HomeMy WebLinkAboutCity Council Minutes 10.03.1989Minutes of the City Council of Laurel October 3, 1989 A regular meeting of the City Council of the City of' Laurel, Montana, was held in the Council Chambers and called to order by Mayor Bob Gauthier at 7:00 p.m., on October 3, 1989. COUNCIL MEMBERS PRESENT: Chuck Dickerson Norman Orr Donna Kilpatrick Bob Graham Chuck Rodgers Bruce Teeters L.D. Collins COUNCIL MEMBERS ABSENT: Ron Marshall INVOCATION: Invocation was given by Reverend Holt. MINUTES: Motion by Alderman Dickerson to approve the minutes of the regular meeting of September 19~ 1989, as presented, seconded by Alderman Orr. Motion carried 7--0. CORRESPONDENCE: Received the City-County Health Department's annual report. Received a report from Linda Williams regarding the V.A. Nursing Home meeting which was held on September 28th. CLAIMS: Claims for the month of September were reviewed by the Budget/Finance Colamittee and recommended that they be paid. Mo~t~ by Alderwoman Kilpatrick to approve all claims in the amount of $ 122,758.49 for the month of September, 1989~ seconded by Alderman Collins. Motion carried 7--0. BID OPENING - NEW POLICE CAR: This being the time and place advertised, all bids received were opened and read aloud. The Mayor referred the bids to the Police Committee for a recommendation at the next council the recommendation of the Parle the Port Authority Nominating AWARD BID FOR THOMSON PARK PROJECT: No bids were received. It was Committee to re-advertise the bid. CAL CUMIN - PORT AUTHORITY: The Mayor appointed himself to Commission. Page2 Minutes of the City Council of Laurel Council Meeting of October 3, 1989 Motion by Alderman Dickerson to confirm the Mayor's appointment of himself to the Port Authority Nominating Commission and to have an ordinance drawn up for the next council meeting recognizing the Port Authority, seconded by Alderman Orr. Motion carried 7--0. REQUEST FOR PUBLIC HEARING - SWECKER APPLICATION FOR GROUP HOME: Joe Bradley said the request for the public hearing came from the Planning Board which at its last meeting held a public hearing on an application for special review submitted by Mr. & Mrs. Swecker. They are foster parents at this time and are seeking state licensing for a group home. Joe said that as foster parents they can have no more than six children but as a group home they can care for up to twelve children. The number of children allowed is based on the square footage of the home as set by state regulations. The Swecker's application is to have seven children under the group home designation and at the present time they have only six. They are going through this process to obtain one more child. Joe said the Planning Board recommended that the Council hold its own public hearing. Motion by Alderman Collins to set up a public hearing on the Swecker application, seconded by Alderman Orr. Motion carried 7--0. The Planning Board's recommendation and the call for the public hearing will be published twice in the newspaper and the public hearing will be set for November 7, 1989. PUBLIC HEARING ON SPECIAL REVIEW FOR DR. KRAYTON KERNS: Dr. Krayton Kerns of Beartooth Veterinary Service is seeking a Special Review to build another building behind his existing one to board dogs. Joe Bradley said the Planning Board held a public hearing and no one came to the hearing, no one had any adverse comments~ no neighbors have complained and no letters were received. In response to the public hearing, the Planning Board recommends that the council not hold a second public hearing. Motion by Alderman Dickerson that the council not hold a public hearing on the Kerns application~ seconded by Alderwoman Kilpatrick. Motion carried 7--0. LIMITING NUMBER OF PIGEONS TO BE KEPT WITHIN THE CITY LIMITS: ORDINANCE NO. 955 (second reading) AMENDING SECTION 7.04.020 OF THE LAUREL MUNICIPAL CODE TO ALLOW A LIMITED NUMBER OF PIGEONS TO BE KEPT WITHIN CITY LIMITS Public Hearing: no comments. Motion by Alderman Dickerson to close the public hearing, seconded by Alderman Orr. Motion carried 7--0. Motion by Alderman Orr that Ordinance No. 955 (second reading be passed and adopted~ seconded by Alderman Collins. A roll call vote was taken and Aldermen Graham, Dickerson and Alderwoman Kilpatrick voted~ "NO." Aldermen Orr~ Teeters~ Rodgers and Collins voted~ "YES." Motion carried 4--3. COMMITTEE REPORTS: --Budget/Finance Committee minutes of September 9, 1989 were presented and reviewed. Motion carried 7--0. --City Council Committee of the Whole minutes of September 19, were presented. 