HomeMy WebLinkAboutCity Council Minutes 07.21.1987Minutes of the Cit Council of Laurel July 217 1987 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Bob Gauthier at 7:00 p.m., on July 21, 1987. COUNCIL MEMBERS PRESENT: COUNCIL MEMBERS ABSENT: Chuck Dickerson Chuck Rodgers L. D. Collins Ervin Wood Donna Kilpatrick Rob Harris Don Meyers INVOCATION: Invocation given by Alderman Collins. With no objection from the Council the Mayor added Item 8A to the agenda which was a resolution regarding setting up Capital Projects fund for the swimming pool. MINUTES: Motion by Alderman Dickerson to approve the minutes of the regular meeting of July 7, 1987, as presented, seconded by Alderman Collins. Carried. CORRESPONDENCE: Received the activity report and minutes of June 9, Pollution Control Board. 1987 from the Air Received the update from the Northwest Power Planning Council. Received a letter from William J. O'Connor II, regarding the consolidation study. The committee would like a certificate containing the plan of government of the existing forms of local government. They would like such a plan from the City of Laurel. Joe Bradley will send a response. Received a memo from the Montana League of Cities and Towns regarding Local Video Gambling Licenses. Received a memo from the Montana League of Cities of Towns regarding the Annual Conference to be held at the Billings Plaza Holiday Inn on September 16th - 18th. Award Bid for Street Roller: At this time the Street and Alley Committee minutes of July 16, were presented and reviewed. 1987, Motion by Alderman Collins to award the bid to Western Plain Machinery Co. for a used 1980 40 Bomag Street Roller in the amount of $27,350.00~ seconded by Alderman Dickerson. Motion carried 6--0. Motion by Alderman Collins to contact Cenex for a bid on MC products seconded by Alderman Dickerson. Motion carried 6--0. Motion by Alderman Dickers0n to enter the Street and Alley Committee minutes of July 16, 1987 into the record, seconded by Alderman Orr. Motion carried 6--0. Open Container Ordinance ORDINANCE NO. 920 AMENDED (second reading) ADDING SECTION 5.36.116, TO THE LAUREL MUNICIPAL CODE, TO ALLOW SPECIAL EXCEPTIONS TO OPEN CONTAINER ORDINANCE BY PERMIT Public Hearing - no comment. Motion by Alderman Dickerson to close the public hearing, seconded by Alderman Orr. Motion carried 6--0. Motion by Alderman Dickerson that Ordinance No. 920 Amended (second reading) be passed and adopted, seconded by Alderman Collins. Upon taking a roll call vote all aldermen present voted, "Yes." Motion carried 6--0. Tennis Court Activities: An ordinance was presented regarding the tennis courts. page 2 at the Ju!ly 21, Minutes of the City Council of Laurel 1987, council meeting. ORDINANCE NO. 921 (first reading) PROHIBITING NON-TENNIS ACTIVITIES ON CITY TENNIS COURTS. Motion by Alderman Dickerson that Ordinance No. 921 (first reading) be passed and adopted, seconded by Alderman Orr. Upon taking a roll call vote all aldermen present voted "Yes.." Motion carried 6--0. Budget Transfers: RESOLUTION NO. 2289 BEING A RESOLUTION AUTHORIZING BUDGET TRANSFERS OR REVISIONS. Motion by Alderman Dickerson that Resolution No. 2289 be passed and adopted, seconded by Alderman Collins. Motion carried 6--0. Transfer of Funds From Revolving Fund: RESOLUTION NO. 2290 A RESOLUTION TRANSFERRING CERTAIN FUNDS OF THE CITY OF LAUREL, MONTANA. Motion by Alderman Rodgers that Resolution No. 2290 be passed and adopted, seconded by Alderman Dickerson. Motion carried 6--0. Swimming Pool Capital Projects Funds: RESOLUTION NO. 2291 A RESOLUTION TO CREATE A CAPITAL PROJECTS FUND FOR THE PURPOSE OF CONSTRUCTING A SWIMMING POOL. Motion by Alderman Dickerson that Resolution No. 2291 be passed and adopted, seconded by Alderman Harris. Motion carried 6--0. 