HomeMy WebLinkAboutCity Council Minutes 05.19.1987Minutes of the City Council of Laurel May 19, 1987 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Bob Gauthier at 7:00 p.m., on May 19, 1987. COUNCIL MEMBERS PRESENT: Ervin Wood Chuck Dickerson Donne Kilpatrick Donald Meyers Chuck Rodgers Rob Harris L. D. Collins COUNCIL MEMBERS ABSENT: Norman Orr INVOCATION: Invocation given by Alderman Collins. MINUTES: Motion by meeting of May Carried. Alderman Meyers to approve the minutes of the reguler 5, 1987, as presented, seconded by Alderman Collins. CORRESPONDENCE: Received the activity report and minutes of April Yellowstone County Air Pollution Control Board. 14, 1987, from the Received a memo from the Department of Commerce, Local Government Assis- tance Division, regarding CDBG application workshop. Received a memo from the Department of Commerce, Local Government Assis- tance Division, regarding fiscal year 1988 Land Planning Fund Projection. Received a legislative bulletin from the Montana League of Cities and Towns. Received the Agenda and Synopsis from the Northwest Power Planning Court= cil. Received a letter of resignation from Pat Johnson, effective May 15, 1987. Motion by Alderman Dickerson to eccept Pat Johnson's resignation, seconded by Alderman Meyers. Motion carried 7--0. CITY CLERK & TREASURER'S FINANCIAL STATEMENT: The City Clerk and City Treasurer's Financial Stetement April, 1987, was presented. for the month of Motion by Aldermen Harris to approve the City Clerk surer's Financial Statement for the month of April, 1987, Alderwoman Kilpatrick. Motion carried 7--0. and City Trea- seconded by PUBLIO HEARIN6 TO VACATE A PORTION OF A STREET AO3AOEN~ ~0 LOTS 12 THROUGH 21, BLOCK 29~ EAST YELLOWSTONE SUBDIVISION (TOWN PUMB). This being the time and place advertised, a public hearing was held. Proponents Jim Worthington, representing Town on a map, the land they are asking Pump, explained to vacate. and showed the Council Jim then addressed a concern Jim Flisrand had about the legal rights to vacate. He stated that Mr. Charlton, Oivision Engineer for the Montana Highway Department right-of-way division in Helena, originally wrote to the Billings division stating he felt the documents were adequate. If the Billings division agreed they should so state in a letter to the Laurel City Council and that letter was received prior to the April 20th Council meeting. The application to vacate was also signed by the Billings divis- ion engineer of the Montana Highway Department. Jim Dixon of Missoula, also spoke as a proponent. He owns land which lies east of Speedy Mart on South Fourth Street and extends to the south side of Speedy Mart's building and borders First Avenue South. He is considering development of this land at a future date and may possibly need to vacate Montana Avenue on his property. In this case, he would have to go through the same process as Town Pump, and Mr. Dixon hopes he would also receive a favorable reaction from the Council at that time. Motion carried 7--0. RESOLUTION NO. 2277 RESOLUTION TO VACATE LANDS ADJACENT TO BLOCK 29, EAST YELLOWSTONE SUBDIVISION. Motion by Alderman Dickerson that Resolution No. 2277 be passed and adopted, seconded by Alderman Meyers. Motion carried 7--0. 1986--87 AUDIT PROPOSAL: a proposal was received from Mel Tiensvold, CPA, in the amount of $8,500. Motion by Alderman Meyers to accept the audit proposal from Mel Tiensvold, CPA, in the amount of $8,500., seconded by Alderman Collins. Motion carried 7--0. WATER RATE INCREASE: RESOLUTION NO. 2278 BEING A RESOLUTION SPECIFYING A PERMANENT WATER RATE TO BECOME EFFECTIVE TEN (10) DAYS AFTER BEING FILEO WITH MUNICIPAL CLERK AND REVISED RATE SCHEDULE FILED WITH THE PUBLIC SERVICE COMMISSION. Motion by Alderman Meyers that Resolution No. 2278 be passed and adopted, seconded by Alderman Dickerson. Motion carried 7--0. SEWER RATE INCREASE: RESOLUTION NO. 2279 BEING A