HomeMy WebLinkAboutCity Council Minutes 09.15.1987Minutes of the City Council of Laurel September 15, 1987 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Bob Gauthier at 7:00 p.m., on September 15, 1987. COUNCIL MEMBERS PRESENT: Donna Kilpatrick Chuck Rodgers L. D. Collins Chuck Dickerson Donald Meyers Norman Orr COUNCIL MEMBERS ABSENT: Ervin Wood Rob Harris INVOCATION: Invocation given by Reverend Wilhelm. MINUTES: Motion by Alderman Dickerson to approve the minutes of the regular meeting of September 1, 1987, as presented, seconded by Alderman Orr. Carried. Without any objections, Item No. 4, 6, and 13 were removed from the agenda. CORRESPONDENCE: Received the August llth minutes and activity Pollution Control Board. report from the Air Received a letter from the Yellowstone County Board of Planning regarding a local review program of the 1990 Census. Received a letter from Warren E. Burger Chairman, commission on the Bicentennial of the United States Constitution regarding the establish- ment of a local commission that will participate in the Bicentennial.. City Clerk's and City Treasurer's Financial Statements for the month of August. These reports will be presented at the october 6th Council Meeting. Box 30518 Billings, Mt. 59107 John Deere 210C Loader Backhoe Bid Bond Attached $24,000.00 The bids were referred to the Cemetery Board for a recommendation at the next Council Meeting. BID OPENING - ONE TON TRUCK Jim Flisrand said the State EPA office indicated they would like additional information in their specifications. Due to Federal Money being used, there are other considerations that are not normal or standard concerning city government and the EPA requested the one ton truck be re-bid with the additional specifications in it. Herbstfest Committee The Herbstfest Committee requested use of Thompson Park for their activities. Motion by Alderman Meyers to grant the Herbstfest Committee permission to use Thompson Park, seconded by Alderman Collins. Motion carried 6--0. Neighborhood Watch Proqram Mike Atkinson reported that there are six blocks set up in Laurel under the Neighborhood Watch Program. They would like to attach their 18" X 18" signs to the city street signs. Motion by Alderman Dickerson to allow the Neighborhood Watch Program to hang their signs on the city street signs, under Jim's supervision, seconded by Alderman Orr. Motion carried 6--0. Greyhound Bus Depot Cal Cumin spoke on behalf of the Planning Board. He stated they thoroughly examined all options concerning the bus depot being located on First Avenue between Main and First Streets. They felt there was no negative impact on the downtown area and actually it seemed to have a positive influence. There are two stops during business hours and the bus is never there for more than a few minutes eve~ if it's running ahead of schedule. Cal stated the City has an ordinance which prohibits buses from parking in an area unless it's a designated bus stop. Joe Bradley suggested setting up a six month study of the depot and see if any problems arise during that time. If everything works out, the ordinance will need to be changed at that time. Keith Thompson, Laurel agent for Greyhound, stated that he has a contract with them which can be cancelled by either party with prior notice. Motion by Alderman Dickerson to set up a six month study of the Greyhound bus depot, to be reviewed in March of 1988 with no change in the existing ordinance now, seconded by Alderman Orr. Motion carried 6--0. ORDINANCE NO. 923 (first reading) AMENDING SECTION 17.32.010, LAUREL MUNICIPAL CODE, TO ALLOW CERTAIN RETAIL COMMERCIAL ACTIVITIES IN LIGHT INDUSTRIAL ZONES. Motion by Alderman Meyers that Ordinance No. 923 be passed and adopted, seconded by Alderman Dickerson. roll call vote, all aldermen present voted "Yes." (first reading) Upon taking a ORDINANCE DESIGNATING TRUCK ROUTES & LOAD LIMITS Joe asked to delay action on this ordinance until next meeting. Vacate & Abandon Portion of Plat RESOLUTION NO. 2313 NOTICE OF INTENT TO VACATE AND ABANDON CERTAIN DESCRIBED PORTIONS OF CHERRY HILL SUBDIVISION SECOND FILING, IN THE CITY OF LAUREL, AND NOTICE OF INTENT TO EXCLUDE SAID VACATED AND ABANDONED PORTIONS FROM THE MUNICIPALITY. Motion by Alderman Meyers that Resolution No. 2313 be passed and adopted, seconded by Alderman Rodgers. Cal Cumin stated that the Planning Board's recommendation was to proceed with vacation and de-annexation subject to several conditions. First, there are city services out there and the City doesn't want to exclude any land which has city water and sewer on it. Secondly, it is subject to review by the public utility companies such as telephone, power and gas. They do not have the power of denial but the City would have their input. Finally, any action would be preceded by a re-plat of Cherry Hills Subdivision Second Filing. It is their responsibility to re-plat it and go through the City's subdivision process which would include a Title Report. Therefore, Cal recommended that the Council not pass a resolution of intent on doing this until after the City has that plat in front of them for approval. Motion by Alderman Dickerson to table Resolution No. 2313, seconded by Alderman Meyers. Motion carried 6--0. COMMITTEE REPORTS: --City Council Committee of the Whole minutes of September 1, 1987 were presented. Motion by Alderman Dickerson to enter the City Council Committee of the Whole minutes of September 1, 1987, into the record, seconded by Alderman Collins. Motion carried 6--0. --City-County Planninq Board minutes of September 10, 1987, were presented. Motion by Alderman Meyers to enter the City-County Planning Board minutes of September 10, 1987, into the record, seconded by Alderman Dickerson. Motion carried 6--0. --Public Utilities Committee minutes of September 14, 1987, were presented and reviewed. Motion by Alderman Meyers to direct Joe Bradley to prepare an ordinance to establish a $25.00 fee for testing meters, seconded by Alderman Dickerson. Motion carried 6--0. Motion carried 6--0. to enter the Public Utilities Committee into the record, seconded by Alderman Comments From the Audience: Keith Thompson commented on the double parking situation in the downtown area. He stated that it's essential to allow the delivery vehicles and trucks to double park when making deliveries due to lack of alley access to many businesses. He asked for the Council's consideration on this matter when they revise the ordinance.
