HomeMy WebLinkAboutCity Council Minutes 05.05.1987Minutes of the City Council of Laurel May 5, 1987 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Bob Gauthier at 7:00 p.m., on May 5, 1987. COUNCIL MEMBERS PRESENT: Ervin Wood Chuck Dickerson Donna Kilpatrick Donald Meyers Chuck Rodgers Rob Harris L. D. Collins Norman Orr COUNCIL MEMBERS ABSENT: none INVOCATION: Invocation given by Alderman Collins. MINUTES: Motion by Alderman Dickerson to approve the minutes of the regular meeting of April 21, 1987, as presented, seconded by Alderman Collins. Carried. CORRESPONDENCE: Received a letter from the Yellowstone County Commissioners regarding a committee to study consolidation of governments. They would like a repre- sentative from Laurel to serve on this committee. Received a letter from the Department of Commerce regarding a planning workshop in Lewistown and GlendiVe on June 2nd and June 4th, 1987. Received a memo from the Laurel Public Schools regarding a series of workshops demonstrating different problems and pressures high school students deal with every day. Received a notice from the Montana Municipal Insurance Authority regarding a Regional Loss Control Seminar. Received a letter of resignation from Georgia Kline effective April 14, 1987. Motion by Alderman Dickerson to accept Georgia Kline's resignation, seconded by Alderman Harris. Motion carried 8--0. CLAIMS: Claims for the month of April, 1987, were reviewed by the Budget/Finance Committee and recommended that they be paid. Motion by Alderman Harris to pay the claims for April, 1987, seconded by Alderwoman Kilpatrick. Motion carried 8--0. VILLAGE SUBDIVISION GARBAGE CONTAINERS: Petitions3were received from Wade Sanderson and George Fox to change from 300-gallon to 90-gallon garbage containers. The cost of new 90-gallon con- tainers, to serve the current residents, would be approximately $13,000. The 300-gallon containers now in use in Village Subdivision would be used to replace others in the City. Any residents moving in after the change would be responsible for purdaasing their own containers. There are currently 57 (300-gallon) containers as opposed to 200 (90-gallon) containers if the change takes place. Garbage pickup would be once a week and the residents would be responsible for having the container at the curb on pickup day. The City is now responsible for the 300-gallon cans if the wind blows them over, but the residents would be responsible with the smaller cans. Ken Tol~v~ & Wade Sanderson carried the petition to the residents and said they found a favorable response. The residents feel the wind wouldn't affect the smaller cans as much and also the can would be moved to a garage or to the rear of the property and not be such an eyesore to the property. One resident of Village Subdivision spoke up at the meeting that he was opposed to the change and that many of his neighbors also opposed it. Motion by Alderman Meyers to purchase 90-gallon garbage containers for Village Subdivision, seconded by Alderman Rodgers. Upon taking a roll call vote, Aldermen Rodgers and Meyers voted, "YES." Aldermen Wood, Collins, Orr, Dickerson, Harris and Alderwoman Kilpatrick all voted, "NO." Motion was defeated 6--2. Ken Tolliver again addressed the Council that all he wants is a solution to the problem of blowing garbage. He feels the City needs to solve this or allow them to utilize a private hauler. He stated the garbage conditions in Village Subdivision have turned away potential buyers, and the developers have spent approximately $25,000 to comply with City regulations for a system which is not working. This was referred back to the Garbage Committee for further discussion. ASPHALT SUPPLY: Ervin Wood stated that Asphalt Supply had an explosion and they never con- tacted the Fire or Police Departments. They were seen, by nearby residents, cleaning up the following day. Also, they have pipe for building purposes and Ervin checked with the City to see if they applied for a building permit. page2 Minutes of the City Council of Laurel They did and were told they didn't need one (the City had previously pulled their City license). Jim Flisrand