HomeMy WebLinkAboutCity Council Minutes 04.21.1987Minutes of the City COuncil of Laurel April 21, 1987 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Bob Gauthier at 7:04 p.m., on April 21, 1987. COUNCIL MEMBERS PRESENT: Donna Kilpatrick Chuck Rodgers L~ D. Collins Chuck Dickerson Donald Meyers Rob Harris Norman Orr COUNCIL MEMBERS ABSENT: Ervin Wood INVOCATION: Invocation given by Reverend Biller. MINUTES: Motion by Alderman Meyers to approve the minutes of the regular meeting of April 7, 1987, as presented, seconded by Alderman Collins. Carried. CORRESPONDENCE: Received a letter from Snow, Christensen, and Martineau, Attoreys at Law, regarding the Wastewater Treatment Plant. Received a letter from Volk Construction regarding the digestor tanks and punch list items at the Wastewater Treatment Plant. Received the minutes and activity report for March from the Yellowstone County Air Pollution Control office. Received a letter from Montana Department of Highways regarding the abandonment of public right-of-way on Highway #212 in front of Town Pump. CITY CLERK & CITY TREASURER'S FINANCIAL STATEMENT: The City Clerk and City Treasurer's Financial Statement for the month of March, 1987, was presented. Motion by Alderman Harris to approve the City Clerk and City Treasurer's Financial Statement for the month of March, 1987, seconded by Alderwoman Kilpatrick. Motion carried 7--0. Julie Landon, representing National Federation of the Blind (vending machines), was not present. TOWN PUMP, VACATING STREET: Jim Worthinqton, consulting engineer for Town Pump, spoke concerning the vacating of a portion of a street. He stated that the Highway Department has approved all the requests and applications. On March 20, 1987, the formal request to vacate the street was submitted to the City on their standard form, signed by Town Pump and also by the Highway Department. The Right-of-Way and Easement Divisions in Helena have determined that they would like to have the land transferred through a Certificate of Survey rather than by the regular method of purchasing property so many feet outside of the center line. Jim stated the item before the Council pertained to vacating a portion of 1st Avenue, which was dedicated under the original subdivision in 1932. This was dedicated before the highway came in and before it was extended down to the refinery. When the Highway Department came in and built the ramp and approach to town, they used that original street and also purchased some additional right-of-way. At present their proposal is to vacate that 30-ft. strip which was dedicated in the original subdivision plan. The Permit and Request of Application Permit before the Council, is requesting that these vacatings be signed by the property owners requesting the vacatings, and that it has been confirmed and agreed to by the Hiqhway Department, which is the adjacent owner. The way they are proposing the Certificate, which will be recorded for transfer of ownership, is that Tract A will be the plat of land that will be~vacated under the action before the Council now. Tract B is the remaining area that is highway right-of-way that they agreed to deed to Town Pump for their development. This allows full development outside of the 45-ft. right-of-way line, adjacent to property owned by Town Pump and the railroad right-of-way down to the north right-of-way line of 4th Street. This will give a continuous line. Part of the agreement of the purchase and transfer of this land is that curb and gutter will be installed by the developer of Town Pump, all the way down to 4th Street and around the radius so it gives full development access and approach to the Town Pump site. A letter was received from Gerald Charlton, who is a right-of-way engineer for the State of Montana, and he indicated the department has received Federal approval of the transfer due to the fact that, originally, Federal funds were used. The Highway Department has indicated that all require- ments have been met as far as the State is concerned. A