September 1, 1987
A regular meeting of the City Council of the City of Laurel, Montana,
was held in the Council Chambers and called to order by Mayor Bob
Gauthier at 7:00 p.m. on September 1, 1987.

INVOCATION:
Invocation given by L. D. Collins.
MINUTES:
Motion by Alderman Dickerson to approve the minutes of the regular
meeting of August 18, 1987, as presented, seconded by Alderman Collins.
Carried.
CORRESPONDENCE:
Received a letter from Kent Harris, representing the Yellowstone Bank,
stating they are opposed to the Greyhound Bus terminal being located
on First Avenue between Main and First Streets. He states this will
create a traffic hazard and add to the congestion in the area. Mayor
referred this to the City County Planning Board.
Received a letter from "Score", a group sponsored by the U.S. Small
Business Administration. They are endorsing Fiberglass Structures
as the recipient of the Economic Development Grant.
Received a letter from Moulton, Bellingham, Long & Mather, P.C. regarding
the EPA response to their settlement request regarding the Laurel Waste-
water Treatment Plant.
Received a letter from the Federal Emergency Management Agency in
Washington D. C. They asked for information and input of the proposal
of developing a community rating system for the National Flood Insurance
Program.
Received a letter from Wright, Tolliver and Guthals, concerning the
drain ditch located on the west side of Village Subdivision. The ditch
needs maintenance and they would like to see the City initiate a
maintenance program to care for it.
Received a letter from Jim Van Arsdale, extending an invitation to
all Mayors, City Council Members, and Staff to attend the Montana League
of Cities and Towns Convention in Billings on September 16th, 17th and
18th, 1987.
Received a letter from the Montana League of Cities and Towns regarding
the upcoming Nominations at the annual conference in Billings.
Received the minutes and activity report for July from the Yellowstone
County Air Pollution Control Officer.
Received a letter from the Office of the Governor to update us on the
progress of Montana's application for the Supercollider.
Received the August newsletter from the Montana Municipal Insurance
Authority.
Notice from the Public Utilities Department that the Board of Adjustment
meeting scheduled for September 8, 1987, has been cancelled. It is
rescheduled for September 14, 1987, at 7:30 p.m.

seconded by Alderwoman Kilpatrick. Motion carried 7--0.

Motion by Alderman Dickerson to grant a City Business License to
Big Bob's All Sports Discount, seconded by Alderman Collins. Motion
carried 7--0.

Deep Reach Carpet Clean, seconded by Alderman Collins. Motion carried

FREEZER & LOCKER PROVISIONERS:
ORDINANCE No. 922 (second reading)
AMENDING SECTION 17.32.010, OF THE LAUREL MUNICIPAL
TO ALLOW FREEZER AND LOCKER PROVISIONERS AND PROCESSING
OF PREVIOUSLY SLAUGHTERED MEATS IN COMMUNITY COMMERCIAL,
HIGHWAY COMMERCIAL, LIGHT INDUSTRIAL, AND HEAVY INDUSTRIAL
ZONES.
Public hearing - no comment.
Motion by Alderman Meyers that Ordinance No. 922 (second reading)
be passed and adopted, seconded by Alderman Orr. Upon taking a roll
call vote, all aldermen present voted "Yes." Motion carried 7--0.
BLOCK GRANT APPLICATION:
RESOLUTION NO. 2312
PREVENTION OF CONFLICT OF INTEREST IN COMMUNITY
DEVELOPMENT BLOCK GRANT APPLICATION.
Motion by Alderman Dickerson that Resolution No. 2312 be passed
and adopted, seconded by Alderman Rodgers.
Rob Harris excused himself from the room when the motion was made due
to a conflict of interest.
At this point the motion was voted upon and carried 6--0.
Rob c~eback to the meeting. He stated his conflict is the fact that
the CDBG program, of which he is applying for, is directly related to
Fiberglass Structures of which he is the owner, and also to Northwest
Toppers, of which he is a partner. If he is successful in his
application, the money would be used to purchase a building and the
hiring of additional workers to expand his existing business.
Mayor Gauthier asked for public comment. There were no comments.
Motion by Alderman Dickerson that Alderman Harris be excluded
from any discussion or decisions relating to this program, seconded
by Alderwoman Kilpatrick. Motion carried 6--0 with Alderman Harris
abstaining from the vote.
COMMITTEE REPORTS:
--Budget/Finance Committee minutes of September 1, 1987 were presented
and reviewed.
Motion by Alderman Harris to accept the committee's recommendation
to purchase a used tire changer from Blue Bell Auction for $395.00,
seconded by Alderwoman Kilpatrick. Motion carried 6--0 with Alderman
Collins abstaining.

