and ice fishing on the ponds. That is why I "quoted" you a section from the Rules of Montana that is pretty clearly stated. There is no liability on the City should anyone be hurt out there. The only way the City can be liable if somebody is hurt.out there is if they are negligent in some way. I'm not aware of any cases around the State of Montana where somebody has fallen through the ice and has sued the landowner. I under- stand there is quite.a bit of. concern on the part of the City about the possi- bility of swimming out there, because of the weed problem in the lake. But as far as ice fishing or.using boats say without motors, we:would really like to see it. It would greatly expand the recreational opportunities to the folks here in the City. Don Meyers stated if they ailow boats on there people are going to start swim- ming right away. Steve McMullen I see no problem if you want to prohibit swimming. It shouldn't be too difficult to have a sign put up there saying what is permissible and what isn't. Joe Bradley asked Steve if the State posts signs or do they have an age limit or require adults with kids. Do you have rules like that? Steve McMullen I'm not aware of any rules like that. Maybe one way to address that is to set a season for ice-fishing, say from the 1st of January through the end of March. Joe Bradley Would your department have any objections say to requiring adult supervision? Steve McMullen No. I don't think so. If you are looking for some help regard- ing rules and regulations, maybe you could get together with Jerry Walker, Manager, at Lake Elmo. Ordinance No. 802 was not considered at this time because it was referred to the Parks Committee for further consideration and they will contact Jerry Walker, Manager, at Lake Elmo. SUE DALY~ PARKS DIVISION~ DEPARTMENT OF FISHy WILDLIFE & PARKS - THOMPSON PARK: Sue is from Parks Division Office out of Helena and she works with the Federal Grants program which provides matching funds for local community parks. I understand that you're interested in improving some ball fields. We would like to help you out if we could. Joe Bradley You say help, do you mean money? Sue Daly Right. It's a 50/50 matching. The town would have to come up with ~ of the project cost and this program would match the other 50%. Bob Gauthier asked if she could explain what projects do qualify. Sue Daly Any outdoor recreation qualifies. Ballfields, golf courses, swimming pools, if it's outdoor recreation it will probably qualify. Our time frame is a November 1 deadline each year to submit the application. Then we usually get our allocation from Congress the first part of the year, so in early March you would know whether your project had been successful to receive funding. Then you would get that money for that construction season, so you would be ready to go like next summer if you got an application in by November 1st of this year. I brought some material with me. What you would have to do is secure your share of the funding. P~ ~gether a proposal - what you plan to do, cost estimate, you would need to get what is called an "Environmental Assessment" of the land that would be involved, and there's samples in this packet that I have. It would require a little research work, planners are usually the people that pull together for communities. We would evaluate them and rank them according to criteria. Joe Bradley Is there a lot of competition for this money? Do you have more requests than you have money? Sue Daly A lot more. This year we had 40 requests and funded 11. There is a big demand for it. Joe Bradley We had to get this ballfield ready for the current season. How about money that we've already spent to improve, can we use Zhat? Sue Daly No. It would have to be a new project monies and you couldn't spend page3 Minutes of the City Council of LaUrel sponsor the project. The land must be in ownership of the sponsor. Don Meyers If we would receive notice that we are eligible, what would the time limit be? We would have to go out for bid because it exceeds $10,000. Sue Daly You have 2 construction seasons.~ Bay if you were successful this March you would have through December of 1986 to finish your project. There is leeway for a one-year extension with the Feds after that, but you have to have good justification. There's a maximum of three years~ but otherwise you get two construction seasons. Don Meyer~ I understand that force labor is no longer eligible for matching funds. Sue Daly Right. The only donated things that are matchable is land or cash. Labor and equipment isn't any more. Marvin Carter What's the greatest amount you've awarded? Sue Daly We have a ceiling of $50,000. We did award about 3 or 4 of them ceiling, that's $50,000 Federal so that would allow for a $100,000 project. Bob Gauthier If you receive one grant, is there a time period before you can apply for another one? Sue Daly No, our planner comes up with a needs assessment. He takes the sponsor and he would determine your population according to your last census and then he has a recreational survey that tells him how many facilities you already have. Then he also