Dune 2, 1987
A regular meeting of the City Council of the City of Laurel, Montana,
was held in the Council Chambers and called to order by Mayor Bob
Gauthier at 7:02 p.m., on June 2, 1987.

MINUTES:

Carried.
Alderman Dickerson to approve the minutes of the regular
19, 1987, as presented, seconded by Alderman Collins.
The Mayor introduced Jim Potter, Eric Eby, and Shawn Michael, Boy Scouts
from Troop 414. They are working on a communication merit badge.
CORRESPONDENCE:
Received a letter from the Montana Department of Highways regarding
allocation of gas tax revenue for fiscal year 1988.
Received a Synopsis and Agenda from the Northwest Power Planning Council.
Received a letter from Governor Schwinden in response to a letter
written to him by Mayor Gauthier, regarding the deadline for submitting
a proposal on the transloading facility.
CLAIMS:
Claims for the month of May, 1987, were reviewed
Committee and recommended that they be paid.

by Alderwoman Kilpatrick. Motion carried 6--0.

This being the time and place advertised,

Laurel Airport Authority and comprehensive and collision on city vehi-
cles. Both vehicle and airport authority coverage were not available
through sources available to us.
Total premium for the remainder of insurance coverage requested is

Our insurance bid for the City of Laurel is as per specifications except
for the following: The Fire Department equipment has $100. deductible
instead of $1,000., the Emergency equipment located on ambulances has
$100. deductible instead of $1,000. and the garbage containers have a
$100. deductible instead of no deductible.
The annual premium for July 1, 1987 to July 1, 1988 is $42,493.00.
The bids were referred to the Insurance Committee for a recommendation

ORDINANCE N0.914 (second reading)
AMENDING SECTION 8.12.058 OF THE LAUREL MUNICIPAL
CODE IN REGARD TO DUMP FEES
Motion by Alderman Meyers that Ordinance No. 914 (second reading)
be passed and adopted, seconded by Alderman Collins. Upon taking a
roil call vote, all Alderman present voted, "YES." Motion carried 6--0.
RESOLUTION NO. 2281
ESTABLISHING DUMP FEES FOR WOOD, CONSTRUCTION OR
DEMOLITION MATERIALS, AND OTHER GARBAGE, RUBBISH
AND TRASH.
Motion by Alderman Meyers that Resolution No. 2281 be passed and
adopted, seconded by Alderman Dickerson. Motion carried 6--0.
Jim Flisrand spoke his concerns as to whether the landfill operators
will feel the ordinance has been changed substantially from what it was
when the bid was let out. Joe Bradley stated the operators were in
attendance at a garbage meeting and they had ne objection to the change,
but they did want some guidelines as far as what to charge for. Joe did
notthink this change would invalidate our contract with them.
Elective & Appointive Offices:
ORDINANCE NO. 904 (second readingL(abled 3-17-87)
AMENDING SECTION 2.04.020, ELECTIVE AND APPOINTIVE
OFFICES, OF THE LAUREL MUNICIPAL CODE.
Motion by Alderman Oickerso~ to remove from the table Ordinance
No. 904, seconded by Alderman Harris. Mo(ion carried 6--0.
Joe Bradley stated Ordinance No. 904 removes four jobs (City Engineer,
Public Utilities Director, Maintenance Director and Public Works Direc-
tor) from the list of Oe.signated City Offices. The object of this
ordinance is to allow these officials to live outside the city limits.
Motion by Alderman Oickerson that Ordinance No. 904 (second read-
ing) be passed and adopted, seconded by Alderwoman Kilpatrick. Upon
taking a roll call vote, all alderman voted, "NO," except for Alderman
Dickerson, who voted, "YES." Motion defeated 5--1.

merit, poker, and keno machine license fees, were discussed.