stated that he contacted State officials. Jim Brown, Building Codes Bureau Chief, said the building code does not address process piping, which this is. It's an industry which is doing piping within its business, such as a refinery, a mill or an asphalt plant. The code does not cover it unless it's new building construction or relates to power, water or sewer. The Fire Marshal said the State does not require permits to enforce the fire code. The fire code is used for new construction, inspections or reports of violations. They can make adjustments to the system without a permit, but the Fire Marshal has the right to enter the premises and make an inspection any time, thus giving him the controlling hand. In conclusion Jim Flisrand said he cannot legally issue a building permit for work of that nature. Ervin Wood & Joe Bradley agreed that there is a need to have one phone number where people can call in complaints about Asphalt Supply. These calls need to be logged in a book. Alan Crowe stated he had no objection to the dispatchers taking these calls. Joe Bradley stated that there has been no trial date set for the Asphalt Supply law suit but we can assume that they will be in operation this season. He hopes some determination will be made before the spring season starts next year. CITY DUMP PROCEDURE: Ervin Wood stated he has received several calls concerning a fee being charged at the dump for people who pay City garbage. Jim Flisrand stated the City has an amendment to an ordinance concerning demolition fees. If the resident is doing work which requires a building permit, there is a fee which can be charged. In the past, when the City ran the landfill, this was not enforced. The City garbage fee is for normal household garbage and anything else can be charged for, according to our present ordinance. Jim stated the landfill contractor is taking this farther than he should because he is charging for brush and things of that nature, which the demolition fee does not address. L. D. Collins spoke to Magnus, who is a contractor, and he has no objec- tion to paying this fee when he does a job because he will pass the charge on to his customer; but, he would like to see the City set a rate so he knows what it is. Ernie Davis stated that residents are also being charged for disposing of such items as water heaters. Joe Bradley stated that it's the City's job to draw the line on what additional charges can be made. The Mayor, Jim, and Joe will draw up a letter of explanation of charges to be given to the landfill operators. PARKING ON THE TRUCK ROUTE: Ervin Wood has received complaints from residents concerning Mr. Herden, who parks his fifth-wheel rig on the City side of Railroad Street. Also when his tractor is parked in the driveway it blocks motorist's view from Woodland and Yellowstone. The overall feeling is that it's not that big of a problem. Joe Bradley stated he will review all the truck route and parking ordinances and report back to the Council. FIRE DISTRICT AGREEMENTS: RESOLUTION NO. 2273 A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND RURAL FIRE DISTRICT NO. 5, SAID AGREEMENT RELATING TO FIRE PROTECTION. Motion by Alderman D±ckerson that Resolution No. 2273 be passed and adopted, seconded by Alderman Meyers. Motion carried 8--0. RESOLUTION NO. 2274 A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND RURAL FIRE DISTRICT NO. 7, SAID AGREEMENT RELATING TO FIRE PROTECTION. Motion by Alderman Meyers that Resolution No. 2274 be passed and adopted, seconded by Alderman Orr. Motion carried 8--0. Rob Harris commented on the change in taxable valuation. RESOLUTION NO. 2275 A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND RURAL FIRE DISTRICT NO. 8, SAID AGREEMENT RELATING TO FIRE PROTECTION. page3 Minutes of the City Council of Laurel Motion by Alderman Dickerson that Resolution No. 2275 be passed and adopted, seconded by Alderman Orr. Motion carried 8--0. RESOLUTION NO. 2276 A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND AIRPORT AUTHORITY, SAID AGREEMENT RELATING TO FIRE PROTECTION. Motion by Alderman Collins that Resolution No. 2276 be passed and adopted, seconded