takes the number of dollars we receive through the program already, and he determines the points there. I think Laurel has had B different projects prior to this. That does come into the evaluation process. But otherwise you could apply every single year. ETHMER MORRISON~ PRESIDENT OF LAUREL SENIOR CITIZEN CENTER: Ethmer reported on the use of the $2,500 of Revenue Sharing money. Ethmer explained the money received from 1979, 80 and 81, a total of $7,000, was used to pay the debt on Senior Citizen Center. Money received in 1982, 83 and 84 which was $2,500 per year was deposited in a Savings Account to be used for further building expansion and maintenance. We are expecting to have to use the money in the future to live on. PUBLIC HEARING - WILLIAM J. BERNHARDT ZONE CHANGE TO RESIDENTIAL MOBILE HOME (RMH} PINE GROVE SUBDIVISION: This being the time and place advertised, a public hearing was held. Steve Duganz expiained his letter of April 12, 1985, that he sent to Jim Flis- rand. He wanted the last paragraph deleted because the property in question is located in a different area than he originally thought. Proponents: Larry Lockrem, Developer of Pine Grove Subdivision. We are proposing a 294 unit subdivision for manufactured and modular housing. Jerry Hauf presented copies of the subdivision restrictions. Discussion followed on different items of the restrictive covenants. Jerry also brought up the fact of response time to a fire in Pine Grove Subdi- vision and mileage to there also. Bob Miller, Civil Engineer for Christian, Springs & Sielbach, explained and read some points of skirting a mobile home from the Laurel Municipal Code. The authority that governs control of that is the permit issued by the City. The City will be in effect guaranteeing that we have established this in the cove- nants. The end will be the City will control that. More discussion on covenants and the placing of 8-yr. old mobile homes on these lots. Cal Cumin stated that none of the documents you've been talking about have been submitted to the City yet. This is a zoning hearing. The issue of restrictive covenants and how you enforce them haven't even been presented to the City. That comes after they get the zoning. If they get the zoning, they go back and subm±t a preliminary plat package that has a draft of these things which we can work on. There are several ways to get to them even if you figured it out tonight you can't make it enforceable tonight because you're dealing with zoning. You don't do this through zoning. This is strictly a zoning issue here. Ail these fine points you're kicking around you're going to be doing again in more detail at that preliminary plat where they are supposed to be discussed. Bob Miller reviewed zoning. This area is within the Laurel Zoning District boundaries so it is Laurel's decision what type zoning will go on that property. It is zoned agricultural now. Traffic patterns were also discussed. Larry Lockrem stated at this time there is verbal committment for 100 lots. There can not be a written committment until there is a zone change. Ernie Davis talked about water line replacement. There is 2,640 feet of 8 inch line that ne~ds to be replaced with a minimum of 12 inch line at $20 a foot. page 4 Minutes of the City Council of LaUrel Bob Miller stated they will pay for the greater amount of that from 4,000 lineal feet of pipe connect the 10 inch pipe to the sewage treatment plant. Opponents: Dee Braswell We live east of this proposed Subdivision. Her main concern is the overcrowding of the schools aready. Lydia Sekora stated Laurel is now going to have public kindergarten and there is no room for that according to what I have read in the paper. Motion by Alderman Meyers to close the public hearing, seconded by Alderman Brennan. Motion carried 7--0. Cai Cumin stated as you know the Planning Board recommended denial of this zone change request. The biggest thing bothering the Planning Board is the cost of this subdivision. The developers have improved their position by offering to pay for more, but there is still more to be paid. It's unfair to request a subdivision such as Pine Grove to pay for all these improvements, but at the same time it's unfair to expect the City to pay for any more than they're paying for now. If you (the Council) approve the zone change, the developer will go full gear into the planning of this thing; what the City needs to look at is the Improvements Agreement. This is a very expensive project no matter how you look at it. I don't think the City can afford it. If you do decide to grant them the zoning, I would like to recommend that you grant them the zoning for a period of time, such as 2 years or 3 years and if the project never materializes it reverts back to its present situation. Connie Kellogg stated he talked to a school board member and there definitely could be a problem in the schools with overcrowding. Also on this tax base Mr. Miller stated the City's share will be $80,000 based on a $50,000 assessment or a home costing $50,000. But yet in their covenants they allow a house that's 8 years old and as low as 800 sq. feet. I'm