August 4, 1987
A regular meeting of the City Council of the City of Laurel, Montana
was held in the Council Chambers and called to order by Mayor Bob
Gauthier at 7:04 p.m., on August 4, 1987.

INVOCATION:
Invocation given by Reverend Speare.
MINUTES:
The minutes were corrected to show that Norman Orr was present
at the July 21, 1987, Council Meeting.
Motion by Alderman Collins to approve the minutes of the regular
meeting of July 21, 1987, as corrected, seconded by Alderman Meyers.
CORRESPONDENCE:
Received a letter from the Department of Natural Resources and
Conservation about a public meeting to be held on Tuesday, August 4,
1987 regarding the selection of a final location for the Montana
Power Company, Laurel to Bridger 100-KV transmission line.
Received a letter from Montana Rail Link regarding their purchase of
BN's line between Huntley and Sandpoint, Idaho.
Received a letter from Juanita and Jerold Cantrell requesting that
65 lots be reverted to pasture land and taken back out of the City
limits. This letter was referred to the City County Planning Board.
CLAIMS:
Claims for the month of July, 1987, were reviewed by the Budget/
Finance Committee and recommended that they be paid.
Motion by Alderwoman K±lpatrick to pay the claims for July, 1987,
seconded by Alderman Collins. Motion carried 6--0.
CITY CLERK & CITY TREASURER'S FINANCIAL STATEMENT:
The City Clerk and City Treasurer's Financial Statements !four the
month of July, 1987, were presented.
Motion by Alderwoman Kilpatrick to approve the City Clerk and
City Treasurer's Financial Statement for the month of July, 1987,
seconded by Alderman Orr. Motion carried 6--0.
Freezer Locker Provisioners:
This being the time and place advertised, a public hearing was held.
The City Clerk did not receive any written protests or objections.

Proponents:
Cal Cumin stated that the purpose of the ordinance is to slightly
expand the Community Commercial Zone to allow the processing of
previously butchered meat for cutting, packing and freezing. He
said three different meat packing operations are looking at the
Yellowstone Valley for possible future development and we need to
entice them to Laurel. The new Jan's IGA building will continue
to sit vacant unless this zone is expanded.
Motion by Alderman Orr to close the public hearing, seconded
by Alderman Collins. Motion carried 6--0.

Tennis Court Activities:
ORDINANCE NO. 921 (second reading)
PROHIBITING NON-TENNIS ACTIVITIES
ON TENNIS COURTS
Public Hearing: Bob Strand spoke in favor of Ordinance No. 921.
He stated that the children who sun bathe and skate on the courts
often times refuse to move when asked to by a person wanting to play
tennis. He has also found sticky substances, candy wrappers and rocks
on the courts. The courts are due to be resurfaced and he wants to
impress on the Council the need to keep the children off the courts
and to restrict it to tennis activities only.
At this time Rob Harris arrived at the meeting. (7:20 p.m.)
Motion by Alderman Meyers ~o close the public hearing,~ seconded
by Alderman Orr. Motion carried 6--0.
Motion by Alderman Rodgers that Ordinance No. 921 (second reading)
be passed and adopted, seconded by Alderwoman Ki!patrick. Upon taking
a roll call vote all aldermen present voted, "Yes." Motion carried
7--0.
COMMITTEE REPORTS:
--Board of Adjustment Committee minutes of July 14, 1987, were presented.
Motion by Alderman Meyers to enter the Board of Adjustment
Committee minutes of July 14, 1987, into the record, seconded by Alder-
man Collins. Motion carried 7--0.
--Budget/Finance Committee minutes of July 21, 1987 were presented and
reviewed.
Motion by Alderman Harris to enter the Budget/Finance Committee
minutes of July 21, 1987, into the record, seconded by Alderwoman
Kilpatrick. Motion carried 7--0.
--Garbage Committee minutes of July 20, 1987, were presented and
reviewed.
Motion by Alderman Meyers to authorize Dennis Johnston to have
Yellowstone Valley Electric install electricity at the landfill at his
expense, seconded by Alderman Orr. Motion carried 7--0.
Motion by Alderman Meyers to enter the Garbage Committee minutes
of July 20, 1987, into the record, seconded by Alderman Orr. Motion
carried 7--0.
--Parks Committee minutes of July 25, 1987, were presented and reviewed.
Motion by Alderwoman Kilpatrick to install new playground equip-
ment at Murray Park,~ seconded by Alderman Orr. Motion carried 7--0.
Motion by Alderwoman Kilpatrick not to allow any cutting of trees
at Riverside Park, seconded by Alderman Harris. Motion carried 7--0.
Motion by Alderwoman Kilpatrick to enter the Parks Committee
minutes of July 25, 1987, into the record, seconded by Alderman Meyers.
Motion ~ar~ied 7--0.
COMMENTS FROM THE AUDIENCE:
Search and Rescue
Lloyd Shay, representing Laurel Search and Rescue, asked if it would be
possible for them to acquire some land near the proposed boat ramp to
construct a building to store their boat and equipment. At the present
time, when a call comes in, it takes from one to two hours to get the
boat in the water, and the equipment is stored by all members at their
homes. Lloyd stated that they are not in a position to build at this
time, but they would like approval so plans can be made for the future.
This request was referred to Jim Flisrand and the Park Committee.

