May 6, 1986
A regular meeting of the City Council of the City of Laurel, Montana, was
held in the Council Chambers and called to order by Mayor Bob Gauthier at
7:03 p.m., on May 6, 1986.

INVOCATION: Invocation given by Reverend Speare.
MINUTES: Motion by Alderman Krug to approve the minutes of the regular
meeting of April 15th and the two special meetings on April 17, 1986, as
presented, seconded by Alderman Collins. Carried.
CORRESPONDENCE:
Received a thank you card from Celia Easton for the retirement reception
given her on April 25th.
Received a letter from Mary Lou Van Buren, on behalf of her father, opposing
annexation of Joe Wetch's property, corner of 8th Avenue and Maryland Lane.
Referred to the City-County Planning Board.
Received an incident report from Mark Katsolas for damage done to his wind-
shield by the street sweeper throwing gravel.
Received a letter from the Yellowstone County Commissioners regarding Local
Option Motor Fuel Tax. Referred to Street & Alley Conu~ittee.
Received a letter from the Yellowstone County Commissioners regarding meetings
which have been set with the Board of Crime Control to present their final
report and recommendations to the Law Enforcement Committee.
Received a copy of a letter to Jim Kaercher, HKM Associates, from Kenneth
Tolliver, Attorney for Atara, Inc., regarding non-payment of claims for
work done at the Wastewater Treatment Plant.
Received a Notice of Claim from Kenneth Tolliver, Attorney for Atara, Inc.,
informing us that they have notified the bonding company and they have
filed a claim in the amount of $29,236.04 against Volk Construction's bond.
Received a letter signed by several members of the Unity Garden Club opposing
a parking lot in Firemen's Park.
Received a letter from J. Brent Twichel, President of the Laurel Chamber of
Commerce, informing the City that the Chamber is withdrawing their request
of placing a parking lot in Firemen's Park.
Received a memo from the State of Montana, Disaster and Emergency Services
Division, regarding a Chemical Emergency Preparedness Program.
Received a memo from the State of Montana, Department of Commerce, regarding
the adoption of application guidelines for the 1986 CDBG program.
Received a letter from the State of Montana, Department of Commerce (Building
Codes Bureau) regarding State Building Codes.
Received a letter from the State of Montana, Department of Commerce, Local
Government Assistance Division, regarding a workshop on the 1986 CDBG appli-
cations.
Received a memo from the Montana League of Cities and Towns regarding a
District Meeting on Monday, May 12th, 1:00 p.m., at the Parmly Library in
Billings.
Received a letter from Book Publishing Co. regarding the codification of the
City's Municipal Code.
Received a memo from HKM Associates regarding the final payment on the
Wastewater Treatment Plant.
Received a letter of agreement from HKM Associates for engineering services
on the Water Distribution Study, Task III.
Received a letter from Ruth Baker of the Library Board regarding appointments.
Rob Harris arrived at the Council meeting at this time.
Received a letter from the American Arbitration Association regarding an
advance deposit toward arbitrator's compensation in the amount of $3,600.
This is based on an estimate of 32 hours hearing and study.
Motion by Alderman Krug to approve the $3,600 deposit, seconded by
Alderman Dickerson. Motion carried 8--0.
Received a copy of a letter to Volk Construction from HKM Associates regarding
the five percent (5%) retainage on the Wastewater Treatment Plant project.

