RESOLUTION NO. 117.

A resolution of intention to create Special Improvement
District No, 23 within the City of Leurel,Montana,for the purpose
of paving Main Street and certain intersecting streets and avenues;
describing the boundaries of such district;stating the general
character of the improvements to be made, and the approximate
estimate of the cost thereof, and the portion of the cost which it
is proposed to have paid by special assessment; fixing the time when,
and the place where, the City Council will hear objections thereto.
NOW, THEREME, BE IT RESOLVED, BY THE CITY COUNCIL OF
THE CITY OF LAUREL, MONTANA;
SECTION 1. That the public interest and convenience
requires the creation of a special improvement district as herein-
after particularly described, and the intention of said Council to
create such district is hereby declared.
SECTION 2. Th"t the number of said Special Improvement
District is hereby declared to be No. 23.
SECTION 3. That the boundaries of said Special Improvement
District are hereby fixed and described as follows:
A line on the center of each street and alley herein-
after named in each case,ex6enUng to intersect the center line of
each street and alley subsequently named at their crossing,beginning
at a point at the intersection of the alley in block 28 of the Allard
Subdivision with the East boundary line of the City of Laurel, thence
running southwesterly along said alley to the intersection of the
Nartbrand South alley with the East and West alley of block 2 of the
Laurel Realty Subdivision, thtnoe Northwesterly along said alley to
the intersection of the said alley wihh First Street, thence South-
westerly along said First Street to the intersection of said First
Street with Montana Avenue, thence North along Montana Avenue to
the intersection of the East and West alley of block 7 of the Laurel
Realty Subdivision, thence West along said alley to the intersection of

Pest boundary line of Lot 4 of said block, and thence along said
boundary line of Lot 4 to the intersection of the said boundary

alley of Block 7 of the Youngs Second Subdivision with the West
boundary line of the City of Laurel, and thence South along said
boundary line to the inte rsection of a line drawn parallel to Main
Street, and 130 foot South from the South boundary line of said
Main Street, and thence East along said lin* to the intersection of said
line with a line drawn at right angles from the Southwest corner of
Block 3 of East Laurel, extending, 130 foot South of the South boundary
line of Main Street,and thence Northwesterly on the said line,
parallel to Main Street, to the intersection of a line drawn parallel
to First Avenue,at a distance 130 foot Vest of the West boundary
line of tahd Avenue,thence South along a line drawn and parallel to
and 130 foot West of the West boundary line pf First Avenue, to the
intersection of the said line with a line drawn at right angles
130 foot distant in a Southwesterly direction from a point at the
intersection of the East boundary line of Block 29 of Yellowstone
Subdivision with the East boundary line o the Northern Pacific

Improvement District will contain and include all lots,blocks, and
parcels of land within the boundaries of such district,as above
described,except streete,avenues,alleys and public places. The

SECTION 4. That the approximate estimate of the cost of
constructing and acquiring the proposed izprovements*ie $240485.68

That said improvements adjavent to blocks 1,2 and 3, in the
Townsite of East Laurel, and 1,2, and 3, in the Laurel Realty Sub-
division,consists principally of 17,491 sq.yde. of Macadam, 5,700

cu.yds.excavation sub-grade, 480 feet inch tile in place,

Macadam road, and 800 cu.yds. of excavation,together with the
installation of the other accessories necessarl for the proper
completion of said Macadam noads.
That the approximate estimate of the cost of constructing
and acquiring the proposed improvernentsAis $47,748.35.
GRAVEL BITULITHIC 07 A FOUR INCH CONCRETE BASE.
That the said improvements adjacent to blocks 1,2, and 3,
in the Townsite of East Laur,1, and 1,2, and 3, in the Laurel Realty

That the approximate estimate of the cost of constructing
and acquiring the proposed improvementsnis $432950.15.
GRAVEL BITULITHIC10N A MIXED BASE.
That the said improvements adjacent to blocks 1,2, and 3,
in the Townsite of East Laurel, and 1,2, and 3, in the Laurel Realty
Subdivision,consists principally of 17,491 sq.yds. of gravel
Bitulithic on a mixed base, 50700 cu.yds.excavation sub-grade,480
feetl? inch tile in place, 10 inlet basins for drains, 370 linear feet

SECTION 5. AThat the entire cost of making acid
i provements shall be paid by special assessment to be levied
u on the lots and parcels of land situate within the boundaries of
the said district as above described. That the assessments shall
be spread upon an area basis as presofibed in Sec. 14 Sub. 1 A of
Chapter 89 of the Thirteenth Session Laws of 1913. And as the
improvements which are to be constructed is not uniform thruout
the entire district, the said special improvement district shall
be. ekbdivided into three subdivisions, known as A,B, and C, for the
purpose of equally assessing the property situate within said
district, and thz lots anr' parcels of land situate within the
said subdivision A.B., and C. shall be assessed for that part of
the whole cost of said improvements constructed within any subdivision
which their area bears to the area of the entire dubdivision of which
they are a part of,within the said special improvement district,
exclusive of streete,avenues,alleys and pVblic placer.
B. That 4kid subdivision A, shall embrace w ithin its
boundaries all that property abutting adjacent to or within 130
foot distant from the boundary of the said street,avenue or
alley,wherein the said Macadam asphalt finish roadway or gravel
Bitulithic pavement is construoted.
C. That subdivision B. of the said special improvement
district shall embrace within its boundaries all that land or
property adjacent and abutting or within 130 foot distant from the
boundary line of the said street,avenue, or alley wherein the said
18 foot Macadam roadway is to be constructed.
D. That said subdivision C. of the said Special
improvement District shall embrace within its boundaries all
that land or property adjacent to or abutting or within 130
foot distant from the boundary line of the street,avenue or
alley,wherein the said 10 foot Macadam roadway is to be constructed.

SECTION 6. That said special assessment shall be
paid in twelve eeNal annual installments, and all funds received
from the payment of such special assessment shall constitute a
separate fund to be known as "Fund of Special Improvement District
No. 23".
SECTION 7. That on the Ath day of July, A.D.1916, at
eight otclock P.M. is hereby designated as the time, and the
Council Chmaber of.the City Hall, at Laurel,Montana, as the
place at which the Council will hear and pass upon all protests
that may be made against the making of such improvements or the
creation of such district.
SECTION 8. That notice of the passage of this resolution
shall be published in the Laurel Outlook, a weekly newspaper of
general circulation in the said city of Laurel in one regular
Issue thereof at least fifteen days prior to the said 18th day of
July,A.D.1916, such notice shall bs,/cribe the general character
of the improvements hereby propooed to be made and shall state the
estimated cost thereof and declare the time when, and the place
where, the Council will hear and pass upon all protests that may
be made against the making of such improvement or the creation of
such district,said notice shall refer to this resolution on file
in the office of the City Clerk for the description of the
boundaries of said di&rict. The City Clerk is hereby directed to
mail a copy of such notice to every firm,or corporation, or the
agent of such person,ftra or corporation, having property within
the boundaries of the proposed district, at his, their, or its
last known address. Such copy to be mailed upon the same day
that said resolution is published as hereinabove ordered.

SECTION 9* That this resolution be, and the same
is, hereby declared to be an emergency measure, providing for
and including only such measures as are immediately necessary
for the Dreservation of -,eace,health and safety,and as such
emergency resolution, shall be in full force and effect from
and aster its passage and approval.
PROVISIONALLY Passed by the City Council and approved
by the mayor this 20th day of June, A.D.1916.