1987 - 88 Preliminary Budget: Motion by Alderwoman Kilpatrick to adopt the preliminary budget as presented, seconded by Alderman Dickerson. Motion carried 6--0. 1987 Tax Resolutions: RESOLUTION NO. 2292 RESOLUTION NO. 2292, BEING A RESOLUTION LEVYING TAXES FOR GENERAL AND SPECIFIC PURPOSES FOR THE CITY OF LAUREL, MONTANA, FOR THE FISCAL YEAR BEGINNING JULY 1, 1987. Motion by Alderman Harris that Resolution No. 2292 be passed and adopted, seconded by Alderwoman Kilpatrick. Motion carried 6--0. RESOLUTION NO. 2293 RESOLUTION NO. 2293, BEING A RESOLUTION LEVYING AND ASSESSING ALL OF THE PROPERTY EMBRACED WITHIN SPECIAL IMPROVEMENT DISTRICT LIGHT NO. 2, OF THE CITY OF LAUREL, MONTANA, WITH THE ENTIRE COST OF MAINTENANCE AND ELECTRICAL CURRENT FOR THE YEAR, 1987. Motion by Alderman Dickerson that Resolution No. 2293 be passed and adopted, seconded by Alderman Orr. Motion carried 6--0. RESOLUTION NO. 2294 RESOLUTION NO. 2294, BEING A RESOLUTION LEVYING AND ASSESSING ALL OF THE PROPERTY EMBRACED WITHIN SPECIAL IMPROVEMENT DISTRICT LIGHTING NO. 3, OF THE CITY OF LAUREL, MONTANA, WITH THE ENTIRE COST OF MAINTENANCE AND ELECTRICAL CURRENT FOR THE FISCAL YEAR BEGINNING JULY 1, 1987. page 3 Minutes of the City Council of Laurel at the July 21, 1987, council meeting. Motion by Alderman Harris that Resolution No. 2294 be passed and adopted, seconded by Alderman Dickerson. Motion carried 6--0. RESOLUTION NO. 2295 BEING A RESOLUTION LEVYING AND ASSESSING ALL OF THE PROPERTY EMBRACED WITHIN THE CITY OF LAUREL, MONTANA, FOR SNOW REMOVAL AND/OR PLOWING. Motion by Alderman Dickerson that Resolution No. 2295 be passed and adopted, seconded by Alderman Orr. Motion carried 6--0. RESOLUTION NO. 2296 RESOLUTION NO. 2296, BEING A RESOLUTION LEVYING AND ASSESSING ALL OF THE PROPERTY EMBRACED WITHIN STREET SWEEPING DISTRIST NO. 1, OF THE CITY OF LAUREL, MONTANA, FOR THE PURPOSE OF THE SWEEPING OF STREETS IN THE DOWNTOWN OR BUSINESS DISTRICT. Motion by Alderman Harris that Resolution No. 2296 be passed and adopted, seconded by Alderman Dickerson. Motion carried 6--0. RESOLUTION NO. 2297 A RESOLUTION LEVYING AND ASSESSING ALL OF THE PROPERTY EMBRACED WITHIN SPECIAL IMPROVEMENT DISTRICT NO. 4, OF THE CITY OF LAUREL, MONTANA, WITH THE COST OF SANITARY WATER AND SEWER IN LAUREL INDUSTRIAL PARK. RESOLUTION NO. 2298 A RESOLUTION LEVYING AND ASSESSING ALL OF THE PROPERTY EMBRACED WITHIN SPECIAL IMPROVEMENT DISTRICT NO. 95 OF THE CITY OF LAUREL, MONTANA, WITH THE COST OF STORM SEWER AND STREETS IN LAUREL INDUSTRIAL PARK. Motion by Alderman Dickerson that Resolution No. 2298 be passed and adopted, S~cohded by Aldeinnan Harris. Motion carried 6--0. RESOLUTION NO. 2299 RESOLUTION LEVYING AND ASSESSING ALL OF THE PROPERTY EMBRACED WITHIN SPECIAL IMPROVEMENT DISTRICT NO. 97 OF THE CITY OF LAUREL, MONTANA, WITH THE COST OF SIDE- WALKS, CURBS, GUTTERS, PAVING AND STREET SIGNS IN EAST YELLOWSTONE SUBDIVISION. Motion by Alderman Diickerson that-Resolution No.2229 be passed and adopted, seconded by Alderman Collins. Motion carried 6--0. RESOLUTION NO. 2300 A RESOLUTION LEVYING AND ASSESSING ALL OF THE PROPERTY