August 5, 1986
A regular meeting of the City Council of the City of Laurel, Montana, was
held in the Council Chambers and called to order by Mayor Bob Gauthier at
7:03 p~m., on August 5, 1986.

INVOCATION: Invocation given by Reverend Biller.
MINUTES:
Motion by Alderman Dickerson to approve the minutes of the regular
meeting of July 15 and July 21, 1986. as presented, seconded by Alderman
Collins. Carried.
CORRESPONDENCE:
Received a copy of a letter written to Volk Construction from HKM Associates
regarding the punch list at the Wastewater Treatment Plant.
Received a letter from Department of Health & Environmental Sciences~ Water
Quality Bureau, regarding the Federal Sewage Works Grant.
Received a letter from Cindy and Darrell Fox regarding the water rate for
private standpipes. This was referred to the Public Utilities Committee.
Received a DNRC news release regarding grant applications and the deadline
of September 15, 1986.
Received the update and synopsis from the Northwest Power Planning Council.
Received a bill from Energy & Environmental Measurement Corporation for
engineer's inspection fee on the Asphalt Supply Co. This City is in the
process of paying their half ($612.70).
Received a newsletter from the Montana League of Cities & Towns Insurance
Trust.
Received a memo regarding the Montana League of Cities & Towns 1986 Annual
Convention to be held in Butte September 17--19.
CLAIMS:
The July claims were reviewed by the Budget/Finance Committee and recommended
that they be paid.
Motion by Alderman Harris to pay the July claims as presented, seconded
by Alderman Meyers. Motion carried 5--0.
CITY CLERK'S AND CITY TREASURER'S FINANCIAL STATEMENT:
The City Clerk's and City Treasurer's Financial Statement for the month of
June was presented.
Motion b__y_Alderman Dickerson to approve the City Clerk's and City
Treasurer's Financial Statement as presented, seconded by Alderman Meyers.
Motion carried 5--0.
PUBLIC HEARING - GARBAGE RATE INCREASE:
This being the time and place advertised, a public hearing was held.
Proponents
Jim Flisrand{ Director of Public Works, reported on the need for an increase.
Opponents
None present. No written protests were received by the City Clerk.
Motion by Alderman Meyers to close the public hearing, seconded by
Alderman Harris. Carried 5--0.
Resolutions will be presented at the August 19th Council meeting.
SID NO. 109:
Resolution No. 2216 was passed June 17, 1986; however, some construction costs
were omitted and a resolution to create was never passed.
A new resolution was Dresented to start the project over.
RESOLUTION NO. 2238
A RESOLUTION DECLARING IT TO BE THE
INTENTION OF THE COUNCIL OF THE C1TY OF
LAUREL, MONTANA, TO CREATE SPECIAL
IMPROVEMENT DISTRICT NO. 109 DESIGNATING
AND DESCRIBING THE NUMBER AND BOUNDARIES
OF SAID DISTRICT, STATING THE GENERAL
CHARACTER OF THE IMPROVEMENTS WHICH ARE
TO BE MADE THEREIN, THE APPROXIMATE
ESTIMATED COST OF SAID IMPROVEMENTS,
AND THE TIME WHEN AND THE PLACE WHERE
THE COUNCIL OF THE CITY OF LAUREL,