RESOLUTION SPECIFYING A PERMANENT SEWER RATE TO BECOME EFFECTIVE TEN (10) DAYS AFTER BEING FILED WITH MUNICIPAL CLERK AND REVISED RATE SCHEDULE FILED WITH THE PUBLIC SERVICE COMMISSION. Motion by Alderman Meyers that Resolution No. 2279 be passed and adopted, seconded by Alderman Dickerson. Motion carried 7--0. GARBAGE RATE DECREASE: RESOLUTION NO. 2280 RESOLUTION OF INTENT TO ADOPT AND REVISE REFUSE COLLECTION FEES AND CALLING A PUBLIC HEARING ON THE REVISED FEES. Motion by Alderman Meyers that Resolution No. 2280 be passed and adopted, seconded by Alderman Dickerson. Motion carried 7--0. A public hearinq for the water, sewer and garbage rates will be held on June 16, 1987, at 7:00 p.m. SWIMMING POOL FEES: Discussion followed concerning the change From a family ticket to an individual pass system. Everyone would pay the same rate of 20¢ per ticket or $1.00 for a daily admittance fee. There would be no difference in ticket price between adult and child or city and county residents. Books of 25 tickets would be sold for $5.00 apiece at City Hall. There was some disagreement on whether to allow an individual back in the pool once they had left. The Park Committee will look into this matter. Motion by Alderman Dickerson to set the pool fees at $1.00 for daily admittance, $5.00 for a book of 25 tickets, and to refer back to the Park Committee the problem of allowing the individual back in the pool, sec- onded by Alderman Collins. Motion carried 7--0. LANDFILL DUMP FEES: ORDINANCE NO. 914 (first reading) AMENDING SECTION 8.12.058 OF THE LAUREL MUNICIPAL CODE IN REGARD TO DUMP FEES. page3 Minutes of the City Council of Laurel Motion by Alderman Meyers that Ordinance No. 914 (first reading) be passed and adopted, seconded by Alderman Rodgers. Upon taking a roll call vote, all alderman present voted, "YES." Motion carried Y--O. AIRPORT AUTHORITY APPOINTMENTS: Mayor Gauthier appointed Bill Brennan to the Laurel Airport Authority Board. Motion by Alderman Meyers to confirm the appointment of Bill Brennan to the Laurel Airport Authority Board, seconded by Alderman Dickerson. Motion carried 6--1, with Alderman Wood voting, "NO." LIBRARY BOARD: The Library Board stated that Gene Williams is more five-year term and that she is interested still eligible for one in serving again. Mayor Gauthier appointed Gene Williams to the Library Board. Motion by Alderwoman Kilpatrick to confirm the appointment of Gene Williams to the Laurel Library Board, seconded by Alderman Collins. Motion carried 7--0. POLICE OFFICER APPOINTMENTS: Mayor Gauthier rejected all applicants for an experienced police officer. and asked Alan Crowe to advertise COMMITTEE REPORTS: --AMBULANCE COMMITTEE minutes of May 12, 1987, were presented and reviewed. Motion by Alderman Meyers to approve the purchase of name patches for the ambulance attendants' coats, seconded by Alderman Harris. Motion carried 7--0. Motion by utes of Nay 6, Motion carried Alderman Harris to enter the Budget/Finance Committee min- I987, into the record, seconded by Alderwoman Kilpatrick. 7--0. --BUDGET/FINANCE COMMITTEE minutes of May 11, 1987, were presented and re- viewed. The City Clerk wanted some direction on the 1987 snow removal and sweep- lng assessments, so resolutions could be prepared for the public hearing on the preliminary budget to be held on August 5, 1987. Motion by Alderman Harris to authorize the City resolution reducing the snow removal assessment from per 4200 sq. ft. lot, for 1987, seconded by Alderman carried 7--0. Clerk to prepare a seven to five dollars Meyers. Motion Motion by Alderman Harris to authorize the City Clerk to prepare a resolution increasing the sweeping assessment by 50% (commercial from 50¢ to 75¢ and residential from $16.66 to 25¢ per frontage foot), seconded by Alderwoman Kilpatrick. Motion carried 5--2 with Alderman Meyers and Dickerson voting, "NO." Motion by Alderman Meyers to accept the Committee's