sure that's a co~d~rgbt~_ amount less than $800. The third point I'd like to bring up, we're working on a water system analysis right now and based on a system development'fee of $300 a house we could stand to lose $90,000 or gain $90,000 if this was implemented. Motion by Alderman Carter to grant the zone change with final plat approval to be within 3 years, seconded by Alderman Krug. LES & JOHN ZUCK - FINAL PLAT, SUNHAVEN EXPANSION: Les Zuck I have submitted the final plat for Sunhaven expansion. I am short one document, the upstate aspects of the title, hoping that the City approves it on a contingency basis that I obtain an abstract from the County Attorney and have the City Attorney look it over. Cal Cumin This was approved by the Council 6--8 months ago. The stipulations that were met were dictated by the Council and have been met. As far as I'm concerned everything is in order and we have signed it off. Motion by Alderman Carter to authorize the Mayor and City Clerk to sign the plat on the condition the abstract is updated, reviewed and approved by City Attorney Joe Bradley, seconded by Alderman Brennan. Motion carried 7--0. JIM WORTHINGTON - ZONING OF CHERRY HILLS~ 2nd FILING: Mike Mace speaking on behalf of Jim Worthington. Mike stated that last June, they asked for a zone request on some lots on the south side of West Maryland Lane to build single family condominiums. At the same Council meeting that night there was also another zone change request to put in multi-family dwellings. There was quite a bit of protest against the multi-family issue, so we withdrew our request. What I would like the City Council to consider is to waive the requirement that would allow Mace one year to wait for a request to rezone the property and ask to go back to the Zoning Board and ask for the zone request now. Joe Bradley stated it's a little late to reconsider a request like that. We've got an ordinance that states once a zone change has been turned down it can't be re- submitted for a year. Now Mike said they tried to withdraw it. Unfortunately when it gets to that stage they can't withdraw it without approval of the Zoning Com- mission. We have to vote and that was never done. He's asking the Council to waive that ordinance. I'm not going to advise you to do that. Mike Mace We have some particular financing available at some good interest rates for home buyers that want to take advantage of those loans. That loan program ends December 31 of 1985. One of our concerns if we wait much longer we will run out of time. Joe Bradley When were you before the Planning Board before? Mike Mace In June of last year. The year would be up July of this year. I don't page 5 Minutes of the City Council of Laurel Cal Cumin stated the issue before you tonight is not a zoning issue, it's an ordinance issue that prohibits him from applying for a zone change until July. He wants to move up his application. When the zone change, etc., comes up there will be a public hearing. Joe Bradley You really shouldn't waive this ordinance. Really you might have grounds in this case, because as I recall you did stand up and say,"I withdraw" and the Board let you get away with it. We didn't realize at the time that he doesn't have the right to withdraw; we're supposed to vote to allow him to with- draw. We didn't do that. Motion by AldErman Carter to allow Mace Builders to submit this proposal to the City-County Planning Board, seconded by Alderman Meyers. AWARD BID ON DUMP TRUCK: Mel Krug stated the Street & Alley Committee met on April 23, 1985, and went over the two bids. The committee recommended purchasing the truck from Yellow- stone Ford Truck Sales being the lowest bidder $556.75 less than the next bid. Leonard Fichtner To address the bids, I have to correct your difference, it's only $464.75. Namely #1, our bid consisted of the 9,000 lb. front axle and also the backup light required by State law for a dump truck.. I feel for $464 as a taxpayer in Laurel, Montana, and one of the local car dealers here, the money ought to stay here locally and in our own community; #2 Yellowstone Ford Truck Sales is not locally owned. It is owned by Ford Motor Company, a factory store. As a privately owned car dealer either Chevrolet or Ford, we're competing against a factory store which, by the way, GM has none. I'm a little surprised that we only got beat by $464. Ernie Davis The Ford price of $19,366, I don't know where he gets his $464 difference. Ernie also told how he arrived at the specs for a new dump truck. Discussion on type of chassis on the dump truck and also how many counties the bids went out to. Motion by Alderman Carter to accept Fichtner Chevrolet's bid for the dump truck, seconded by Alderman Krug. George Holley~ Yellowstone Ford Truck Sales said that Yellowstone Ford Truck is not a factory store, it's a dealer development store. Discussion on price of dump truck. The mechanic for the City explained how he felt. He also said right now we do have three trucks with 7,000 lb. axle. They seem to be working OK. Statement made of how close Fichtner's bid was, how much taxes the City has received from