Motion by Alderman Dickerson that Resolution No. 2238 be passed and
adopted, seconded by Alderman Meyers. Motion carried 5--0.
TENNIS COURTS:
Bob Strand spoke for himself and on behalf of other tennis players regarding
the upkeep and maintenance of the tennis courts.
There was discussion regarding several problems as follows:
- water valves near the court should be locked up so kids can't turn the
water on and let it run on the courts
- drain gutters cluttered with grass, etc., and not draining properly
- cracks in the tennis courts and grass and weeds growing through them
- kids sunbathing on tennis courts
- gum, beer bottles, wrappers, etc., on tennis courts
- could use some new nets
- generally, the tennis courts in Laurel are in deplorable condition
Discussion.
Referred to the Park'Committee for recommendations.
COURT CLERK HOURS:
ORDINANCE NO. 890 (second reading)
AN ORDINANCE AMEND1NG ORDINANCE NO. 825
TO INSURE THE HOURS OF WORK OF THE CLERK
OF COURT AND TO ASSIGN A MUNICIPAL CODE
SECTION NUMBER TO THE ORDINANCE.
Motion by Alderman D±ckerson that Ordinance No. 890, second reading,
be passed and adopted, seconded by Alderman Meyers.
Discussion.
Motion by Alderman Meyers to amend Ordinance No. 890, item no. 7, to
a part-time position with a 30-hour work week, seconded by Alderman Harris.
Motion carried.
Question was called for on the ordinance as amendedl Upon a roll call vote,
all aldermen present voted, "YES." Motion carried 5--0. Passed first reading
as amended.
UNPAID SEWER CHARGES ON PROPERTY TAXES:
ORDINANCE NO. 888 (second reading)
ENACTING SECTION 13.08.225 TO PROVIDE FOR
THE SETTING OF SEWER RATES AND FOR ASSESSMENT
OF UNPAID SEWER CHARGES ON PROPERTY TAXES.
Motion by Alderman Dickerson that Ordinance No. 888, second reading, be
passed and adopted, seconded by Alderman Meyers. Upon taking a roll call
vote, all aldermen present voted, "YES." Motion carried 5--0.
FENCE ORDINANCES:
ORDINANCE NO. 891 (first reading)
AMENDING SECTION 17.20.225, DEFINITION OF
FENCE, OF THE LAUREL MUNICIPAL CODE.
Motion by Alderman Dickerson that Ordinance No. 891, first reading, be
passed and adopted, seconded by Alderman Meyers. Upon taking a roll call
vote, all aldermen present voted, "YES." Motion carried 5--0.
ORDINANCE NO. 892 (first reading)
AMEND1NG SECTION 17.40.010 (D), FENCES,
OF THE LAUREL MUNICIPAL CODE.
Motion by Alderman Meyers that Ordinance No. 892 (first reading) be
passed and adopted, seconded by Alderman Dickerson.
After a discussion regarding types and the height of fences; Aldermen Dickerson
and Meyers withdrew their motion and second.
Motion by Alderman Meyers to table Ordinance No. 892, first reading,
until the August 19, 1986, Council meeting, seconded by Alderman Dickerson.
Motion carried 5--0.
REFERENDUM FOR MEDICARE COVERAGE:
RESOLUTION NO. 2239
RESOLUTION REQUESTING REFERENDUM
Motion by Alderman Dickerson that Resolution No. 2239 be passed and
adopted, seconded by Alderwoman Kilpatrick. Motion carried 5--0.

TRUCK FROM THE GENERAL FUND.
Motion by Alderman Dickerson that Resolution No. 2240 be passed and
adopted, second from Alderman Harris. Motion carried 5--0.

--Airport Authority minutes of June 24, 1986, were presented and reviewed.
Motion by Alderman Meyers to enter the Airport Authority minutes of
June 24, 1986, into the record, second from Alderman Dickerson. Motion
carried 5--0.
--Airport Authority minutes of July 22, 1986, were presented and reviewed.
Motion by Alderman Dickerson to enter the Airport Authority minutes
of July 22, 1986, into the record, second from Alderman Collins. Motion
carried 5--0.
--Budqet/Finance Committee minutes of August 5, 1986, were presented and