1989 Motion by Alderman Dickerson to enter the City Council of the Whole minutes of September 19, 1989, into the record, by Alderman Rodgers. Motion carried 7--0. Committee seconded --City-County Planning Board minutes of September 14, 1989 and September 21, 1989 were presented and reviewed. Motion by Alderman Dickerson to enter the City-County Planning Board minutes of September 14, 1989 and September 21, 1989, into the record, seconded by Alderwoman Kilpatrick. Motion carried 7--0. --Fire Committee minutes of September 26, 1989 were presented and reviewed. Motion by Alderman Rodgers to enter the Fire Committee minutes of September 26, 1989, into the record~ seconded by Alderman Collins. Motion carried 7--0. --Park Committee minutes of October 2, 1989 were presented and reviewed. Motion by Alderwoman Kilpatrick to re-advertise for of the concession/bathroom building for Thomson Park, Alderman Collins. Motion carried 7--0. construction seconded by Motion by Alderwoman Kilpatrick to accept the committee's recommendation to not get involved in funding the lights in Thomson Park, seconded by Alderman Orr. Motion carried 6--1 with Alderman Graham voting, "NO." Motion by Alderwoman Kilpatrick to enter minutes of October 2, 19897 into the record, Dickerson. Motion carried 7--0. the Park Committee seconded by Alderman --Thomson Park Shelter Committee minutes of September 20, 1989 were presented and reviewed. Motion by Alderwoman Kilpatrick to enter the Thomson Park Shelter Committee minutes of September 20, 1989, into the record, seconded by Alderman Dickerson. Motion carried ?--0. COMMENTS FROM THE AUDIENCE: Motion by Alderman Graham to suspend the rules to allow reconsideration of the Cantrell application for de-annexation. seconded by Alderman Dickerson. Motion carried 6--1 with Alderman Collins voting, "NO." Bob Graham commented that he would like to see the city get this land and use it as a possible trade for land for a transfer site. When the landfill closes, Laurel will need land on which to put a transfer site and instead of having to buy land out of the budget we could possibly trade for it at no cost to the city. Bob stated that if Cantrell's proposal is voted down, where is the city going to get money for a transfer site? Joe Bradley stated this item will be put on the agenda for the next meeting and at that time someone who voted against the resolution can make the motion to reconsider it. Chuck Dickerson questioned where Bradley stated he will check with meeting. the codification stands now. Joe them and report back at the next Page Minutes of the City Council of Laurel Council Meeting of October 3, 1989 The Park Committee meeting will be changed from October 12th to Wednesday the 18th. Public Utilities Committee meeting will be held on October 10th instead of the 9th because it is a holiday. Chuck Dickerson suggested having the first council meeting in November on Thursday the 9th due to the election on Tuesday and the Centennial Ball in Helena on Wednesday. After a discussion it was decided to leave the regular council meeting as scheduled on Tuesday, November 7th at 7:00 p.m. MAYOR'S COMMENTS: AIRPORT AUTHORITY APPOINTMENT: The Mayor appointed Roy Zahm to the Airport Authority. Motion by Alderman Dickerson to confirm the Mayor's appointment of Roy Zahm to the Airport Authority~ seconded by Alderman Orr. Motion carried 7--0. PLANNING BOARD APPOINTMENT: The Mayor stated there is one opening on the Planning Board but he will delay this appointment until he confirms whether it is a council appointment or the Mayor's appointment. The only applicant is Linda Williams. POLICE COMMISSION APPOINTMENT: There is one opening on the Police Commission and applications were received from Bob Strand, Richard Barnhart and Steve Hollingshead. The Mayor asked Alan Crowe how soon he needed to have this position filled and Alan stated an officer has turned in his resignation and he will need to fill this position~ but the next council meeting will be soon enough. There being no further business to come before the Council at time, the meeting was adjourned at 7:63 p.m. Donald L.