Fichtner. Question called for on the motion. Motion by Alderman Krug to accept Yellowstone Ford's bid for a dump truck in the amount of $19,366~ seconded by Alderman Brennan. Motion carried 5--2 with Aldermen Carter and Kellogg voting "NO." PAUL PETERSON, REPORT ON USE. OF $200 IN REVENUE SHARING M.O?EY FOR THE TRANSIT RELIEF FUND: Paul explained where the money goes. In the past twelve months we have been involved in assistance of transients to the number of 215 people. We also receive funding from the annual combined Thanksgiving service and also individual contributions. Our total disbursements for the last year has been right at $!,700. CEMETERY COMMITTEE, CLAIM FOR A DAMAGED STONE: Delayed until committee reports. WATER RATES FOR COMMERCIAL STANDPIPES: Lonnie Kellogg This was referred to this m~eting from last Council meeting so as to receive a little more information. The PSC was called and the committee was concerned that if we held a public hearing and if we raised the rate on the standpipe at Locust it would affect our time table of water rate next year. The mailing was also in there, and it would cost about $600 if we mailed to everybody. The PSC said we just had to notify the one user i_~f we wanted to have a public hearing. Joe Bradley You wouldn't have to wait twelve months? RESOLUTIONS ON FIRE DISTRICTS: RESOLUTION NO. 2129 APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND FIRE DISTRICT NO. 5, SAID AGREEMENT RELATING TO FIRE PROTECTION. Motion by Alderman Carter that Resolution No. 2129 be passed and adopted, seconded by Alderman Bre'nnan. Motion carried 7--0. RESOLUTION No. 2130 A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND RURAL FIRE DISTRICT NO. 7, SAID AGREEMENT RELATING TO FIRE PROTECTION. Motion by Alderman Carter that Resolution No. 2130 be passed and adopted, seconded by Alderman Meyers. Motion carried 7--0. RESOLUTION NO. 2131 APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND CARBON COUNTY FIRE DISTRICT NO. 8, SAID AGREEMENT RELATING TO FIRE PROTECTION. Motion by Alderman Carter that Resolution No. 2131 be passed and adopted, seconded by Alderman Krug. Motion carried 7--0. RESOLUTION NO. 2132 APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND LAUREL AIRPORT AUTHORITY, SAID AGREEMENT RELATING TO FIRE PROTECTION. Motion by Alderman Carter that Resolution No. 2132 be passed and adopted, seconded by Alderman Meyers. Motion carried 7--0. ORDINANCE NO. 803 (FIRST READING): ORDINANCE NO. 803 (first reading) ADDING SECTION 15.44.021, BOARD OF APPEALS SHALL BE BOARD OF ADJUSTMENT~ TO THE LAUREL MUNICIPAL CODE. Joe Bradley in response to several complaints we've had about buildings around town that are decrepit, Jim and I went through our abatement of dangerous building codes and we found that.the Council is supposed to establish a Board of Appeals under that code to review any order that a building be torn down. We thought that might De an appropriate job for the Board of Adjustment to do. This ordinance would appoint the Board of Adjustment as the Board of Appeals. Motion by Alderman Carter that Ordinance No. 803 (first reading) ~ passed and adopted, seconded by Alderman Meyers. Upon taking a roll call vote, all aldermen present voted, "YES." Don Meyers stated John was issued a City license by the City Treasurer because he's in a commercial zone. He has been checked out and he claims to be doing his business outside. The committee recommends approval of it. Comment was made of how junky John's yard looks because of all the furniture sitting outside. Chuck Dickerson stated John is doing the sanding and stripping of the furniture in his basement, which does not have any kind of sprinklers or fire protection. They would like to present a proposal to develop a four-diamond field on the undeveloped park on West 9th Street. Mike Penne stated the girls have outgrown Nutting Park. We are looking into grant money to improve this park if the Council will approve the plans. We are also looking at a BN fund foundation grant. (The park is currently outside the City limits.) Joe Bradley said the Littie League has asked the Council to prohibit car parking in Thompson Park. Joe will draw up an ordinance to prohibit parking in the park. COMMENTS FROM AUDIENCE: Andy Loebe asked about the ditch in Pine Grove Subdivision~ if the City is going to be responsible for that ditch also. Discussion regarding cleaning of ditches. Andy also stated that Bernhardt's.ditch that runs behind Curt Riemann's place, the City spends a lot of time cleaning that ditch also. COMMENTS FROM ALDERMEN AND DEPARTMENT HEADS: Chuck Dickerson stated Don Britton, Admiral of the Boat Float, wants permission to use Riverside Park for the Boat Float on July 12, 13 and 14th. Motion by Alderman Dickerson to authorize the boat floaters to use Riverside Park and to have the Polioe Reserve patrol the area on July 14th, 1985, seconded by Alderman Meyers. Motion carried 7--0. Bill Brennan asked if there was an ordinance on putting items on the sidewalk. Discussion followed about having tractors and lawn mowers parked on the City sidewalks. Joe will speak to the individual involved.