ELSIE JOHNSTON - FIREMEN'S PARK:
Elsie presented petitions with over 1400 signatures opposing the use of any
portion of Firemen's Park as a parking lot. They want it left as it is.
Louie Yovetich has done some research and wanted to emphasize that the lease
agreement for this park is between the railroad and the City -- not the
Chamber of Commerce. The lease can be cancelled by either party upon a
30-day notice.
There was an amendment to the lease in 1962 which stated that the lessee
will occupy the premises for the purposes of maintaining an information
bureau and for no other purpose. A parking lot would be for another purpose.
He felt that the City came very close in violating the agreement.
Louie would like to see the Council rescind all action taken so far.
Mr. Yovetich complimented the Mayor, Donna Kilpatrick, Don Meyers and the
Utilities Committee, Ernie Davis, Phil Curry and the crew for finishing the
6th Avenue water line. He felt that the crew did a good job and they knew
what they were doing.
Elsie commented that they did not canvas signatures from businessmen.
Motion by Alderman Meyers to leave Firemen's Park as it has been for
the past 60 years, seconded by Alderman Dickerson. Motion carried 8--0.
PUBLIC HEARING - ANNEXATION OF TRACT IA~OF CERTIFICATE OF SURVEY NO. 1894~
TRACT 1 AMENDED (FRONTS ALONG THE 800-900 BLOCKS OF 9THE STREET WEST:
This being the time and place advertised, a public hearing was held.
Proponents
Pastor Ray Willis spoke in favor of the annexation for the purpose of
building a church on this property.
Cal Cumin commented that the City-County Planning Board recommended approval.
Opponents
None present, no written protests were received.
Motion by Alderman Meyers to close the public hearing, seconded by
Alderman Dickerson. Motion carried 8--0.
ORDINANCE OF ANNEXATION NO. 879 (first reading)
EXTENDING THE BOUNDARIES OF THE CITY OF LAUREL,
MONTANA, TO INCLUDE TRACT lA OF CERTIFICATE OF
SURVEY NO. 1894, TRACT 1 AMENDED, SITUATED IN THE
S~ SE~ NE~ SECTION 8, T2S, R24E, PMM, yELLowSTONE
COUNTY, MONTANA.
Motion by Alderman Meyers that Ordinance No. 879 (first reading) be
passed and adopted, seconded by Alderman Dickerson. Upon taking a roll call
vote, all aldermen, present voted, "YES." Motion carried 8--0.
CLAIMS:
Claims for the month of April, 1986, were reviewed by the Budget/Finance
Committee and recommended that they be paid.
Motion by Alderman Harris to pay the claims for the month of April,
1986, seconded by Alderwoman Kilpatrick. Motion carried 8--0.
WASTEWATER TREATMENT PLANT 5% HOLDBACK:
Motion by Alderman Meyers to remove from the table the item of 5% holdback
to Volk Construction on the Wastewater Treatment Plant, seconded by Alderman
Harris. Motion carried 8--0. (tabled 4/15/86)
Jim Kaercher, HKM Associates presented the idea of paying Volk the 5% holdback
except for the items that are not completed, which amounts to approximately
$33,000.
Discussion regarding subcontractors.
Motion by Alderman Meyers to pay Volk Construction the holdback that is
due them which amounts to approximately $153,000, seconded by Alderman Dicker-
son. Motion carried 8--0.
Discussion regarding the items remaining on the punch list.
Motion by Alderman Meyers to direct Volk Construction to complete the
remaining work in 30 days or the City will either do it themselves or have it
done by someone else, seconded by Alderman Dickerson. Motion carried 8--0.

BOAT FLOAT:
Ray Wells is Vice-Admiral of the 1986 Boat Float and he is requesting permission
to use Riverside Park as a final landing site for the boat float on July 13th.

Motion by Alderman Meyers to permit the boat float to land in Riverside
Park on July 13th, seconded by Alderman Dickerson. Motion carried 8--0.
RESOLUTION FOR WATER RATE HEARING:
This was delayed un~il the next regular Council meeting.
Mayor Gauthier asked Jim Kaercher to have some figures available for the
System Development Fee by the next Council meeting.
The Mayor also asked the Council to review the Task III letter. A resolution
will be presented at the next Council meeting.
Alderman Meyers announced that the Publ£c Utilities Committee will meet next
Monday and they will be reviewing this.
LICENSE COMMITTEE:
There was a person in the audience who was representing Bob's Welding on
a request for a City business license. Rather than have the person wait until
the committee reports were presented, the Council took action at this time.
Motion by Alderman Meyers to grant Bob's Welding~a City business license,
seconded by Alderman Krug. Motion carried 8'-0.

This being a public hearing on second readings, there was no one present in
the audience.

D. L. McGillen commented that there are a lot of calls which the Fire Depart-
ment may assist the ambulance on, or answer a fire call out on the Interstate
who is a non-resident of the City or Fire Districts that isn't contributing
any money for fire support. This way we now can bill them for our services.
Upon taking a roll call vote, all aldermen present voted, "YES." Motion
carried 8--0.
A resolution was presented establishing rates to non-residents. D. L. McGil-
len explained the rates to the City Council.

Discussion about girls' softball at a park on West 9th Street.

for swimming lessons and that it would not be part of their 40-hour work week,

Discussion regarding a transfer site. Jim stated that he got a call from
the State and they have been getting some opposition from Mr. Phillip Fox.
Their latest decision was that they want us to upgrade our existing landfill
to the point that was requested at an earlier date: fences, landscaping, etc.,
before they will consider a transfer station. Jim will be meeting with the
State in the near future to review this matter.
