AN ORDINANCE PROVIDING FOR THE RECEIVING OF BIDS AND THE
LETTING OF A.CONTRACT FOR THE CONSTRUCTION OF IMPROVEV"TS IN
SPECIAL INPHOVBMT DISTRICT NO. 71*

Section 1. That at-S o'clock r .M . on Tuesday,, the 6th day

Laurel, Xont&na, the City Council of said City of Laurel will re-
ceive ¦ealed bids for the construction of iaprvvemwts in special
Improvement District No. 71,,sa14 improvements to consist ofs
The excavation of approximately Eighty Four H.uzdred ( 8400 }
linear foot of pipe trench, the laying and complete installation
of approximately Eighty Four Hundred ("00) linear feet of Fight
(8) inch vitrified newer pipe, together with the complete install-
atien of Eighteen (16) Manholes and such other accessories and
acguipmeat as may be necessary for the proper operation of the said
sewer mains, additions and improvements* in blocks five (S), four-
teen (14), fifteen (lb), six (6), thirteen (13), sixteen (16)0 three
(3}, seven (7), twelve (12), soventeen (17), two (2), sight (8)0
eleven (11), eighteen (18), one (1), nine (9)0, ten (10), and nine-
teen (18) all 1h Yellowstone Subdivision, blocks twenty-three (23)0
twenty-two (22), twenty-one(21), twenty (20), twenty-five (26),
twenty-rsix (26)0 and.tweaty-seven (27) all in East Yellowstone Sub-
divisi.on# and also parcel of land more particulakly described as
follows Beginning. at a point at the intersection of South Fourth
Street and the West Might of Way of the Northern Pacific Red Lodge.

The doing of all things found necessary and incidebtal to the afore-
sald, all of which aluall be in strict accordance with the plans and
specifications of the City Engineer; said improvements to be van-
struated and fully completed on or before the /,-*day of

SectIOU 9. That the City Coucaeail shall, and :
reserve the right to reject any or all bids.
3e4tion 3„ That the City Clerk is hereby authorized and directed
to publish notice inviting sealed bids, stating the time and place
said bids will be received by the City Council, in the Laurel Out-
look, a newspaper published and circulated in the City of 'Laurel,
in the 'regular issues thereof on the 17th and 24th days of October,
1945.
Section 4. If the ownersi.'of over bG% of the frontage of lots
&Ad lands within said District, liable to be e?ssesSed, or their agents,
fail to elect to take such wotk and enter into a written contract to
do the whole work at a price at least 5% doss than the price at which
they man* will be awarded, within 3 days after the awarding of the
contract in camplianeae with the statutes of theSteate of Montana, then
said successful bidder, shall. Immediately make and oaetcut* with the
City of Laurel, a Oontracat, in duplieaates, and in accordance with the
provisions of this Ordinance and all other ordinances., n6tiaes and
resolutions coneerning this special lsaprovo m"t District. Said con.
tract an the part of the City of Laurel, shall be aaecated in the
WING of the City of Laurel by its Mayor and attested by its City Clerk,
Section 5, That, upon the execution and delivery of said con-
tract to either the successful bidder or contracting owners, he or
they, shall give to the City of Laurel, a good and sufficient bond,
in the sum of at least 19 of the amount of the contract, to be
approvet by the mayor and City Council, conditioned to the effect
that such contractor or contracrtor& shall well, and truly perform all
the teri s and conditions and provisions of said contract, and shall
save the City of Laurel harmless fresa negligent or willful cots of
said Contractor or Contractors in performing the terms and conditions
of said contract, and in making said improvements. The condition of
said bonds shall be as follows s

Section 6. That each of said bids will be accompanied by an
us?comditiobal certified checrk# cashior's check or bid bond made pay-
able to the. City of Laurel in the sum of at least 10% of the amount
of the laid, and drawn on some responsible bank. If such bid is
aacepted sad the bidder amplies with the terms of this Ordinance