EMBRACED WITHIN SPECIAL IMPROVEMENT DISTRICT NO. 98 OF CITY OF LAUREL, MONTANA, WITH THE COST OF CURB, GUTTER, PAVING, SIDEWALK, SANITARY SEWER AND WATER LINE IN NUTTING BROS. SUBDIVISION. Motion by Alderman Collins that Resolution No. 2300 be passed and adopted, seconded by Alderman Dickerson. Motion carried 6--0. RESOLUTION NO. 2301 A RESOLUTION LEVYING AND ASSESSING ALL OF THE PROPERTY EMBRACED WITHIN SPECIAL IMPROVEMENT DISTRICT NO. 100 OF THE CITY OF LAUREL, MONTANA, WITH THE COST OF CURB, GUTTER, PAVING, WATER & SEWER IN MOGAN SUBDIVISION. Motion by Alderman Dickerson that Resolution No. 2301 be passed and adopted, seconded by Alderwoman Kilpatrick. Motion by Alderman Collins that Resolution No. 2302 be passed and adopted, seconded by Alderman Harris. Motion carried 6--0. RESOLUTION NO. 2303 A RESOLUTION LEVYING AND ASSESSING ALL OF THE PROPERTY EMBRACED WITHIN SPECIAL IMPROVEMENT DISTRICT NO. 102 OF THE CITY OF LAUREL, MONTANA, WITH THE COST OF CURB, GUTTER, PAVING AND STREET SIGNS IN WHITFIELD SHERIDAN SUB. Motion by Alderman Dickerson that Resolution No. 2303 be passed and adopted, seconded by Alderman Collins. Motion carried 6--0. RESOLUTION NO. 2304 A RESOLUTION LEVYING AND ASSESSING ALL OF THE PROPERTY EMBRACED WITHIN SPECIAL IMPROVEMENT DISTRICT NO. 104 OF THE CITY OF LAUREL, MONTANA, WITH THE COST OF PAVING IN MURRAY HEIGHTS SUBDIVISION. Motion by Alderman Orr that that Resolution 2304 be passed and adopted, seconded by Alderman Collins. Motion carried 6--0. RESOLUTION NO. 2305 A RESOLUTION LEVYING AND ASSESSING ALL OF THE PROPERTY EMBRACED WITHIN SPECIAL IMPROVEMENT DISTRICT NO. 105 OF THE CITY OF LAUREL, MONTANA, WITH THE COST OF PAVING IN LAURMAC AND WARD SUBDIVISION. Motion by Alderman Dickerson that Resolution No. 2305 be passed and adopted, seconded by Alderwoman Kilpatrick. Motion carried 6--0. RESOLUTION NO. 2306 A RESOLUTION LEVYING AND ASSESSING ALL OF THE PROPERTY EMBRACED WITHIN SPECIAL IMPROVEMENT DISTRICT NO. 106 OF THE CITY OF LAUREL, MONTANA, WITH THE COST OF PAVING IN MTN VISTA, MALIT, WILLOW CRK, CASA LINDA, & LAURMAC SUB. Motion by Alderman Rodqers that Resolution No. 2306 be passed and adopted, seconded by Alderwoman Kilpatrick. Motion carried 6--0. RESOLUTION NO. 2307 A RESOLUTION LEVYING AND ASSESSING ALL OF THE PROPERTY EMBRACED WITHIN SPECIAL IMPROVEMENT DISTRICT NO. 108 OF THE CITY OF LAUREL, MONTANA, WITH THE COST OF PAVING AND STORM DRAINS IN MURRAY HEIGHTS. Motion by Alderwoman Kilpatrick that Resolution No. 2307 be passed and adopted, seconded by Alderman Dickerson. Motion carried 6--0. RESOLUTION NO. 2308 A RESOLUTION LEVYING AND ASSESSING ALL OF THE PROPERTY EMBRACED WITHIN SPECIAL IMPROVEMENT DISTRICT NO. 109 OF THE CITY OF LAUREL, MONTANA, WITH THE COST OF STREET PAVING, CURB & GUTTER, DRIVEWAY, SANITARY SEWER & WATER IN MURRAY HEIGHTS SUBDIVISION. Motion by Alderman Dickerson that Resolution No. 2308 be passed and adopted, seconded by Alderman Collins. Motion carried 6--0. Committee Reports: --City Council Committee ~f the Whole minutes of July 7, 1987 were presented. Motion by Alderman Dickerson to enter the City Council Committee page5 Minutes of the City Council of Laurel at the July 21, 1987, council meeting. --Park Committee minutes of July 13, 1987 were presented and reviewed. Motion by Alderwoman Kilpatrick to authorize the laying of plastic pipe for the purpose of pulling wires through for future camper hook-ups and to also extend the water line at