March 2, 1999
A regular meeting of the City Council of the City of Laurel, Montana, was held in the
Council Chambers and called to order by Mayor Chuck Rodgers at 7:00 p.m. on March 2, 1999.

Mayor Rodgers asked the council to observe a moment of silence in behalf of Miranda Fenner and
her family.
MINUTES:
Motion by Alderman Kroll to approve the minutes of the regular meeting of February 16,
1999, as presented, seconded by Alderman Johnson. Motion carried 8 -0.
CORRESPONDENCE:
None.
CONSENT ITEMS:
a. Claims for the month of February in the amount of $381,339.55.
b. Committee Reports.
--BudKet/Finance Committee minutes of February 16, 1999 were presented.
--City Council Committee of the Whole minutes of February 16, 1999 were presented.

The mayor asked if there was any separation oCconsent items. There was none.
Motion by Alderman O1son to approve the consent items as presented, seconded by
Alderman Standinger. Motion carried
SCHEDULED MATTERS:
a. Confmnation of Appointments.
Acting Clerk-Treasurer:
Mayor Rodgers appointed Mary Embleton as Acting Clerk-Treasurer, ef/~ctive March 1, 1999, with
a six-month probationary period.
Motion by Alderman Johnson to confirm the appointment of Mary Embleton as Acting
Clerk-Treasurer, effective March 1, 1999, with a six-month probationary period, seconded by
Alderman Staudinger. Motion carried 8-0.
Mayor Rodgers asked for suggestions to fill the Historical Preservation Board vacancy resulting
from Patrick Gubbins' resignation.
b. Ordinance No. 099-5: Ordinance amending the Laurel Municipal Code adopting the
Uniform Building Code, 1997, and repealing specific provisions of the City's code
relating to inspections and permits that are inconsistent with the Uniform Building
Codes, 1997. First Reading.

Motion by Aldem~an Orr to approve Ordinance No. 099-5, seconded by Alderman Johnson.
A roll call vote was taken on the motion to approve Ordinance No. 099-5. All eight aldermen
present voted aye. Motion carded 8-0.
The second reading and public heating will be held at the council meeting on March 16, 1999.
c. Ordinance No. 099-6: Amending Chapter 15.08 of the Laurel Municipal Code, to
adopt the Uniform Housing Code 1997 Edition. First Reading.

Temple. A roll call vote was taken on the motion to approve Ordinance No. 099-6. All eight
aldermen present voted aye. Motion carried 8-0.

Ordinance No. O99-7: Amending Chapter 15.16 of the Laurel Municipal Code, to
adopt the Cabo One and Two Family Dwelling Code 1995 Edition. First Reading.

f. Ordinance No. 099-9: Amending Chapter 15.24 of the Laurel Municipal Code, to
adopt the Model Energy Code 1993 Edition. First Reading.

Motion by Alderman Kroll to approve Ordinance No. O99-9, seconded by Alderman

aldermen present voted aye. Motion carried 8-0.

Ordinance No. O99-11: Amending Chapter 15.40 of the Laurel Municipal Code, to
adopt the Fire Code 1997 Edition. First Reading.
ORDINANCE NO. O99-11

Motion by Alderman Walton to approve Ordinance No. O99-11, seconded by Alderman
Olson. A roll call vote was taken on the motion to approve Ordinance No. O99-11. All eight
aldermen present voted aye. Motion carried 8-0.

Ordinance No. O99-12: Correction of Tables 17.16.010 and 17.16.020. First
Reading.
Ordinance No. O99-12 was withdrawn from the agenda.
UNSCHEDULED MATTERS:
John Oakes, 2317 East Maryland Lane, distributed a letter to the council. The letter outlined a
complaint that Mr. Oakes recently registered with Larry McCarm concerning the streets in the
Village Subdivision. He said that many property owners and tenants maintain their property in a
responsible manner, but others do not do so. John stated that one of the major problems is with the
landlords, many of whom are absentee landlords who do not have an on-site manager to oversee
their properties.
Bill Staudinger expressed concem about the gravel on the streets in this area. Larry McCann agreed
that the gravel problem is a citywide problem, and he emphasized that control needs to be gained in
other areas regarding trash and debris in this area of the city. He suggested researching how other
trailer parks are managed to see how they are properly maintained. Bill Staudinger said that
enforcement of the codes should help with these problems.
Joe Leckie explained that the council has recently passed the community decay ordinance, which
should help address such problems. The problem he foresees is how the investigations will be
written for purposes of enforcement. Joe explained that specific complaints must be registered so
that each individual violation can be addressed. Someone needs to be in charge of investigating each
complaint and violation and getting the information to Joe to issue the warning letter or issue the
citation. Mr. Oakes wants to hold the landlords responsible for the maintenance of the properties.
Joe explained that a higher standard cannot be placed on a landlord because he has income property
than on a normal property owner. Joe again explained that the ordinance on community decay
should be sufficient to address these problems, but the problems must be handled specifically, not in
a general manner.
Miles Walton stated that the ordinance on community decay stipulates that the Public Works
Department should investigate complaints of community decay. Miles invited Mr. Oakes to attend
the Public Works meeting scheduled for Monday, March 8th to further discuss this matter. Miles
explained that the complaints must be specific, not general. If the neighbors want the area cleaned
up and maintained, they will need to identify specific problems at specific addresses so the Public
Works Department can investigate them.
Bud Johnson reminded the council that the ordinance on community decay would go into effect
thirty days after the second reading, which was February 2, 1999.
Bill Staudinger mentioned that the area south of Western Drug needs to be cleaned up.