by Alderman Rodgers. Motion carried 8--0. CURB, GUTTER & SIDEWALKS: ORDINANCE NO. 912 (second reading) AMENDING SECTION 11.08.030, TO ALLOW PERMITS FOR CUTTING CURBS, DRIVEWAY APPROACHES OR SIDEWALKS TO THE PROPERTY OWNER, OF THE LAUREL MUNICIPAL CODE. Public hearing - no comment. Motion by Alderman Meyers that Ordinance No. 912 (second reading) be passed and adopted, seconded by Alderman Orr. Upon taking a roll call vote all aldermen present voted, "YES" except for Alderman Rodgers who voted, "NO." Motion carried 7--1. SIGN CODE: ORDINANCE NO. 913 second reading) SECTION 17.68.020 IS HEREBY REPEALED Public hearing - no comment. Motion by Alderman Dickerson that Ordinance No. 913 (second reading) be passed and adopted, seconded by Alderman Collins. Upon taking a roll call vote all aldermen voted, "YES." Motion carried 8--0. COMMITTEE REPORTS: --Budget/Finance Committee minutes of May 5, 1987, were presented and reviewed. Motion by Alderman Harris to enter the Budget/Finance Committee minutes of May 5, 1987, into the record, seconded by Alderwoman Kilpatrick. Motion carried 8--0. The Mayor announced that budget meetingS begin on May 6th to start going over the 1987--88 preliminary budget. --City Council Committee of the Whole minutes of April 21, 1987, were presented and reviewed. Motion by Alderman Meyers to enter the City Council Committee of the Whole minutes of April 21, 1987, into the record, seconded by Alderman Collins. Motion carried 8--0. --Parks & Recreation Committee minutes of April 27, 1987, and May 4, 1987, were presented and reviewed. Motion by Alderman Dickerson to send two or more representatives to the Swimming Pool Seminar Wednesday, May 27, 1987, seconded by Alderman Meyers. Motion carried 8--0. Motion by Alderman Harris to enter the Parks & Recreation Committee minutes of April 27 and May 4, 1987, into the record, seconded by Alderman Collins. Motion carried 8--0. COMMENTS FROM THE AUDIENCE: Kelly Landon (2943 Cook Avenue, Billings, MT. 59102), representing the National Federation of the Blind, spoke on putting a small vending machine in City Hall. He was advised to apply for a City license. It was referred to the License Committee. Steve Dickey representing Sparkle Wash was seeking a license to wash and wax mobile homes, vinyl siding, trucks, etc., on location. Joe Bradley advised him to follow set procedure and go to the License Committee. He also needs to go before the Planning Board to seek a Home Occupation designation since he lives in a residential area. MAYOR'S COMMENTS: Mayor Gauthier appointed Sue Carter to the Library Board. Motion by Alderman Orr to confirm the appointment of Sue Carter to the Library Board, seconded by Alderman Meyers. Motion carried 8--0. Georgia Kline submitted a letter dated April 14, 1987, informing the City that she is retiring. Mayor Gauthier appointed Joe Meccage to the position of full-time dispatcher. Minutes of the City Council of Laurel Motion by Alderman Rodqers to confirm the appointment of Jo Meccage to full-time dispatcher, seconded by Alderman Dickerson. Motion carried 8--0. Mayor Gauthier appointed Cheryl Marshall to the position of permanent part-time dispatcher. Motion by Alderman Dickerson to confirm the appointment of Cheryl Marshall to permanent part-time dispatcher, seconded by Alderman Meyers. Motion carried 8--0. Motion by Alderman Dickerson to eliminate the temporary dispatcher position at the Police Department, seconded by Alderman Collins. Motion carried 8--0. Mayor Gauthier stated he will contact Bob Singleton concerning the tennis courts. Airport Authority appointments will be made at the next Council meeting. Discussion followed concerning water on the tennis courts. This will be addressed at a later time. Police Committee meeting scheduled for Thursday, May 7, 1987, will be cancelled. Donna Kilpatrick has submitted a letter of application to serve on the Study Commission for Consolidation. Mayor Gauthier spoke to Dwight McKay and Grace Edwards to let them know she is the Council's choice. There being no further business to come before the Council at this time, the meeting was adjourned at 8:39 p~~~~ Donald L.