public hearing will be held on May 19, 1987. Jim also informed Dave Michael that there is an easement for the sewer line. RESOLUTION NO. 2270 NOTICE OF INTENT TO VACATE CERTAIN LANDS IN THE CITY OF LAUREL. Motion by Alderman Dickerson that Resolution No. 2270 be passed and adopted, seconded by Alderman Meyers. Motion carried 7--0. A notice will be published in the Laurel Outlook on April 29th and also May 6th with a public hearing on May 19, 1987. BOAT RAMP ACCESS: Motion by Alderman Dickerson to remove the Perpetual Easement Agree- ment from the table, seconded by Alderman Meyers. Motion carried 7--0. RESOLUTION NO. 2271 APPROVING AN AGREEMENT,BETWEEN THE CITY OF LAUREL AND MONTANA STATE DEPARTMENT OF FISH, WILDLIFE & PARKS, SAID AGREEMENT RELATING TO PERPETUAL EASEMENT FOR BOAT RAMP ACCESS TO YELLOWSTONE RIVER. Motion by Alderman Meyers that Resolution No. 2271 be passed and adopted, seconded by Alderman Orr. Motion carried 7--0. DISPLAY OF ADDRESS NUMBERS: ORDINANCE NO. 910 (second reading) ADDING SECTION 15.14.010, DISPLAY OF ADDRESS NUMBERS, TO THE LAUREL MUNICIPAL CODE. Public hearing - no comments. Motion by Alderman Meyers that Ordinance No. 910 (second reading) be passed and adopted, seconded by Alderman Dickerson. Upon taking a roll call vote, all aldermen present voted, "YES." Motion carried 7--0. Discussion followed concerning number specifications. All numbers shall be arabic numerals, a minimum of 3~-in. and a maximum of 18-in. in height, having a minimum stem width of ½-in. and shall be of a contrasting color with the building. FINAL PLAT APPLICATIONS: ORDINANCE NO. 907 (AMENDED) (second reading) AMENDING SECTION 18.32.020, FINAL PLAT APPLI- CATION, TO PROVIDE THAT FINAL PLATS SHALL BE REVIEWED BY PLANNING BOARD, CITY ENGINEER, AND EXAMINING LAND SURVEYOR. Public hearing - no comments. Motion by Alderman Dickerson that Ordinance No. 907 (amended) (second reading) be passed and adopted, seconded by Alderman Orr. Upon taking a roll call vote, all aldermen present voted, "YES." Motion carried 7--0. ORDINANCE NO. 911 (second reading) AMENDING SECTION 18.32.030, REQUIRING SUBDI- VIDERS TO HAVE FINAL PLAT CHECKED FOR ERRORS AND OMISSIONS IN APPROPRIATE CASES. Public hearing - no comments. Motion by Alderman Dickerson that Ordinance No. 911 (second reading) be passed and adopted, seconded by Alderman Orr. Upon taking a roll call vote, all aldermen present voted, "YES." Motion carried 7--0. CURBS, SIDEWALKS AND DRIVEWAYS: ORDINANCE NO. 912 (first reading) AMENDING SECTION 11.08.030, TO ALLOW PERMITS FOR CUTTING CURBS, DRIVEWAY APPROACHES OR SIDEWALKS TO THE PROPERTY OWNER, OF THE LAUREL MUNICIPAL CODE. Motion by Alderman Dickerson that Ordinance No. 912 ~firs~ reading) be passed and adopted, seconded by Alderman Meyers. Upon taking a roll call vote, Aldermen Harris, Collins, Dickerson, Meyers and Alderwoman Kilpatrick voted, "YES." Aldermen Rodgers and Orr voted, "NO." Motion carried 5--2. SIGN INSTALLATION: ORDINANCE NO. 913 (first reading) page 3 Minutes of the City Council of Laurel SECTION 17.68.020 IS HEREBY REPEALED. Motion by Alderman Dickerson that Ordinance No. 913 (first reading) be passed and adopted, seconded by Alderman Collins. A roll call vote was taken and all aldermen present voted, "YES." Motion carried 7--0. UNDERPASS LIGHTS - ENERGY COSTS: RESOLUTION NO. 2272 APPROVING AN AGREEMENT BETWEEN THE CITY OF LAUREL AND THE MONTANA POWER COMPANY, SAID AGREEMENT RELATING TO FOUR CITY OWNED 70 WATT RECESSED UNDERPASS LIGHTS. Discussion concerning who should be responsible for the energy costs of the underpass lights. The Chamber of Commerce had the lights installed, and now Montana Power wants to know who to charge for the energy. It was decided the City would be responsible at a cost of $1.81 per fixture per month for an approximate cost of $88.00 per year. Motion by Alderman Meyers that Resolution No. 2272 be passed and adopted, seconded by Alderman Orr. Motion carried 7--0. COMMITTEE REPORTS: --Ambulance Committee minutes of April 14, 1987, were presented and