Motion by Alderman Harris to enter the Budget/Finance Committee

and reviewed.
Motion by Alderman Meyers to enter the City Council Committee as a

Dickerson. Motion carried 5--0.
--City-County Planninq Board minutes of July 10, 1986, were presented and
reviewed.
Motion by Alderman Dickerson to enter the City-County Planning Board
minutes of July 10, 1986, into the record, second from Alderman Meyers.
Motion carried 5--0.
--Park Committee minutes of July 28, 1986, were presented and reviewed.
Motion by Alderman Meyers to renew the contract with Bob Volmer for
horse pasture rental, second from Alderman Harris. Motion carried 5--0.
Motion by Alderman Meyers to allow a request by Jerry Philhower to
use the area around the Rod & Gun Club for a picnic September 7th, second
from Alderman Dickerson. Motion carried 5--0.
Motion by Alderwoman Kilpatrick to enter the Park Committee minutes of
July 28, 1986, into the record, second from Alderman Dickerson. Motion
carried 5--0.
--Public Utilities Committee minutes of July 24, 1986, were presented and
reviewed.
Motion by Alderman Meyers to enter the Public Utilities Committee
minutes of ~uly 24, 1986, into the record, seconded by Alderman Dickerson.
Motion carried 5--0.
--Public Utilities Committee minutes of August 4, 1986, were presented and
reviewed.
Motion by Alderman Meyers that an irrigation fee only be charged for
water usage, second from Alderman Dickerson. Motion carried 5--0.
Motion by Alderman Meyers to charge Sprucegrove for water, sewer and
garbage usage for the past six months, second from Alderman Harris. Motion
carried 5--0.
Motion by Alderman Meyers to deny Alvie Edgmond sewer hookup because
he is outside the service area, second from Alderwoman Kilpatrick. Motion
carried 5--0.
Motion by Alderman Meyers that contractors who desire construction
water sign up for water service, have meter installed, and be billed for
usage, second from Alderman Dickerson. Motion carried 5--0.
Motion by Alderman Meyers to enter the Public Utilities Committee
minutes of August 4, 1986, into the record, seconded by Alderman Harris.
Motion carried 5--0.
--Street & Alley Committee minutes of July 17, 1986, were presented and
reviewed.

Motion by Alderman Dickerson to deny speed bumps'on Pine Street, second
by Alderman Meyers. Motion carried 5--0.
Motion by Alderman Dickerson to enter the Street & Alley Committee minutes
of July 17, 1986, into the record, second from Alderman Meyers. Motion
carried 5--0.
CHIP & SEAL PROGRAM:
Ernie Davis reported on the chip and seal program.
POLICE RESERVE AND AUXILIARY:
Mike Atkinson presented the names:of Dean Bacon and Cheryl Marshall for
appointment to the Police Reserve and Auxiliary.
The Mayor appointed Dean Bacon and Cheryl Marshall to the Police Reserve and
Auxiliary.
Motion by Alderman Dickerson to confirm the appointments of Dean Bacon
and Cheryl Marshall to the Police Reserve and Auxiliary, second from Alderman
Harris. Motion carried 5--0.
CUTTING OF GRASS AND WEEDS:
Jim Flisrand asked for a discussion on how to handle the cutting of noxious
weeds and grass. Discussion followed.
Motion by Alderman Meyers to hire someone,with Joe Bradley's approval,
to cut the noxious weeds and grass, second from Alderman Harris. Motion
carried 5--0.
MAYOR'S COMMENTS:
The Mayor asked the Council to reconsider the salary of the City Judge.
Motion by Alderman Dickerson to reconsider Ordinance No. 889, seconded by
Alderman Collins. Motion carried 5--0.
ORDINANCE NO. 889 (first reading)
SALARY OF THE CITY JUDGE
Motion by Alderman Dickerson that Ordinance No. 889 (first reading) be
passed and adopted, seconded by Alderman Meyers. Upon a roll call vote, all
aldermen present voted, "YES." Motion carried 5--0. Passed first reading.
The Mayor appointed Herbert Mohs as caretaker of Riverside Park.
Motion by Alderman Meyers to confirm the Mayor's appointment of Herbert
Mohs as caretaker of Riverside Park, second from Alderman Harris. Motion
carried 5--0.
PERMISSION TO LEAVE THE STATE:
Peq Kamerzel, City Treasurer, requested permission to leave the State.
Motion by Alderman Meyers to grant Peg Kamerzel permission to leave the
State, second from Alderman Harris. Motion carried 5--0.
Don Hackmann, City Clerk, requested permission to leave the State.
Motion by Alderman Harris to grant Don Hackmann permission to leave the
State, second from Alderman Meyers. Motion carried 5--0.
Alderwoman Kilpatrick requested permission to leave the State.
Motion by Alderman Harris to grant Alderwoman Kilpatrick permission to
leave the State, second from Alderman Meyers. Motion carried 5--0.
There being no further business to come 5efore the Council at this time, the
meeting was adjourned at 8:45 p.m. ~ ~ ~