WEEDS
Bob Diede, 1411 West Maryland, spoke concerning weeds on property
adjacent to his, and also what will become of the 65 lots that have
reverted back to Jerold Cantrell. Bob is concerned that Jerold will
pasture cattle on these lots and that he will have barb wire fence
bordering his property.
Jim Flisrand stated that the Cantrell property has had the weeds
cut but the remaining weeds are on property owned by a developer
out of Billings. This developer has indicated he was going to
get them cut but if he doesn't Jim will see it gets taken care of.
Transloadinq Facility
Cal Cumin spoke concerning the transloading facility. Yellowstone
County is suing the State Department of Commerce to stop the granting
of this facility at this time. Cal said Butte had two years to
submit an application and everyone else was given two months. He
said anyone could submit one, but it's the quality of the submittal
that counts and that quality is not possible within the two month
time frame; it would take at least six months. Cal would like the
Mayor to testify in Helena on Monday if it is requested by the
County Attorney.
Weeds
Clay Devener, 1006 Betty Ave., spoke in agreement with Bob Diede
about de-annexing the Cantrell ground. He also said he called the
City about a garbage can and the City placed it directly in front of
his house when there is a pad for it across the street. Jim will
check into the matter.
MAYOR'S COMMENTS:
Mayor Gauthier appointed Cal Cumin, Chuck Rodgers, Norman Orr and
Jim Flisrand to the Grant Committee.
Motion by Alderman Meyers to confirm the appointment of Cal
Cumin, Chuck Rodgers, Norman Orr and Jim Flisrand to the Grant
Committee, seconded by Alderman Collins. Motion carried 7--0.
Mayor Gauthier stated there will be a public hearing on the pre-
liminary budget on Wednesday, August 5th at 7:00 p.m.
The Consolidation Committee will meet Thursday at 6:00 p.m. Indications
are that about eight Council members and Department Heads will be
attending.
There will be a Special Council Meeting on August 10th at 7:00 p.m
to adopt the final budget.
Don Hackmann stated he has not received any registration forms from
anyone regarding the annual convention to be held in Billings on
September 17th and 18th. Anyone planning on attending needs to turn
in a form by August 24th.
Jim Flisrand stated the Laurel Key Club and Kiwanis groups would like
to paint house numbers on the curbs throughout town. They will be
available for questions at the August 18th Council Meeting and at
that time they would like the Council's approval to go ahead with the
project.
Ambulance Committee
Pat Metzger received a request from Aero Ambulance Service of Billings
to rent an ambulance from the City of Laurel to use as a back-up
during the fair on August 12th, 13th and 14th. Pat mentioned that
they have helped us out in the past.
Discussion regarding insurance, personne~ an agreement and about a
resolution limiting use of city equipment by city employees, on city

Motion by Alderman Meyers to authorize the Mayor to rent an ambul&nce
for 3 days to the Aero Ambulance Service of Billings, seconded by
Alderman Orr. Motion defeated 4--3.
