HomeMy WebLinkAboutCity Council Minutes 01.06.1987Minutes of the City Council of Laurel January 6, 1987 A regular meeting of the City Council of the City of Laurel, Montana, was held in the Council Chambers and called to order by Mayor Bob Gauthier at 7:02 p.m., on January 6, 1987. COUNCIL MEMBERS PRESENT: Ervin Wood Chuck Dickerson Mel Krug Rob Harris L. D. Collins COUNCIL MEMBERS ABSENT: Donna Kilpatrick Donald Meyers Norman Orr INVOCATION: Invocation given by Alderman Krug. MINUTES: Motion by Alderman Kruq to approve the minutes of the regular meeting of December 16, 1986, as presented, seconded by Alderman Collins. Carried. CORRESPONDENCE: Received the Montana Municipal Insurance Authority's December Newsletter. Received "High Water," a flood plain management newsletter. Received a letter from the Montana Department of Administration regarding the financing of the statewide 9-1-1 program. Received a memo from the Montana League of Cities & Towns requesting infor- mation on taxable value, mill levies, number of employees, cost of State mandated programs, etc. Received a letter of resignation from Rev. Paul Peterson of the Laurel Ambulance Service, effective January 24, 1987. Motion by Alderman Dickerson to accept the resignation of Rev. Paul Peterson from the Laurel Ambulance Service effective January 24, 1987, seconded by Alderman Krug. Motion carried 5--0. CLAIMS: Claims for the month of December, 1986, were reviewed by the Budget/Finance Committee and recommended that they be paid. Motion by Alderman Harris to pay the claims for December, 1986, seconded by Alderman Krug. Motion carried 5--0. FINAL PLAT - LITTLE SCOTTIE MOBILE HOME PARK: The Final Plat was presented for approval. The landscaping will be done later due to the weather. Cal Cumin, Cumin Associates Another issue did come up during the processing of this final plat. It has nothing to do with the subject of this plat, but it's the procedure for final plats. Rick Leuthold, the engineer, indicated that the final plat should have or would have a signature for "examining land surveyor" and I said, "I don't care about an examining land surveyor. I want the City Engineer's signature on it because that's what is important to me and to the City". The City Engineer looks at these to see that all the water, sewer, and street hookups work right. Between Jim, myself, and Rick Leuthold we got into this argument about the law says you shall have an examining land surveyor. So it now has come before you whether you want an examining land surveyor or not. My feeling is you do not need an examining land surveyor on a subdivision plat because it is prepared by a professional surveyor. In the Administrative Regulations of Montana, not the State code, but the Administrative Regulations of the Department of Commerce says, "You shall have an examining land surveyor, if applicable." The State taw says, "The City may require an examining land surveyor." My feeling is we don't need a second surveyor. Joe Bradley We don't have to do it, but we can require it if we want to. If we want to require it, then we will have to contract out because Jim can't do it. If we don't want to require it, Jim can't sign the paragraph that says he has checked it for errors and omissions because he is not going to be able to do that. He's only checking it in order to make sure it satisfies him but he's not going to swear that it's correct. It's being extra careful and if we could collect it from the developer, I don't see that the City is hurt; although, like Cal says, it's just "make work." That's your decision. Motion by Alderman Kruq that a review by a registered land surveyor is not required for this plat, seconded by Alderman Collins. Motion carried 5--0. RESOLUTION NO. 2262 APPROVING LITTLE SCOTTIE MOBILE HOME PARK Motion by Alderman Harris that Resolution No. 2262 be passed and adopted, seconded by Alderman Krug. Motion carried 5--0. ENGINEER'S PROPOSAL - EAST MAIN LIFT STATION: Jim Flisrand presented a proposal from Roger Perkins for the East Main Lift Station. page2 Minutes of the City Council of Laurel The first proposal from Jim Worthington was $5,000.00. For the same type of construction Mr. Perkin's bid was $6,132.00. Mr. Perkins also submitted a bid using fiberglass, but Jim Worthington had not. Motion by Alderman Dickerson to table this matter until the next Council meeting, so Jim Worthington can make a proposal for a fiberglass unit, seconded by Alderman Wood. Motion carried 4--1 with Alderman Harris voting, "NO." There was discussion on whether this matter should have been tabled since the amount of the bids were already known. Motion by Alderman Krug to reconsider the motion to table the engineer's proposals for a new lift station, seconded by Alderman Collins. Division of the house: Aldermen Dickerson and Wood voted, "NO" Aldermen Harris, Krug and Collins voted, "YES." Motion carried 3--2. A vote was taken on the original motion to table, which was defeated 4--1 with Alderman Dickerson voting, "NO." It was finally decided to consider only the bids for a new lift station since that was what was originally asked for. Motion by Alderman Krug to award the engineering bid on a new lift station to Cashell Engineers in the amount of $5,000.00, seconded by Alderman Collins. Division of the house: Aldermen Collins, Krug and Wood voted, "YES." Aldermen Harris and Dickerson abstained. Motion carried: 3 in favor, none against, and 2 abstaining. COMMITTEE REPORTS: --City Council Committee as a Whole minutes of December 16, 1986, were presented and reviewed. Motion by Alderman Krug to enter the City Council Committee as a Whole minutes of December 16, 1986, into the record, seconded by Alderman Collins. Motion carried 5--0. --Street & Alley Committee minutes of December 18, 1986, were presented and reviewed. Motion by Alderman Krug to pay $208.60 or less to Darlene Steinmetz for sod replacement in SID 108, seconded by Alderman Dickerson. Motion carried 5--0. Motion by Alderman Krug to enter the Street & Alley Committee minutes of December 18, 1986, into the record, seconded by Alderman Dickerson. Motion carried 5--0. COMMENTS FROM THE AUDIENCE: Cam Calvert asked who had approved the easement on the Steinmetz property. Jim Flisrand told Cam the easement had been approved the way it was because of the fact that a sanitary sewer was already there. Cam then questioned the policy of accepting the bids on sod replacement. The response was sealed bids had not been asked for. Dick Metzger informed the Council that he did not feel that it was fair that he had to rebid on the 1962 Dodge crew cab. MAYOR'S COMMENTS: Bob Gauthier said that he would make some appointments at meeting and that he would like to leave the committees as year. BIDS FOR 1962 DODGE CREW CAB: (Refer to City Council minutes of December 16, 1986) Richard A. Metzger $35.01 Ernie Davis $105.00 Motion by Alderman Collins to accept the high bid on the 1962 Dodge crew cab, seconded by Alderman Krug. Motion carried 5--0. LANDFILL HOURS: The landfill hours will be in the Laurel Outlook. The Mayor announced that there would be a Personnel meeting following the Council meeting. Chuck Dickerson said that he had been asked about the progress of the con- struction of the new Nursing Home. Jim said that concrete should not be poured on frozen ground.