reviewed. Motion by Alderman Dickerson to enter the Ambulance Committee minutes of April 14, 1987, into the record, seconded by Alderman Orr. Motion carried 7--0. --Budget/Finance Committee minutes of April 7, 1987, were presented and reviewed. Motion by Alderman Harris to enter the Budget/Finance Committee minutes of April 7, 1987, into the record, seconded by Alderman Dickerson. Motion carried 7--0. --Garbaqe COmmittee minutes of April 20, 1987, were presented and reviewed. The decision regarding the use of 90-gal. garbage containers in Village Subdivision was delayed until a future date. Motion by Alderman Meyers to enter the Garbage Committee minutes of April 20, 1987, into the record, seconded by Alderman Dickerson. Motion carried 7--0. --Public Utilities Committee minutes of April 13, 1987, were presented and reviewed. Discussion concerning the adjustment of sewer rates. Motion by Alderman Meyers to accept the committee's recommendation to adjust the sewer rates for: K. Miller E. Swan A. Eisenbraun D. Shriner H. Sorg M. Winkler The motion was seconded by Alderman Dickerson. Carried 6--1 with Alderman Orr voting, "NO." Motion by Alderman Meyers to accept the committee's recommendation to enforce the ordinance regarding pigtailing of waterlines, seconded by Alderman Dickerson. Motion carried 7--0. Motion by Alderman Dickerson to enter the Public Utilities Committee minutes of April 13, 1987, into the record, seconded by Alderman Meyers. Earl Linger's curb, gutter & driveway approach Discussion followed regarding the cutting of asphalt from Earl Linger's driveway approach during road repairs by the State. He would like his driveway approach replaced. Motion by Alderman Collins to direct Jim Flisrand to write a letter to the State regarding Earl Linger's curb, gutter and driveway approach, seconded by Alderman Dickerson. Motion carried 7--0. Motion by Alderman Collins to enter the Street & Alley Committee minutes of April 16, 1987, into the record, seconded by Alderman Orr. Motion carried 7--0. MAYOR'S COMMENTS: Consolidation Committee Discussion followed regarding the Consolidation Committee of Billings. The Mayor has been contacted by Dwight McKay and also committee representa- tives John Hedges and Jim Van Arsdale about having a representative from Laurel participate on the committee. This will be a study commission to look into the consolidation of all services. The Mayor asked those who are interested in participating to submit an application to him and he will, in turn, submit them to Dwight McKay by the deadline of May 8, 1987. Swimming Pool Manager Mayor Gauthier appointed Janice Keller as swimming pool manager. Motion by Alderman Meyers to confirm the appointment of Janice Keller as swimming pool manager, seconded by Alderman Orr. Motion carried 7--0. Assistant Pool Manager Mayor Gauthier appointed James Malin as assistant pool manager. Motion by Alderman Orr to confirm the appointment of James Malin as assistant pool manager, seconded by Alderman Dickerson. Motion carried 7--0. Recreation Director Mayor Gauthier appointed Anne Easton as recreation director. Motion by Alderman Orr to confirm the appointment of Anne Easton as recreation director, seconded by Alderman Dickerson. Motion carried 7--0. Permission to Leave the State Don Hackmann, City Clerk, requested permission to leave the State April 24 to May 3. Motion by Alderman Meyers to grant Don Hackmann permission to leave the State, seconded by Alderman Harris. Motion carried 7--0. Peg Kamerzel, City Treasurer, said there had been some confusion regarding the business license of Big Sky Motor when they moved to their east end location. Joe Bradley stated the "non transferable" in the license means from one person to another. A business can change location and operate under the same license. Big Sky Motor paid the $10 for a fire inspection. It was done by Dick Metzger, and everything was alright. There being no further business to come before the Council at this time, the meeting was adjourned at 8:14 p.m. Donald L.