of $2,080.00, seconded by Alderman Meyers. Motion carried 7--0.
Motion by Alderman Harris to accept the committee's recommendation
to purchase 30 firemen helmets at a cost of $2,188.50, seconded by
Alderman Dickerson. Motion carried 7--0.
Motion by Alderman Harris to accept the committee's recommendation
to purchase a remote high band radio link at a cost of $700.00, seconded
by Alderman Dickerson. Motion carried 7--0.
Motion by Alderman Harris to enter the Budget/Finance Committee minutes
of September 1, 1987, into the record, seconded by Alderwoman Kilpatrick.
Motion carried 7--0.
--Board of Adjustment COmmittee minutes of August 11, 1987 were presented;
Motion by Alderman Meyers to enter the Board of Adjustment Committee
minutes of August 11, 1987, into the record, seconded by Alderman Orr.
Motion carried 7--0.
--City Council Committee of the Whole minutes of August 18, 1987, were
presented and reviewed.
Motion by Alderman Meyers to enter the City Council Committee of
the Whole minutes of August 18, 1987, into the record. Motion carried
7--0.
--License Committee minutes of August 31, 1987, were presented and reviewed.
Motion by Alderman Meyers to grant a City Business License to Laurel
Optical on September 14, 1987, on the condition that they meet the fire
inspector's recommendations to install exit signs and fire extinguishers
and to repair a wall switch and a hanging light fixture, seconded
by Alderman Orr. Motion carried 7--0.
Motion by Alderman Dickerson to grant a City Business License to
Northwest Toppers pending a fire inspection, seconded by Alderman Orr.
Motion carried 6--0 with Alderman Harris abstaining.
Motion by Alderman Dickerson to refer Don Keefe's application for a
city license to the City-County Planning Board, seconded by Alderman Collins.
Motion carried 7--0
Motion by Alderman Dickerson to grant a City Business License to
Montana Signworks, seconded by Alderman Orr. Motion carried 7--0
Motion by Alderman Dickerson to grant Brown Plumbing & Heating a City
Business License, seconded by Alderman Orr. Motion carried 7--0.
Motion by Alderman Dickerson to grant Rodreick Lumber a City Business
License, seconded by Alderman Meyers. Motion carried 7--0.
Motion by Alderman Rodgers to enter the License Committee minutes of
August 31, 1987, into the record, seconded by Alderman Meyers. Motion
carried 7--0.
--Parks Committee minutes of August 24, 1987, were presented and reviewed.
Motion by Alderwoman Kilpatrick that the pool hours be set from
1-4 p.m. for the little pool and 4-8 p.m. for the large pool once school
resumes, seconded by Alderman Meyers. Motion carried 7--0.
Motion by Alderwoman Kilpatrick to approve the repairs to the dugouts
and the concession stand in Athletic Field, seconded by Alderman Dickerson.
Upon further discussion it was decided that the structure of the building
could not withstand the weight of a metal roof. Alderwoman Kilpatrick
withdrew her motion and Alderman Dickerson withdrew his secondi

Motion by Alderman Meyers to table further action on the repairs
at Athletic Field until the next meeting, seconded by Alderman Dickerson.
Motion carried. 7--0.
Motion by Alderwoman Kilpatrick to allow the Little League
Association to repair the valve box in the Little League field under
Jim's supervision, seconded by Alderman Dickerson. Motion carried 7--0.
Motion by Alderwoman Kilpatrick to install a security light near
the concession stand in Athletic Park, with cost not to exceed $300.00,
seconded by Alderman Dickerson. Motion carried 7--0.
A dedication ceremony has been set for September 14, 1987, at 5:00 p.m.
to dedicate the memorial plaque placed in Russell Park by Junior Fink in
memory of Lois Russell.
Motion by Alderwoman Kilpatrick to enter the Parks Committee minutes
of August 24, 1987, into the record, seconded by Alderman Meyers. Motion
carried 7--0.
--Streets and Alley Committee minutes of August 20, 1987 were presented
and reviewed.
Motion by Alderman Collins to enter the Street and Alley Committee
minutes of August 20, 1987, into the record, seconded by Alderman
Dickerson. Motion carried 7--0.
Pruning Trees:
Motion by Alderman Meyers to have Donna write a letter of appreciation
to Gene Blackwell for pruning the trees in downtown Laurel, seconded
by Alderman Collins. Motion carried 7--0.
Cal Cumin stated the Laurel Economic Development Organization is moving
for ~certification in the Certified Cities Program, and this in turn
plays an important part in our Community Block Grant application.
Laurel will be visited by the State Certification Team the first week
in October. One of the requirements the Department of Commerce puts on
it's certification is to grade us on our response to a potential new
business to Laurel. Cal stressed that anyone taking such a call should
direct this person to our local Contact Team which is composed of Cal,
Kent Harris and Mel Tiensvold.
Police Committee meeting for Thursday September 3, 1987, has been
cancelled.
Moving Permits:
Jim Flisrand asked for some direction when issuing permits, especially
for house movers. Discussion followed concerning the lack of an East-West
truck route which would connect 8th and let Avenues.
Motion by Alderman Dickerson to have Joe draw up an ordinance
designating an East-West and North-South truck route, seconded by Alderman
Harris. Motion carried 7--0.
MAYOR'S COMMENTS:
Mayor Gauthier stated that the City has a real expensive problem with weeds.
We are having to cut the weeds on property where the owners are not doing
it, and this expense is then billed to the owners. Due to lack of payment
on their part, this expense then goes on the taxes and the city does
not receive payment for three years. The Mayor stated that this is
happening most often by developers or on repossessed homes which are now
in the hands of financial institutions. He stated they would rather the
City cut the weeds than to employ a private individual because the City
is cheaper.
This matter will be put on the agenda for the next Council meeting.
There being no further business to come before the Council at this time,
the meeting was adjourned at 8:50 p.m. //j~j