Riverside Park in the area of the new boat ramp, seconded by Alderman Orr. Motion carried 6--0. Motion by Alderwoman Kilpatrick to enter the Park Committee minutes of July 13, 1987, into the record, seconded by Alderman Orr. Motion carried 6--0. --Public Utilities Committee minutes of July 13, 1987 were presented and reviewed. Motion by Alderman Dickerson to accept the committee's recommendation to charge Mr. Gonder a flat rate of $9.97 until an average can be esta- blished, seconded by Alderwoman Kilpatrick. Motion carried 6--0. Motion by Alderman Dickerson to accept the committee's recommendation on Harry Perrigo, not to allow an adjustment for his sewer bill and to leave the charge at $12.30, seconded by Alderman Orr. Motion carried 6--0. Motion by Alderman Dickerson to enter the Public Utilities Committee minutes of July 13, 1987, into the record, seconded by Alderman Harris. Motion carried 6--0. Comments from the Audience: Ernie Davis wanted to know when the City can go out for bid on a backhoe for the cemetery. The Mayor stated that the City will not receive the balance of the Catholic Church's perpetual care fund until February so he will decide at a later date. Chuck Dickerson spoke concerning the lack of direction signs in the intersection on 1st Avenue and Main Street when your Eastbound. Jim said the State Traffic Engineer felt there was a concern going west and they had the lanes marked but apparently' he felt the concern was not there for the eastbound lanes. Jim will contact him again. Don Hackmann stated that many times he has found windows open, doors unlocked, lights on and the air conditioner still going after office hours. He asked everyone to be responsible for checking to make sure everything is locked up and turned off when they leave. Don Hackmann, City Clerk, requested permission to leave the State August 13 through August 20. Motion by Alderman Dickerson to grant Don Hackmann permission to leave the State, seconded by Alderwoman Kilpatrick. Motion carried 6--0. Alan Crowe, Police Chief, requested permission to leave the State the second week of August. Motion by Alderman Dickerson to grant Alan Crowe permission to leave the State, seconded by Alderwoman Kilpatrick. Motion carried 6--0. Ernie Davis, Maintenance Director, requested permission to leave the State August 2, through August 9. Motion by Alderman Dickerson to grant Ernie Davis permission to leave the State, seconded by Alderwoman Kilpatrick. Motion carried 6--0. Appointment: Mayor Gauthier appointed Shane Moos as a police officer for a one year probationary period, effective September 1, 1987. Motion by Alderman Dickerson to confirm the appointment of Shane Moos as a police officer, seconded by Alderman Harris. Motion carried 6--0. 1987 - 88 Wage & Benefit Proposal for Non-Union Employees Wage increase: None Benefits: To increase the Cities health insurance participation from $90.00 to $135.00 or to allow the $45.00 to be used for another benefit program within the City. page 6 Minutes of the City Council of Laurel at the July 21, 1987, council meeting. Motion carried 6--0. The Mayor stated there will be a Consolidation Committee meeting August 6th at 6:00 p.m. in the Council Chambers. This is an informational type meeting and they would like to entertain comments from anyone who is interested. There being no further comments to come before the Council at this time, the meeting was adjourned at 7:58 p.m. Donald L.