recommendation to hold a public hearing on the use of 90-gallon and 300-gallon garbage containers in Village Subdivision on June 15, 1987, at 7:00 p.m., second- ed by Alderman Dickerson. Motion carried 7--0. Motion by Alderman Meyers to enter the Garbage Committee minutes of May 18, 1987, into the record, seconded by Alderman Dickerson. Motion carried 7--0. --UTILITIES COMMITTEE minutes of May 11, 1987, were presented and reviewed. Motion by Alderman Meyers to reject the Committee's recommendation to not adjust John Burkland's April sewer charge, but to adjust the summer sewer average, seconded by Aldermen Collins. A divis:ion of the house was called for with Aldermen Wood, Meyers and Collins voting, "YES." Alderman Dickerson, Rodgers, Harris and Alderwoman Kilpatrick all voted, "NO." Motion was defeated 4--3. Motion by Alderman Meyers to eccept the Committee's recommendationto not adjust John Burkland's April sewer charge, but to adjust the summer sewer average, seconded by Alderwoman Kilpatrick. A division of the house wes called for with all alderman present voting, "NO," except for Aider- woman Kilpatrick, who voted "YES." Motion defeated 6--1. Motion by Alderman Meyers to adjust John Burkland's summer sewer average and leave his April bill as billed, seconded by Alderman Harris. Motion carried 7--0. Motion by Alderman Meyers to accept the Committee's recommendation to not prerate the customer charge on water and sewer bills, seconded by Alderman Harris. Motion carried 7--0. Motion by Alderman Meyers to accept the Committee's recommendation to write off delinquent mater customers totaling $1,987.47, seconded by Alderwoman Kilpatrick. Motion carried 7--0. Motion by Alderman Meyers to enter the Utilities Committee minutes of May 11, 1987, into the record, seconded by Alderman Dickerson. Motion carried 7--0. page 5 Minutes of the City Council of Laurel COMMENTS FROM THE AUDIENCE: Cal Cumin stated that the Legislature appropriated 2.1 million dollars to fund a pilot project for a modular frans loading facility which is mainly a component transfer facility on the railroad. This mill be a 15 million dollar facility which will generate jobs and commerce. This was designed and developed by bhe City of Butte and et the last minute the Legislature put it out for bidding with a deadline of July 8, 1987. Yellowstone County would like to go after the bid, but would like the time frame to be extended to September 9, 1987. Cal would like the Council's approval to write a letter to the Governor, signed by Mayor Gauthier, extending the time frame. Motion by Alderman Collins to authorize Cai Cumin to draft a letter to the Governor, signed by Mayor Gauthier, asking for an extension of the deadlihe for bids on the modualr trans loading facility, seconded by Alderman Dickerson. Motion carried 7--0. POLICE RESERVE: Alan Crowe stated the Police Reserve would like of Michelle Steffans to the Police Reserve. to make the appointment Mayor Gauthier appointed Michelle Steffans to the Police Reserve. Motion by Alderman Dickerson to confirm the appointment of Michelle Steffans to the Police Reserve, seconded by Alderman~Meyers. Motion carried 7--0. Chuck Oickerson asked Joe about the jurisdiction of having appointed of- ficials live within the city. Joe stated the city would have no problem making emergency personnel and department heads who need to be on call, live within the city. Motion by Alderman Oickerson to put Ordinances #904 and #905 on the June 2nd agenda, seconded by Alderwoman Kilpatrick. Motion carried 7--0. MAYOR'S COMMENTS: A department head meeting is scheduled for ..May 26, 1987, at 7:00 a.m. Mayor Gauthier declared May 22, 1987, as poppy day in Laurel. Motion by Alderman Meyers to confirm that May 22, 1987, be declared poppy day, seconded by Alderman Dickerson. Motion carried 7--0. License Committee meeting on May 20, 1987, ak 5:30 p.m. May 25th is a holiday for city employees.