Curt Riemann presented to the Council a paper with his own cost projec-
tions on poker and keno machines for the 1986-87 year v.s. the 1987-88
year, due to the law change.
ORDINANCE NO. 915 (first reading)
AMENDING SECTION 5.24.040 OF THE LAUREL MUNICIPAL
CODE IN REGARD TO CITY AMUSEMENT LICENSE FEE.
Motion by Alderman Meyers that Ordinance No. 915 (first reading)
be passed and adopted, seconded by Alderman Dickerson. Upon taking a
roll call vote, all alderman present voted, "YES." Motion carried 6--0.
Joe stated that this ordinance does not include the dancing license fee.
The City Treasurer will still need to collect this fee.

License Fees for Poker~ Bingo & Keno:
ORDINANCE NO. 915 (first reading)
AMENDING SECTION 5.48.040 OF THE LAUREL MUNICIPAL
CODE IN REGARD TO CITY LICENSE FEE FOR ELECTRONIC
VIDEO DRAW POKER MACHINES AND ELECTRONIC BINGO
AND KENO MACHINES.
Motion by Alderman Meyers that Ordinance No. 916 (first reading)
be passed and adopted, seconded by Alderman Rodgers. Upon taking a
roll call vote Alderman Meyers, Dickerson, and Rodgers voted, "YES."
Alderman Collins, Harris and Alderwoman Kilpatrlck voted, "NO." Mayor
Gauthier broke the tie mlth a "YES" vote. Motlon carrled 4--3.
The City has been charging non-profit organizations a fee for bingo,
but have not required a permit from them. ODe stated there is an
Attorney General's opinion which states you can only license these
games in establishments where there is a liquor license. So now, the
City can require a permit but cannot charge a fee to non-profit orga-
nizations.
COMMITTEE REPORTS:
--Airport Authority Committee minutes of January 27, March 24, and
April 27, 1987, were presented.
Motion by Alderman Meyers to enter the Airport Authority Committee

seconded by Alderman Collins. Motion carried 6--0.

Motion by Alderman Harris to authorize the City Clerk to prepare
a resolution reducing the assessment in Light District #2 to 75% of last
year's assessment, seconded by Alderman Meyers. Motion carried 6--0.
The committee recommended the same assessments as last year for Light
District #3 and also FAP and Storm Sewer Bonds.

The Catholic Cemetery hoard has $12,517.96 in their perpetual care fund
that they will turn over to the city. It is their recommendation that
the money be used toward the purchase of a new backhoe.
Motion by Alderman Harris to give preliminary acceptance to the
Catholic Church's proposal for taking over their cemetery, and to direct
Joe Bradley to draw up a resolution, seconded by Alderman Collins.
Motion carried 6--0.
Alderman Meyers stated there are many aoctions of construction companies

which are going out of business and he thinks we would be able to pick
up a good used backhoe at a reduced cost.
Ernie Davis said he has received a budget figure of $25,000. from Case
for a new 480 Backhoe and $27,500. figure from John Deere. Both these
figures reflect the large discounts they give to government agencies.
Ernie feels the bid figures would be lower than their budget figures, so
the purchase of anem backhoe cannot be ruled out.

Don Hackmann, City Clerk, commented that the Council take a good hard
look at using the principle amount of the perpetual care fund, in light
of CI-105 and proposed CI-31. The intent mas to use the interest earned
on the principle for maintaining the cemetery.

MAYOR'S COMMENT:
July 4th Beer Sales:
Mayor Gauthier was contacted by the Chamber of Commerce.

beer on July 4th in Thompson Park, seconded by Alderman Harris
Upon further discussion, Alderman Collins withdrew his motion and Alder-
man Harris withdrew his second.
The Chamber was asked to present a plan at the June 16, 1987, Council
meeting.
Underpass Work:
Jim Flisrand commented that the state rejected the contractor's work
on the underpass and that mas the reason for the detour once again. He
mas told the murk would take three days maximum and then it would be sub-
ject to a state inspection again.
Mayor Gauthier stated that me are currently advertising for a Police
Officer and also a Clerk/Typist for the City Hall office.
Public Utilities meeting scheduled for June 8, 1987, has been cancelled
until the July meeting.
Mayor Gauthier announced that he may be out of town on the June 16, 1987,
Council meeting.
